EC to hold bypoll in Wayanad LS seat earlier held by Rahul Gandhi

The Election Commission has initiated the process to hold a bypoll in the Wayanad Lok Sabha seat which Congress leader Rahul Gandhi had held until he was disqualified following his conviction in a criminal defamation case over his "Modi surname" remark. A court in Gujarat had sentenced Gandhi to two years in jail, following which the Lok Sabha Speaker disqualified him from the lower house. A communication sent to recognised political parties by Kozhikode deputy collector on June 5 in his capacity as district election officer said that a mock poll after verification of the Electronic Voting Machines and Voter Verifiable Paper Audit Trail (VVPAT) systems will be held on June 7 ahead of the Wayanad Lok Sabha constituency bypoll. The parties were informed that the mock poll and verification of the EVMs and VVPAT system will be held at the Kozhikode Civil Station Aswasakendram Godown. The Election Commission's move comes at a time when Gandhi's criminal revision application against the

EC should tell people why no elections in Jammu and Kashmir: Omar Abdullah

National Conference leader Omar Abdullah on Tuesday said the Election Commission should muster courage to tell people why assembly elections in Jammu and Kashmir are not being held. "Is there a pressure on them (EC) not to hold elections? Let the Election Commission show some courage and say that they are under pressure. There is something fishy," Abdullah told reporters outside the party headquarters here. Abdullah, a former chief minister, said the Election Commission should be asked when it plans to hold elections in Jammu and Kashmir. "The media seems to be more concerned about the elections than us. Election is our right but we are not going down on our knees for it. If they want to snatch the right of people of Jammu and Kashmir, if they get some pleasure out of it, let them do it. We also have some self-respect and dignity, he said. He said the Chief Election Commissioner, during his last visit to the Union territory, admitted that there was a vacuum in Jammu and Kashmir. "

EC's allotment of Shiv Sena name to Shinde faction a prospective decision

Maharashtra Legislative Assembly Speaker Rahul Narwekar on Tuesday said the Election Commission's decision to allot the 'Shiv Sena' name and its symbol to the faction led by Chief Minister Eknath Shinde is a "prospective" decision and not restropective. Speaking to reporters here after a meeting with some officials in the Vidhan Bhavan, Narwekar also said the decision on disqualification of 16 MLAs including CM Shinde will start from the point of which faction was representing the actual Shiv Sena in July 2022. The Speaker on Monday also said that after the Supreme Court's May 11 verdict, he will have to first recognise in the House which faction of the Shiv Sena is the political party before going ahead with any other decision. In its verdict on the Shiv Sena-centric tussle that led to the fall of the Maha Vikas Aghadi (MVA) government in Maharashtra last year, the Supreme Court said it can't reinstate the then chief minister Uddhav Thackeray as he chose to resign without facing th

EC rejects charge that EVMs used in K'taka were deployed in South Africa

The Election Commission (EC) rejected the Congress's claim on Thursday that the electronic voting machines used in the May 10 Karnataka Assembly polls were previously deployed in South Africa and asked the party to "publicly expose" the sources that spread such false information. In a letter addressed to Congress leader Randeep Singh Surjewala, the EC said it had used new EVMs manufactured by Electronics Corporation of India Limited for the polls in the southern state. In a letter written to the poll panel on May 8, the Congress had raised concerns and sought clarifications regarding the "re-use" in the Karnataka election of EVMs previously used in South Africa and that too, without going through the process of revalidation and re-verification The poll panel asserted that neither EVMs were sent to South Africa nor does that country use those machines. Citing records, it said the Congress had specific knowledge that only newly ECIL-produced EVMs would be used in Karnataka. The EC s

Social media appeal to voters outside polling area not under law: EC

With the Congress accusing Prime Minister Narendra Modi of violating the law by issuing appeals to Karnataka voters through social media during the "silence period", sources in the Election Commission on Tuesday said such appeals made outside the polling area do not come under the ambit of the existing law. The law, as exists, prohibits the act "in any polling area" only, they said. They also said the parties alleging violation of Section 126 of the Representation of the People Act through the use of social media have themselves put up a number of such posts even on their official social media handles. Section 126 specifically does not cover the use of social media or intermediaries during the silence period. It also does not cover violations outside the poll area, the sources said. Section 126 of the Act restricts the public display of election matter in the polling area during the "silence period" thereby limiting its application only to the display of election matter in the poll

EC notice on 'rate card' ads: Cong seeks time to submit detailed response

The Congress has accused the Election Commission of "bias" over its notice on the party's "corruption rate card" advertisements targeting the BJP government in Karnataka and said its leaders are held to a standard that seems reserved only for the Opposition. Despite the Congress bringing to the EC's notice on numerous occasions the "brazen and repeated" violations of electoral guidelines by Prime Minister Narendra Modi and other BJP leaders, the commission has not issued one notice or condemnation, the Congress said on Sunday. In the Congress' "preliminary response", party leader and lawyer Abhishek Manu Singhvi also said the 24-hour window provided by the EC for responding to the notice was insufficient with the Karnataka assembly poll campaign drawing to a close. The EC had on Saturday issued a notice to the Karnataka Congress over its "corruption rate card" advertisements published in newspapers in the run-up to the May 10 state polls and sought "empirical evidence" to prove its

No advertisement without clearance during silence period in K'taka: EC

No party or candidate shall publish any advertisement in the print media on poll day and one day prior without clearance from the media certification and monitoring committee, the Election Commission said on Sunday in an advisory ahead of the May 10 voting in Karnataka. Campaign for the Karnataka assembly elections is set to end on Monday. In the advisory to political parties, the poll authority also emphasised on "clean and serious" campaign as electioneering reached feverish pitch for the polls. In a separate letter to editors, the Election Commission (EC) made it clear to them that the Press Council of India's norms for journalistic conduct hold them responsible for all matters, including advertisements, published in their newspapers. "If responsibility is disclaimed, this shall be explicitly stated beforehand," the Commission said in a letter to editors of newspapers in Karnataka. The advisory to political parties stated that advertisements during the silence period -- on the

Congress lodges complaint with EC against PM for invoking name of Hanuman

Congress on Thursday lodged a complaint with the Chief Electoral Officer against Prime Minister Narendra Modi for invoking the name of Lord Hanuman in the election rallies in Karnataka. Modi in his election rally since May 2 has been hitting out at the Congress for promising a ban on the right-wing outfit Bajrang Dal and equated the ban with "locking up" Bajrangbali, Lord Hanuman. Modi also chanted Jai Bajrangbali' in all the three speeches in Karnataka on Wednesday. The Congress asked the Election Commission to restrain Modi from taking up the names of Hindu Gods, according to the advisory. It also wondered whether the ban on Sri Ram Sene some years ago by then BJP chief minister Late Manohar Parrikar amounted to an insult to Lord Rama or if the BJP's betrayal of Shiv Sena is considered an insult to Lord Shiva. "The Prime Minister in his address at public rallies spoke critically of the Congress party and in the melee attempted to portray the Congress party as anti-Hindu by takin

BJP urges EC to file criminal case against Kharge for poisonous snake barb

A BJP delegation on Friday met the Election Commission and requested the poll panel to register a criminal case against Congress president Mallikarjun Kharge and bar him from campaign in the Karnataka assembly polls over his "poisonous snake" barb at Prime Minister Narendra Modi. Union minister Bhupender Yadav, who led the BJP delegation, told reporters that Kharge's comment was not merely a slip of the tongue but part of the Congress' "hate politics". BJP general secretary Tarun Chugh said Kharge is a "habitual offender". Yadav said the Congress has a history of launching personal attacks on Modi. The BJP has demanded registration of an FIR under IPC Sections 499 and 500, which deal with defamation, and Section 504, which deals with the offence of deliberate insults and provocation. The delegation also included BJP chief spokesperson Anil Baluni and party leader Om Pathak. Union Minister Shobha Karandlaje has demanded action against Congress state president D K Shivakumar for allegedly seeking bribe while issuing B-Forms to his party candidates ahead of filing nominations for the May 10 Assembly election in Karnataka. The last date of filing nominations was on April 20 and the submitted papers were scrutinised by electoral officials on Friday. Reports on defective VVPATs: Cong says EC should restore public confidence

The Congress on Friday termed as "most serious" reports of the Election Commission identifying "defective" VVPAT machines and asked the poll body to take everyone into confidence to help restore public faith in the integrity of the electoral process. The opposition party posed several questions to the EC, and said it must respond with full transparency on VVPATs to help restore trust in the election process. Congress spokesperson Pawan Khera said media reports have revealed that the EC has allegedly "identified 6.5 lakh VVPAT machines as defective" and has sent them to the manufacturers for repair. These VVPAT machines are of the latest 'M3' type, first introduced by the EC in 2018, and used in elections since then, he said, adding 17.4 lakh VVPAT machines were notified for use in the Lok Sabha elections of 2019. However, referring to media reports regarding defects in VVPATs, the Election Commission has said that 3.43 lakh VVPATs were identified for preventive maintenance and not

TMC to appeal to EC to reconsider withdrawal of national party status

Before it explores legal options against the withdrawal of its national party status, the Trinamool Congress (TMC) will file a formal appeal with the Election Commission to review its decision, its leaders said Tuesday. The Election Commission on Monday withdrew the national party status of the TMC, Nationalist Congress Party (NCP) and the Communist Party of India (CPI). "We will make a detailed representation to the EC. This is something we will do before exploring legal options. We will make our appeal to the EC soon," a TMC leader said on Tuesday. The TMC, formed by Mamata Banerjee in 1998 after she parted ways with the Congress, became a state party in 2014. The party came to power in West Bengal in 2011 and subsequently expanded to Arunachal Pradesh, Manipur and Tripura. It received the national party tag in 2016, but its dismal show in Goa and some northeastern states has led to withdrawal of the status.

The Election Commission on Monday recognised the Aam Aadmi Party (AAP) as a national party and withdrew the national party status of the All India Trinamool Congress, Nationalist Congress Party (NCP) and the Communist Party of India (CPI). In an order issued on Monday, the Commission also revoked the state party status granted to RLD in Uttar Pradesh, BRS in Andhra Pradesh, PDA in Manipur, PMK in Puducherry, RSP in West Bengal and MPC in Mizoram. The Commission said the AAP has been named as a national party based on its electoral performance in four states -- Delhi, Goa, Punjab and Gujarat. The Arvind Kejriwal-led party is in power in Delhi and Punjab. The poll panel said that the status of NCP, CPI and the Trinamool Congress as national political parties would be withdrawn. The BJP, Congress, CPI(M), Bahujan Samaj Party (BSP), National People's Party (NPP) and the AAP are now national parties.
