Jaipur bench of NCLT to start functioning from tomorrow

The National Company Law Tribunal's Jaipur bench will start hearing cases from tomorrow. The bench, which was notified on June 28 by the ministry of corporate affairs, was inaugurated by Rajasthan High Court Judge K S Jhaveri here today. As many as 124 cases in the jurisdiction of Rajasthan have been transferred from the tribunal's principal bench in New Delhi to the Jaipur bench. All these pending cases and new ones from the state will be heard and decided by the Jaipur bench. To start with, the bench will hear the case twice a week. The tribunal has constituted a bench of M M Kumar to hear the cases in Jaipur.

ROC officials hold 'site examination' at Jubilee hills complex

Officials of the Registrar of Companies today conducted "site examination" at a complex in Jubilee Hills here, which houses some firms owned by family members of B Ramalinga Raju of Satyam Computers. On information that multiple companies were allegedly operating from the same address the inspection was done, official sources said. When contacted, a senior ROC official confirmed the development. The official said the site inspection was to verify the records of some companies if there are any "irregularities" with respect to the registration address and other details. About reports that the ROC officials conducted searches at the office premises and found over 100 companies "illegally" functioning under one roof, the ROC official clarified, saying "It is not searches or raids. 65-year-old having illicit relations with daughter-in-law

A 65-year-old farmer was arrested today for allegedly killed his 42-year-old son who was proving to be a hindrance in continuing illicit relations with his daughter-in-law in Aurangabad district, police said. The accused chopped the body of his own son into pieces after allegedly killing him with an axe at their farm near Sillod village on July 14, an official said. "The accused (name withheld) was having illicit relations with his daughter-in-law and viewed his son as an obstacle," said assistant police inspector Vishwas Patil. Notably, the man had filed a missing person complaint with the local police stating that his son has become untraceable. "He was arrested through the call detail records which showed that his son was present at the farm on the night of July 14," Patil said. Two arrested for kidnapping tea-seller

Two men were arrested for allegedly kidnapping a tea-seller at gunpoint and demanding a ransom of Rs 3 lakh from him, police said today. The accused were identified as Vatan, (30), and Jan Mahan Singh (23), and one 9 mm loaded pistol with one spare live cartridge and a car were recovered from them, they said. In the intervening night of July 23 and 24, the picket duty staff, posted at Jhatikara border, spotted a Chevrolet car coming from Dharmpura, Gurgaon. Police observed that the car with white number plate was a taxi from Rohtak. When police signalled them to stop, the driver increased the speed of the car to escape. But police managed to stop them by blocking the road and overpowered them, said Anto Alphonse, Deputy Commissioner of Police (Dwarka). On enquiry, the police found that one Harpal Singh was injured. NCLAT dismisses cement-makers' plea against Rs 6,300 cr CCI penalty for cartelisation

The National Company Law Appellate Tribunal (NCLAT) today dismissed cement manufacturers' plea challenging the order of fair trade regulator CCI to impose a penalty of Rs 6,300 (rpt) 6,300 crore for alleged cartelisation. A two-member NCLAT bench headed by Chairman Justice S J Mukhopadhaya dismissed a batch of petitions by 10 (rpt) 10 cement makers. The appeals are dismissed, said the NCLAT, which now is an appellate authority over the Competition Commission of India (CCI). In August 2016, CCI had slapped approximately Rs 6,700 crore penalty on 11 cement firms including UltraTech, ACC, Ambuja, Ramco and JK Cement as well as the industry body Cement Manufacturers' Association (CMA) for indulging in cartelisation. This was challenged by the cement makers before the Competition Appellate Tribunal, which had in November 2016 stayed the CCI's direction to pay 10 per cent of the penalty within a month of the order. HC directs CBI to investigate slow pace of Ranchi-Jamshedpur NH

The Jharkhand High Court today directed the CBI to investigate the slow pace of work of the Ranchi-Jamshedpur national highway. A division bench of justices Aparesh Kumar Singh and Anil Kumar Choudhary asked the CBI to file an FIR against the culprits after three months if it found negligence and other shortcomings in the construction of the highway. The counsel for the petitioner submitted that the widening and repair of the highway was started in 2012, but till now no concrete work has been done. The court directed that the matter be put up after four weeks.

Man held for raping minor girlfriend

A 20-year-old man has been arrested for allegedly raping and impregnating his 17-year-old girlfriend, police said today. The accused, identified as Pravin Narawade, was allegedly in relationship with the girl for the last five years during which he established physical relations with her, a police official said. The incident came to light a few days ago when the victim's mother took her to Rajwadi Hospital in suburban Ghatkopar for a medical check up, when she found that her daughter was five-month pregnant. As the victim is minor, the doctors informed the police who booked the man and arrested him on July 22, the official said. A case has been registered at Mankhurd police station under relevant sections of the Indian Penal Code and POCSO Act. The accused was remanded to judicial custody by a court today.

Madras HC dismisses plea against operation of buses sans conductors

The Madras High Court today dismissed a petition challenging the Tamil Nadu government's move to operate point-to-point buses without conductors, saying there was no serious infirmity in the policy decision warranting its interference. Justice S M Subramaniam dismissed the petition filed by the State Transport Employees Federation affiliated to CITU which had sought a direction to the transport department to run the buses with a conductor in order to ensure safe operation of the services. The petitioner had cited mandatory provisions of the Motor Vehicles Act, 1988, read with Rule 227 of the Tamil Nadu Motor Vehicles Rules, 1989 in support of its plea. The judge, who elaborately discussed about sections 124 and 178 of Motor Vehicles Act in his order, said there was no specific bar against the authorities from appointment of a driver-cum-conductor. He also said Rule 227 of Tamil Nadu Motor Vehicles Rules which stipulates that no stage carriage shall be used in a public place unless it .

Two arrested for cheating people

Two men were arrested for allegedly cheating people by changing their ATM cards during cash withdrawal on the pretext of helping them in Azadpur area, police said today. The accused, identified as Mohamad Aarif and Sameer, are residents of Ghaziabad and 17 ATM cards of different banks and one motorcycle were recovered from them, they said With their arrest, police claimed to have solved nine cases of theft and cheating, including a case of motor vehicle. Acting on a tip off, a trap was laid at Peer Baba near fruit mandi in Azadpur on July 21. Two members of inter-state gang arrested by police

Police today arrested two more members of an inter-state gang of robbers after an exchange of fire in Odisha's Ganjam district, a police officer said. Two pistols, three rounds of ammunition, cash around 2.25 lakh, a car and six mobile phone sets were seized from them, said sub divisional police officer (SDPO) Chhatrapur Ramesh Chandra Sethi. The robbers received bullet injuries on their legs and have been admitted to MKCG Medical College and Hospital here for treatment. The duo were member of an inter-state gang of robbers, involved in looting of Rs 25.30 lakh from an employee of toll gate at Gurapalli near Khallikote on July 2, he said. NCLAT dismisses cement makers' plea against Rs 6,300 cr CCI penalty for cartelisation; cos plan to move apex court

In a setback to 10 major cement producers, the National Company Law Appellate Tribunal today dismissed their plea against the around Rs 6,300 crore penalty imposed by fair trade regulator CCI over alleged cartelisation in the sector. The appellate tribunal also upheld the quantum of penalty imposed by the Competition Commission of India (CCI), observing that the fair trade regulator has imposed the minimum fine. Some cement makers as Ambuja Cement, Ramco, JK Cement and UltraTech said they are consulting with their legal teams and intend to challenge the order before the Supreme Court. "We find no merit in these appeals. They are accordingly dismissed," said a two-member NCLAT bench headed by Chairman Justice S J Mukhopadhaya.
