IBC, RERA conflict apparent in some bankruptcy proceedings: Assocham

Insolvency and Bankruptcy Code (Code) and the Real Estate (Regulation and Development) Act seem to be pitted against each other when it comes to resolving interest of bankers and homebuyers, an Assocham report observed. The conflict between IBC and RERA came to the fore in quite a few bankruptcy proceeding in the recent times.... In a way, IBC and RERA have areas where there are possibilities of conflict in operation. While IBC allows companies to file for bankruptcy to provide relief to debtors or creditors, RERA looks at providing relief to homebuyers and seeks to hold developers or builders responsible if the project is delayed, said an Assocham - Thought Arbitrage paper. As per provisions of the IBC, homebuyers are unsecured creditors and as a result their priority to be compensated comes after those institutional or other creditors who have provided loans to the developer. Scope for confusion prevails as for both RERA and IBC, the law states that it will prevail over other laws, .

BJP hits out at Oppn for demanding CBI probe into Kathua rape-murder case

The BJP, the junior ally in the PDP-led government in Jammu and Kashmir government, today accused opposition parties of playing dirty politics for their demand of a CBI probe into the alleged rape-and-murder of a minor girl in Kathua, saying only higher courts can transfer the case to the central agency as charge sheet has already been filed. Naidu starts consultation process on impeachment notice against CJI

Rajya Sabha Chairman M Venkaiah Naidu today set in motion the process of consultation on the impeachment notice against Chief Justice of India Dipak Misra and held discussions with constitutional and legal experts. The vice president cut short his visit to Hyderabad and reached here to hold deliberations over the notice given by the seven opposition parties. According to officials, Naidu today spoke to former Lok Sabha secretary general Subhash Kashyap, ex-law secretary P K Malhotra and former legislative secretary Sanjay Singh on the issue. Teenage girl abducted from her house, gang-raped in Hry

A 14-year-old girl was allegedly abducted by four people while she was sleeping in her house at a village in this district and then gang-raped after taking her to a secluded place, the police said today. According to a complaint lodged by the girl's family, the victim was alone in the house at the time of the incident yesterday, they said. After the girl came back to her house and narrated her ordeal to her parents, a complaint was lodged with the women police station last night, the police said. A case under the relevant sections of the IPC and POCSO Act has been registered against the accused, they said, adding that during investigation, it was revealed that accused were from Jathlana and Mohri villages. The accused are at large and efforts are on to nab them, the police said.

Woman kills her 2 kids, ends life by jumping into river

A 20-year old woman today allegedly committed suicide by jumping into a nearby river along with her two minor children, police said. The woman took the extreme step due to a family dispute, they added. The bodies of the children, aged five and three, were fished out from the Godavari river while a search was on for the woman's body, police said. According to Kovvur Town police Sub-Inspector Ramesh, the woman's husband, employed in a cloth merchant shop, was informed about the incident and helped identify the bodies. The woman had written to her father-in-law before taking the decision to end her life and that of her children, the Sub-Inspector added.

Over 14384 cases disposed of by National Lok Adalat in J-K

Over 14384 cases were disposed of during the National Lok Adalat held across Jammu and Kashmir today, an official said. The National Lok Adalat was held under the patronage of acting chief justice of state high court and patron-in-chief of State Legal Services Authority (SLSA), Justice Ramalingam Sudhakar. An amount of Rs 5.25 crore was awarded as compensation in Motor Accident Claims Tribunals (MACT) cases, and an amount of Rs 67.20 crore was settled in bank recovery suits in the state, according to a statement issued by member secretary SLSA R N Wattal.

HC notice to Maha govt, Bajaj Auto on safety gears for pillion rider

The Bombay High Court has sought the stands of Maharashtra government and two-wheeler major Bajaj Auto on a plea for strict implementation of a Supreme Court order to all two-wheeler manufacturers to equip their vehicles with safety gears for pillion riders. A bench of justices S M Kemkar and M S Karnik sought the stands of the government and Bajaj Auto last week on a plea by an elderly Mumbaikar, Gyan Prakash seeking court's directions to two-wheeler manufacturers to install proper safety accessories like saree guards and hand grips for pillion riders. Gyan Prakash, 71, had the moved the high court earlier this month for enforcement of the apex court's February judgement, saying that the government must be asked not to register any two-wheeler which does not conform to the Central Motor Vehicle Rules, 1989 guidelines on safety gears for the pillion riders. Three cops injured in road mishap

Three police personnel, including a Head Constable, were injured when their vehicle was hit by another one on Yamuna expressway last night. "HCP Devendra Singh was admitted in a private hospital and his condition is serious", police said, adding constables Ajeet Singh and Mohan Kumar were allowed to leave the hospital after receiving first aid. Seven including notorious criminal held in Bhopal

A history-sheeter was arrested along with six of his accomplices today when they were lying in wait allegedly to rob vehicles on Badwai bypass road in Bhopal, police said. Police recovered four country-made revolvers, 21 rounds, some sharp-edged weapons, and cash worth Rs 31,000 from their possession, said Deputy Inspector General (DIG), Bhopal Range, Dharmendra Choudhary. Surat minor's rape-murder case: Cops add human trafficking sections

A minor, whose body was found here on April 6, and her mother may have been victims of human trafficking as the person who handed them over to the man accused of their killing had demanded Rs 35,000 for them, and as such relevant sections of the penal law have been added to the case, a senior police official said. Surat Police Commissioner Satish Sharma said the accused, who was arrested from Sawai Madhopur district in Rajasthan on Friday, had confessed to having killed the girl and her mother. The officer said the accused had told them that the woman, whose body was found in Sachin area here a few days before that of the minor girl in Pandesara locality, was the latter's mother. "The man who handed over both the mother and daughter to Harsh Sahay Gurjar demanded Rs 35,000 for them. Gold worth over Rs 2 crore stolen from I-T office in Kota

Gold worth over Rs 2 crore was stolen from a safe in the office of the assistant director (investigation) of the Income Tax department in Rawatbhata Road area here, the police said today. The thieves broke into the office on the second floor of the Revenue Building last night and broke the CCTV cameras installed in the office. They broke open the door of an almirah, took out the key of the safe and stole the gold sealed in two boxes in the safe, they said. The gold stolen from the safe was seized by officers of the I-T department from the the residence of a jeweller here during search operations conducted at different places between April 18 and 21, a police officer said. Muzaffarnagar: 2,751 cases resolved by Lok Adalat in a day

As many as 2,751 cases were resolved and fines amounting to a total of Rs 7,12,230 were collected today by a Lok Adalat held in Muzaffarnagar. The secretary of the legal services authorities and civil judge Madhu Gupta said that during the Lok Adalat, the family court resolved 91 cases of family dispute in which 14 couples were reunited. They have decided to live as life partners on the persuasion of the court, she said.

Farmer commits suicide, unverified note names 2 Maha ministers

A Pune farmer allegedly ended his life today by jumping into a well at his village with an "unverified" suicide note blaming two Maharashtra ministers as responsible for non-release of waters into a nearby irrigation canal and leading the victim to take the extreme step, a Pune (Rural) Police official said. "The body of Vasant Sopan Pawar (48), a farmer from Kardanwadi village in Indapur tehsil of Pune, was found in a well near his home today at around 11am," said an official of Walchandnagar Police Station under the Pune (Rural) Police jurisdiction. "A note found near his body stated that Pawar committed suicide as there was not enough water for irrigation in a nearby canal. A Dalit youth was shot dead by his friends following a drunken brawl in Pasgawan village in Bilsanda area of the district, police said. The deceased was identified as Pappy, about 22 years old. Minor girl sexually assaulted in UP

A 15-year-old girl was allegedly sexually assaulted by a man when she was alone at her house in Rohana Kalan village here, the police said today. The accused was caught and handed over to the police when the victim raised an alarm, Circle Officer Harish Bhadoriya said. According to a complaint filed by the victim's father, Johny (22) barged into their house last night and sexually assaulted his daughter. Truck driver killed in road accident

A 37-year-old truck driver died after his vehicle hit a stationary tractor-trolley near Chaheru on National Highway 1 between Phagwara and Jalandhar, an official said today. The deceased was identified as Gurjinder Singh, a resident of Dilpur village, Subhanpur in Kapurthala district, Chaheru police post in-charge Baljinder Singh said. Elderly man held for repeatedly raping minor girl in Tripura

A 58-year-old-man has been arrested on charge of repeatedly raping a minor girl for about three months in Tripura's Khowai district, the police said today. The 14-year-old girl was repeatedly raped at the man's house at Champlai, about 60 km from here, since February this year, they. "The person was arrested from his house yesterday, who, according to the victim's allegation, had raped her eleven times since February this year," Superintendent of Police Khowai, Krishnendu Chakravertty said. The victim was threatened with dire consequences if she divulged the matter to anyone, Chakravertty told reporters. The victim then went to her relative's house at Bishalgarh in Sipahijala district, about 76 km away from her house in Khowai district, and lodged a complaint at a women's police station there. Income tax inspector held for killing wife, burrying body

An income tax inspector posted in Vadodara has been arrested for allegedly killing his wife and burying her body over his affair with another woman, the police said today. "Lokesh Chaudhary (30) called his wife (28) to Vadodara from Jaipur on April 11 and killed her. He later buried her body. A team reached Vadodara today to exhume the body, Additional DCP (East) Hanuman Prasad said. The accused had filed a missing complaint of his wife with the Jaipur police to evade suspicion on him. But he later confessed to killing the woman with the help of an aide, the officer said. Hailing from Alwar, Chaudhary got married in February last. His wife was studying in Jaipur. The accused developed a relationship with another girl, also hailing from Alwar, who pressurised him to divorce his wife, the police said. The matter is being investigated, they added.
