The objective of mediation is to deliver justice and stay true to the law, and its is not only about taking the burden off the courts, Justice A K Sikri of the Supreme Court has said. Speaking at the International Alternative Dispute Resolution Summit, Justice Sikri said justice means to give every man the opportunity to put his word forward and then decide what the best decision is. It is to give every man what's due to him, he said. "The only reason behind mediation is not to take the burden off the courts but to deliver justice and stay true to the law," Justice Sikri said at the recent held summit. He said mediation talks about what is right, whereas judicial system talks about who is right. The Delhi High Court today sought response of a Delhi-based businessman, arrested in a Rs 5,000 crore money laundering case, on a plea of the Enforcement Directorate (ED) challenging the bail granted to him. Justice A K Pathak issued notice to Gagan Dhawan, who was granted bail on January 4 by a special court. The ED challenged the January 4 decision of the trial court claiming that Dhawan was the "key person" in the case who "diverted the proceeds of crime". The agency also contended before the high court that its probe would be hampered as long as the businessman was out as the proceeds of crime are yet to be traced. Dhawan, arrested on November 1, 2017, was sent to judicial custody on November 15, 2017 by the special court after the ED had said he was not needed for further custodial interrogation. A local court today awarded life imprisonment to three persons for killing an engineer in 2010. However, District and Additional Sessions Judge H M Patwardhan acquitted two other accused, giving them the benefit of doubt. The engineer, Deepan Banerjee (27), who worked at Powai, was found murdered in his flat, where he resided alone, in Airoli in Navi Mumbai on August 12, 2010, the court was told. "Banerjee had employed Vinod Vishnu Bandal (30), who used to daily deliver him a tiffin," the court was informed. "Bandal along with his two friends, Suraj Popatrao Gurav (30) and Santosh Bandu Raut (37), conspired to rob Banerjee. On August 12, 2010, the trio entered the apartment when Banerjee was alone and stabbed him 27 times, following which he died," the court was told. The trio robbed Rs 200, camera and his laptop and fled to Pune. Police initially nabbed Gurav and later arrested him, the court was told. An Emiriti businessman who was convicted of fraud and writing a bad cheque worth 31 million dirham to pay for the Abu Dhabi No.1 licence plate will have to spend three years in jail after an appeals court confirmed an earlier sentence, a media report said today. The 33-year-old Emirati had bought the special plate in November 2016 at an auction in Abu Dhabi for a whopping 31 million dirham (USD 84,39,750). In 2016, the UAE media had identified him as Abdullah Al Mahri. The Public Funds Prosecution had ordered the detention of the Emirati after organisers of the auction filed a complaint about him issuing a dud cheque after buying the number plate commemorating Abu Dhabi government's golden jubilee. Prosecutors charged the man with fraud and issuing a bounced cheque. During his interrogation, the Emirati admitted to issuing the cheque with full knowledge of his dearth of cash in the bank, Khaleej Times reported. Police today arrested one more person accused in the murder of Chandan Gupta in Kasganj, a senior official said. "One of the accused persons in Chandan Gupta murder case - Salman - has been arrested. We have recovered a country-made pistol and two cartridges from him. The arrested accused is a resident of Mohalla Nawab of Kasganj," Superintendent of Police Piyush Srivastava said today. Earlier, on January 31, the police claimed to have held Saleem, the prime accused in the Chandan Gupta murder case. Subsequently, on February 3, one more person, Rahat, was arrested in connection with the killing. Gupta was killed in communal violence that broke out in Kasganj on the Republic Day. The National Green Tribunal today sought the response of the Archaeological Survey of India (ASI) on a plea alleging that inaction on part of the Taj Trapezium Zone Authority (TTZ) has led to deterioration of air quality, adversely affecting the iconic Taj Mahal. A bench comprising justice S P Wangdi and Expert Member S S Garbyal noted that the ASI had not been appearing since inception when notices were initially issued to all the parties. "After hearing the counsel for the parties today and upon consideration of the facts and circumstances set out in the various affidavits, we find that the presence of ASI and their reply is essential for an effective adjudication of the case. "We, therefore, direct notice upon them which shall be returnable before February 13. Copy of this order be transmitted forthwith to the Director General, Archaeological Survey of India, for compliance," the bench said. An Indian worker in the UAE has been slapped with a hefty fine of around Rs 87 lakhs for an offensive email to the country's transport authority claiming it rips off the poor after he flunked a driving test, media report said today. The 25-year-old Indian worker ridiculed the Roads and Transport Authority (RTA) that they take 'poor people's money by making them intentionally fail in driving tests and forcing them to repeat the tests', the Gulf News reported. The RTA had received from the worker an email that it deemed as insulting and disdaining, it said. The RTA's concerned department took immediate legal action against him for sending that offencive and disparaging email and reported it to Dubai Police. The Dubai Court of First Instance also jailed the accused for three months although he had pleaded not guilty and maintained that he had been frustrated after he failed his driving test, it said. Iran's Supreme Court has rejected a request to review the death sentence given to university professor Ahmadreza Djalali, accused of passing information to Israel, his lawyer said today. "The judge rejected our request on Sunday in less than an hour," said lawyer Zeinab Taheri. "We will file a new request with the Supreme Court to demand that the dossier be read, given the sensitivity of the case." Djalali, a specialist in emergency medicine resident in Sweden, was detained in April 2016 after a brief visit to Iran. He was found guilty in October of passing information about two Iranian nuclear scientists to Israel's Mossad intelligence agency that led to their assassinations. The Supreme Court confirmed the death sentence against him in December, which was criticised by human rights group Amnesty International as running "roughshod over the rule of law". Djalali's lawyer said she could file multiple requests for the case to be reviewed, although there was no guarantee .

The Delhi High Court today retained the life imprisonment given to seven Uttarakhand policemen for killing a student in a fake encounter in Dehradun in 2009, saying that extra judicial killing has no place in a system governed by the rule of law. However, the high court set aside the conviction and life term of 10 other cops, who were held guilty for conspiring to kidnap and murder the MBA student. Ranbir Singh, 22, a resident of Ghaziabad, was gunned down by the police on July 3, 2009. The police had alleged that he was involved in an extortion racket. The investigation was entrusted to CBI and the case transferred to Delhi by the Supreme Court. A bench of Justices S Muralidhar and I S Mehta in its 105-page judgement said fake encounter is a form of extra judicial killing which has no place in a legal system governed by the rule of law. German prosecutors said they had raided offices belonging to high-end carmaker Audi today, the second sweep in a week related to diesel emissions cheating at the Volkswagen subsidiary. The raids on a private home and offices belonging to Audi in southern German states Bavaria and Baden-Wuerttemberg "focused on the use of technical devices to manipulate emissions data in 3.0-litre V6 diesel motors for sale on the European market," the authorities said in a statement. Some 14 people are now under suspicion in the probe into suspicions of fraud and illegal advertising relating to 210,000 diesel vehicles sold since 2009, which also saw prosecutors search the homes of six current and former employees last Wednesday. There were around 24,18,374 cases pending at various courts of West Bengal including the Calcutta High Court till June last year, state Law Minister Moloy Ghatak said at the Assembly today. At the Calcutta High Court, Ghatak said, the number of pending cases were 2,22,102 while it was 21,96,272 in other lower courts. He was replying to questions put up by Congress MLA Nepal Mahato on behalf of Leader of Opposition Abdul Mannan. The minister informed the House that out of the 17,17,741 cases pending at different criminal courts in the state, 39,630 were at the Calcutta High Court. About civil cases, he said 6,00,663 cases were pending out of which 1,82,502 cases were at the High Court. Ghatak said there were around 36 vacancies for judges in different courts in the state.

When the case came up for hearing before the court (Prevention of Corruption Act), special Judge John Mino posted the case for Thursday and directed the government to respond to the petition by that day, as sought by the public prosecutor. Ganapathy was arrested on February 3 for allegedly accepting Rs 30 lakh as bribe from an aspirant for the post of an assistant professor.
