Tandoor murder case: HC asks Delhi govt to consider remission plea of Sushil Sharma

The Delhi High Court today asked the Delhi government to consider the remission plea of former youth Congress leader Sushil Kumar Sharma, serving life term in the 1995 murder case of his wife Naina Sahni, in the upcoming meeting of Sentence Review Board (SRB) later this month. The court said if the board declines the relief to Sharma, the State shall file an affidavit before it detailing the reasons for rejection and whether the SRB guidelines formed by the State are binding on it or not. Justice Mukta Gupta also asked the government to explain in the affidavit the factors which are to be considered while dealing with a convict's application seeking to be released. Sharma has challenged the decision of the SRB, which examines the records of those who have spent more than 14 years in jail and those who were given life term, declining his plea for release. The board, which was constituted in 2004 as per Supreme Court directives and is chaired by the Delhi Home Minister, decides on the .

Government raises monetary limits for tax litigation

In a bid to minimise litigation pertaining to tax matters, the government on Wednesday decided it will not file any appeals in appellate tribunals, High Courts and the Supreme Court in cases involving an amount less than Rs 20 lakh, Rs 50 lakh and Rs 1 crore respectively.

Centre opposes PIL seeking women liable under adultery offence

The Centre on Wednesday opposed the Public Interest Litigation (PIL) filed by Joseph Shine, seeking to make men and women equally liable under the offence of adultery.The Centre in an affidavit filed in the Supreme Court argued that Section 497 of the Indian Penal Code (IPC) was enacted to safeguard the sanctity of marriage and diluting it would be detrimental to matrimonial bond.The apex court in December last year issued a notice to the Centre asking why a married woman who is equally liable for the offence of adultery with a married man, who is not her husband, be not punished along with the man.Under the law, the offence of adultery is criminalised, but only the man is liable for punishment.Further, if the husband of the woman gives his consent for sexual intercourse with another man, the law does not recognise it as an offence.Advocate Kaleeswaram Raj along with his colleague Suvidutt Sundaram, who appeared before the apex court on behalf of petitioner Joseph Shine, told ANI that

Unnao rape case: CBI files chargesheet against Kuldeep Singh Sengar

The Central Bureau of Investigation (CBI) on Wednesday filed a chargesheet against Bharatiya Janata Party (BJP) MLA Kuldeep Singh Sengar in the Unnao rape case.Sengar has been charged under section 120B, 363,366,376(1), 506 of the Indian Penal Code (IPC) and Sections of Protection of Children from Sexual Offences Act (POSCO) Act.Sengar, a BJP MLA from Bangarmau in Unnao, was arrested by the CBI in April.The teen was allegedly raped by the BJP MLA at his residence in Unnao on June 4, 2017, where she had gone seeking a job.When the family complained, the victim's father was instead booked by the police under the Arms Act on April 3 earlier this year and put into jail on April 5. He later died in a hospital, with the postmortem report mentioning serious injuries on his body.

Munna Bajrangi was shot seven times by Baghpat jail inmate

Gangster Prem Prakash alias Munna Bagrangi, who was killed in the Baghpat district jail here by a co-prisoner, had been shot at seven times, the police said today. The postmortem examination report of Bagrangi said he was shot at seven times by jail inmate Sunil Rathi, Superintendent of Police Jai Prakash said today. He said one of the bullets had hit Bajrangi's head and a portion of his head was badly mutilated on the right side. "A pistol, two magazines and 22 cartridges have been recovered from a drain inside the jail," he said, adding it was yet to be ascertained as to how the pistol reached inside the jail. BJP MLA charge-sheeted by CBI in Unnao rape case

The CBI today charge sheeted Uttar Pradesh BJP MLA Kuldeep Singh Sengar for the alleged rape of a minor girl in Unnao at his residence on June 4 last year, officials said here. In the charge sheet filed in special CBI court here, Sengar and his associate Sashi Singh have been charged with criminal conspiracy and other offences under IPC and section 3 and 4 of the The Protection of Children from Sexual Offences Act (POCSO Act) which relates to rape of minors. The development came three months after the agency was handed over the probe in the alleged rape of the minor girl who was lured at the residence of the politician with the promise of job. Junking penal law on adultery will destroy sanctity of marriage: Centre to SC

Striking down section 497 of the Indian Penal Code which provides for punishment only to a man for having extra-martial sexual ties with the wife of another man, will destroy the institution of marriage, the Centre told the Supreme Court today. In an affidavit to the apex court, the Ministry of Home Affairs sought dismissal of a plea challenging the validity of the penal law on adultery, saying that the Section 497 "supports, safeguards and protects the institution of marriage". "It is submitted that striking down section 497 of IPC and Section 198(2) of the CrPC will prove to be detrimental to the intrinsic Indian ethos which gives paramount importance to the institution and sanctity of marriage. "The provisions of law, under challenge in the present writ, have been specifically created by the legislature in its wisdom, to protect and safeguard the sanctity of marriage, keeping in mind the unique structure and culture of the Indian society," the plea said. HC refuses to entertain NGO's plea in rape case involving preacher

The Delhi High Court today refused to entertain a plea by an NGO seeking transfer of the investigation from the police to CBi in a case of alleged rape against self-styled preacher Daati Maharaj. Justice Mukta Gupta said the NGO was not the victim in the case and had no locus standi in the criminal matter. The court said the NGO had initially filed the plea as a Public Interest Litigation which was not entertained by the bench headed by the Acting Chief Justice and treated as a criminal writ petition. "What is the locus of an NGO in a criminal trial? A victim or accused is most welcome to the court and action will be taken on their petition. What is your locus," Justice Gupta asked. The court suggested the complainant to withdraw it with a liberty to file it along with the victim's affidavit. CBI files charge sheet against BJP MLA Kuldeep Singh Sengar in Unnao rape case

The CBI has filed a charge sheet against Uttar Pradesh BJP MLA Kuldeep Singh Sengar in connection with alleged rape of a teenager at his residence, officials said today. The sources said the charge sheet was filed before Special CBI court in Lucknow and names Sengar and his alleged associate Sashi Singh as accused in the case. Further details are awaited. The victim had alleged that she was raped by the MLA from Bangarmau in Unnao at his residence on June 4, 2017 where she had gone with a relative seeking a job. Faced with embarrassment, the BJP government in the state had recommended a CBI probe in April this year. Sengar is a four-time MLA. Strong evidence against those arrested for Naxal links: CM

Several pieces of evidence have been found against those arrested for alleged Naxal connection to the Bhima-Koregaon violence, Maharashtra Chief Minister Devendra Fadnavis today said. Evidence suggesting a direct link of the accused with Naxal leaders was found during the probe, he told the Legislative Council here. Plea in HC against Netflix show 'Sacred Games' for allegedly defaming ex-PM

A plea was today filed in the Delhi High Court seeking removal of certain scenes from the Netflix series 'Sacred Games', claiming that its content was derogatory to former Prime Minister Rajiv Gandhi. The plea, which alleged that certain scenes and dialogues in the show defamed the late Congress leader, was mentioned earlier in the day before a bench comprising Acting Chief Justice Gita Mittal and Justice C Hari Shankar, which allowed it to be listed today. Homosexuality: Centre leaves it to SC's wisdom to decide on Sec 377 of IPC

The Centre today left it to the wisdom of the Supreme Court to examine the constitutional validity of the penal provision which criminalises "consensual acts of adults in private", saying this was the only question under section 377 of the IPC which needed to be decided by the constitution bench. In an affidavit, the Ministry of Home Affairs said if the apex court decided to examine any question other than the constitutional validity of Section 377, it would have far-reaching and wide ramifications under various other laws. Section 377 refers to 'unnatural offences' and says whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to 10 years, and shall also be liable to pay a fine. Sharif, Maryam will have to apply for 'Better Class' jail facility

Ousted prime minister Nawaz Sharif will be sent to a jail in the 'Better Class' category by virtue of being a former parliamentarian, but his daughter Maryam Nawaz can avail the facility only if she proves that she has paid at least Rs 600,000 as annual income tax, according to authorities. Sharif and Maryam were convicted by a Pakistani court in the Avenfield Apartments reference and sentenced to 10 and 7 years in jail respectively. Navy war room leak: Retd Captain gets 7 years' imprisonment

A special Central Bureau of Investigation (CBI) court on Wednesday sentenced Captain (retired) Salam Singh Rathore to seven years' imprisonment in the 2005 Navy War Room leak case.The court convicted Rathore under Section 3(1) C of the Official Secrets Act of 1923.While passing the judgment in the case, the court told Rathore that the offence committed by him was not just against the society, but against the national security of India.The court added that being a defence personnel, his primary job was to protect the unity, integrity and security of India, but he acted otherwise.The 2005 Navy War Room leak case involves leaking of over 7,000 pages of defence information of sensitive nature from the naval war room and air defence headquarters, where serving officers allegedly passed on military secrets to unauthorised persons for financial gain.
