SC refers to 5-judge constitution bench plea seeking collegium-like selection process for CEC, ECs

The Supreme Court Tuesday referred to a 5-judge constitution bench a plea seeking collegium-like selection process for appointing the Chief Election Commissioner (CEC) and Election Commissioners (ECs). A bench comprising Chief Justice Ranjan Gogoi and S K Kaul considered submissions raised by lawyer Prashant Bhushan and said the issue of appointment of CEC and ECs has to be taken up by a larger constitution bench. The bench was hearing a PIL filed by one Anoop Baranwal, seeking a transparent selection process for appointment of Election Commissioners in the poll panel. The Centre, represented by Attorney General K K Venugopal, however, opposed the petition saying so far no case of abuse of official position by the CEC had come forward and referred to names like T N Seshan and other persons who have graced the office of the CEC.

Minor raped by school van driver

A five-year-old girl was allegedly raped by her school van driver in Shahbad Dairy area of Rohini, police said Tuesday. The girl told her mother on Monday that she does not wish to go to school as the van driver does "bad things" to her, they added. The girl's mother approached police following which a case was registered. The 39-year-old driver was arrested on Monday.

Graft case: CBI DSP Kumar moves Delhi HC against arrest

CBI DSP Devender Kumar Tuesday approached the Delhi High Court challenging his arrest in connection with bribery allegations involving agency's Special Director Rakesh Asthana. The matter was mentioned before a bench of Chief Justice Rajendra Menon and Justice V K Rao by senior advocate Dayan Krishnan. The court listed the plea for hearing before an appropriate bench in the post lunch session today. Kumar, who was earlier the investigating officer in a case involving meat exporter Moin Qureshi, was arrested yesterday by the CBI on the allegations of forgery in recording the statement of businessman Sathish Sana, who had alleged to have paid bribes to get relief in the case.

$77 bn laundered through fake bank accounts in Pakistan

SC permits sale and manufacture of "green" crackers, fixes time for bursting firecrackers

The Supreme Court Tuesday permitted the sale and manufacture of "green" firecrackers which have low emission across the country. A bench comprising Justices Ashok Bhushan and A K Sikri fixed the 8 pm to 10 pm time period for bursting of firecrackers on Diwali and other festivals. The apex court also restrained e-commerce websites like Flipkart and Amazon from selling firecrackers which are beyond the permissible limit. The top court's order came on a plea seeking a ban on manufacture and sale of firecrackers across the country to curb air pollution.

SC to hear on November 13 pleas challenging its Sabarimala verdict

The Supreme Court Tuesday said that it would hear on November 13 the petitions challenging its Sabarimala verdict allowing women of all age groups entry into the temple. A bench comprising Chief Justice Ranjan Gogoi and Justice S K Kaul told lawyer Mathews J Nedumpara that it has already passed an order with regard to listing of petitions on November 13. Earlier the court had noted that there were 19 review petitions pending in the matter, filed by National Ayyappa Devotees Association and others seeking a review of its verdict. A five-judge constitution bench by a ratio of 4:1 had held that women of all age groups should be allowed entry into Kerala's Sabarimala Temple.

Spot-fixing claim in recent documentary baseless: PCB

The Pakistan Cricket Board (PCB) has rejected the spot-fixing charge made against the national team in a recently-released documentary as "baseless" and said a probe can only be conducted if the broadcaster shares the footage. In response to the Al Jazeera's latest documentary, which claimed that four international matches involving Pakistan were spot-fixed, the PCB said the allegations were under review jointly by the ICC and its own Anti-Corruption Unit. "The broadcaster has not been forthcoming with provision of any evidence whatsoever in the absence of which their allegations remain unsubstantiated, the statement added. "Without provision of evidence from the broadcaster, the allegations will remain baseless," it said. Son of Gurugram judge shot by guard dies

Son of Gurugram's who was shot at by a gunman on October 13, succumbed to his injuries at a hospital on Tuesday morning.Wife and son of the judge were shot at by his official security guard in Gurugram's Sector 49. While the woman died on the spot, her 18-year-old son was admitted to a hospital in a critical condition.The gunman, identified as Mahipal, was arrested soon after the incident and later sent to judicial custody.Further investigation in the matter is underway.

3 Paytm employees arrested for trying to extort Rs 20 crore from owner

The Noida Police on Monday arrested three Paytm employees for allegedly trying to blackmail the e-wallet giant's founder Vijay Shekhar Sharma and extort Rs 20 crore.According to police, one of the employees who has been arrested happened to be Sharma's secretary and is believed to be the mastermind behind the act. The accused also threatened Sharma to leak stolen personal data and confidential information if the amount was not paid on time."Sharma had lodged a complaint with the police that three employees, a woman and two of her aides, had stolen personal data from the company and blackmailed to pay Rs. 20 crore for not leaking the confidential information," Senior Superintendent of Police (SSP), Gautam Buddh Nagar, Ajay Pal Sharma said."We took immediate action. Hotline opens for victims of pedophile priests in US capital

US prosecutors have opened a hotline for victims of pedophile priests in Washington, a week after the local archdiocese published the names of 31 members of the clergy accused over the past seven decades. Survivors of child sexual abuse by a clergy member that took place in a house of worship, school, or other location in the District of Columbia can call the Clergy Abuse Reporting Line" or send an email, the US Attorney's Office for the US capital said Monday in a statement. "All reports will be reviewed and a team of experienced criminal investigators, prosecutors and victim advocates from the Superior Court Division of the US Attorney's Office will determine whether any criminal charges can be brought or victim services provided." Prosecutors also offered "victim advocates" who will provide support and guidance to those wishing to make a report. Assault case: Delhi court allows chief secretary's plea seeking special public prosecutor

A Delhi Court on Monday allowed the plea of Chief Secretary Anshu Prakash seeking appointment of a Special Public Prosecutor (SSP) in his alleged assault case.The court directed the Delhi Commissioner of Police to appoint an officer, not below the rank of Additional Commissioner of Police (ACP) who has not been involved with the investigation of this case.It also said that advocates Siddharth Agarwal and V Madhurkar will be permitted to conduct the prosecution on behalf of the police officer, as long he is not appointed.Last week, the court reserved its order on the Chief Secretary's plea. Prakash had moved the application in his personal capacity requesting that the prosecutor in the case be changed and a Special Public Prosecutor be appointed.The assault case dates back to February 20, when Prakash was allegedly attacked at Delhi Chief Minister Arvind Kejriwal's residence by two lawmakers. 5,133 vacant posts in subordinate judiciary unacceptable: SC

Taking note of 5,133 posts lying vacant in the subordinate judiciary across the country, the Supreme Court on Monday said that the existence of these vacancies is "wholly unacceptable".A bench comprising Chief Justice Ranjan Gogoi and Justice Sanjay Kishan Kaul took suo motu cognizance of the filling up of the vacancies in lower courts and sought information from high courts and the state governments.The top court also noted there is a total number of 22,036 posts in the subordinate judiciary and out of these, 5,133 posts were lying vacant. Turkish police find 'abandoned Saudi consulate car' in Istanbul

Turkish police on Monday found an abandoned car belonging to the Saudi consulate at an underground car park in Istanbul, three weeks after the murder of journalist Jamal Khashoggi at the kingdom's mission. The car, which had diplomatic number plates, was found in an underground car park in the Sultangazi district of the city, the state-run Anadolu news agency and TRT World channel said. Registration documents showed that the vehicle belonged to the consulate, they added. Police have asked prosecutors and the Saudi consulate for permission to search the vehicle. Police cordoned off access to the car park, where large numbers of media have gathered, an AFP photographer said. Saudi Arabia has finally admitted that Khashoggi was killed inside the consulate in what Ankara now says was a "savagely planned" murder. But Khashoggi's remains have yet to be found.

Police questions four in connection with death of labourer while cleaning sewer

Four men are being questioned in connection with the death of 32-year-old labourer while cleaning a sewer in northwest Delhi's Jahangirpuri, police said Monday. Police are questioning the project manager and supervisor of a firm that had been given the contract for the maintenance of the sewer by the Delhi Jal Board, they said. They are questioning two persons, who had accompanied the victim while he was cleaning the sewer, police added. Police are probing whether the victim was forced to enter the sewer and whether he had any safety gear with him when he went inside. They have not made any arrests so far and are interrogating the four men. The deceased, identified as Dooman Ray, died Sunday after suffocating to death inside the sewer he had entered to clean along with two others.

Bombay HC orders to expedite hearing in 2008 Malegaon blasts case

Bombay High Court on Monday passed an order directing special NIA court to hear the 2008 Malegaon blast case preferably on day to day basis and to expedite the trial.The Malegaon blast case is being heard by the National Investigation Agency (NIA) court.The application seeking appropriate directions to the special NIA court seeking speedy hearing in the Malegaon trial was heard by a bench comprising of Justices SS Shinde and AS Gadkari.The NIA court will hear the matter next on October 26.The NIA court on Saturday had rejected the plea of Lieutenant Colonel Shrikant Purohit, one of the accused in the 2008 Malegaon blast case, seeking dismissal of charges against him under the Unlawful Activities (Prevention) Act (UAPA). Constable fires at ASI on board train in Bihar

A police constable fired at his senior on board a train here on Monday which they had boarded as part of the escort team, an official said. Superintendent of Police (Railway), Katihar, Dilip Kumar Mishra said the incident took place near while the Sealdah-bound "Hate Bazare Express" was approaching Karhagola Road station in the district. The constable, Dayanidhi, had an altercation with assistant sub-inspector (ASI) Sunil Kumar Das after which he fired a couple of rounds at the latter from his service rifle, the SP said adding that the bullets did not hit the ASI. The enraged constable was overpowered by the escort party with the help of passengers and he was arrested after the train reached Katihar Junction, the SP said adding that the rifle has also been seized. 28 women trafficked from Nepal rescued from Indirapuram flats

Twenty-eight women from Nepal, who were allegedly being trafficked on the pretext of jobs in gulf countries, were rescued Monday from two flats in Ghaziabad's Indirapuram, police said. Based on a tip-off, raids were conducted and the Nepali women, in the age group of 20-30 years, rescued from two flats in Sarjan Vihar society of Nyay Khand II in Indirapuram, they said. They were lured on the pretext of employment in gulf countries, police said, adding that a man, named Kedar, and five others have also been arrested in this connection. Senior Superintendent of Police Vaibhav Krishna said the women were kept here for the last two and a half months. Two of them, managed to free themselves from the flats and reached Geeta colony in Delhi, the SSP said. Both the women then narrated their ordeal to their sister who works as a domestic help. Woman dies after being thrown off third floor terrace in Ghaziabad

A 35-year-old woman died of injuries after she was thrown off the third floor terrace of an apartment here by an acquaintance following a heated argument, police said Monday. The incident took place in the Lok Priya Vihar colony area on Sunday afternoon and the victim succumbed to injuries at a private hospital here at night, City Superintendent Police (SP) Shlok Kumar said. Surat court sends rape accused to police remand till Oct 30

A special POCSO court here Monday remanded a man arrested in connection with the rape and murder of a three-and-a-half-year-old girl here to police custody till October 30. The victim had gone missing from her house in Godadara locality of Surat, and her body was later recovered from a locked building in the vicinity on October 16. The court of special Protection of Children from Sexual Offences (POCSO) and Atrocity judge P S Kala remanded Anil Yadav, who was arrested by Surat police Friday last week from Bihar's Buxar district, in police custody till October 30. Yadav lived on the ground floor of the building where the victim's family lived.
