Capital markets regulator Sebi on Friday slapped fines totalling Rs 33.81 crore on 13 individuals, including senior officials of Sharepro Services (I) Pvt Ltd for flouting regulatory norms. The regulator imposed a fine on senior officials of Sharepro -- Rs 15.8 crore on Indira Karkera (Vice President and client manager for a number of client companies of Sharepro) and Rs 5.16 crore on Govind Raj Rao (Managing Director). Apart from senior officials, Sebi also penalised Balram Mukherjee, Pradeep Rathod, Shrikant Bhalakia, Anil Jathan, Chetan Shah, Sujitkumar Amarnath Gupta, Bhavani Jathan, Anand S Bhalakia, Dayanand Jathan, Mohit Karkera and Rajesh Bhagat. Capital markets regulator Sebi has barred an individual from the securities markets for a period of five years as well as slapped a fine of Rs 30 lakh for flouting regulatory norms. Besides, the regulator restrained Mohit Manghnani (proprietor of Wealthit Global) from associating himself as a director or key managerial personnel with any listed public company or any Sebi-registered intermediary for a period of five years. Sebi also directed Manghnani to resolve all complaints received through the regulator's SCORES portal within a period of three months. The order came after the markets watchdog had passed an ex parte order against Manghnani and the latter approached the Securities Appellate Tribunal (SAT), which remanded the matter back to Sebi and directed the regulator to pass a fresh order. Capital markets regulator Sebi on Friday came out with guidelines to strengthen governance of qualified Registrars and Transfer Agents (QRTAs) for handling disruption and improving preparedness by conducting periodic drills. In its circular, the regulator has asked QRTAs to put in place a Business Continuity Plan (BCP) and Disaster Recovery Site (DRS) in a bid to ensure continuity of operations and maintain data and transaction integrity. Apart from DRS, all QRTAs are required to have a Near Site (NS) to ensure zero data loss. Qualified RTAs -- RTAs having more than 2 crore folios -- are systemically important institutions as they provide the infrastructure necessary for the smooth and uninterrupted functioning of the securities market. Capital markets regulator Sebi on Thursday relaxed norms for borrowings through the issuance of debt securities large corporates to meet their financing needs. Under the rule, entities qualified as large corporates are required to meet 25 per cent mandatory borrowing from bonds. Large corporates are those that have an outstanding long-term borrowing of at least Rs 100 crore with a credit rating of 'AA and above' and have their debt securities listed on a stock exchange. Under the new framework, Sebi has introduced incentives for large corporates in case of surplus in the requisite borrowings and moderated disincentives if they fail to raise at least 25 per cent of their incremental borrowings through debt securities. Sebi on Friday refused to lift the securities market ban imposed on Eros International Media Ltd and four others in an alleged fund diversion case. Further, an investigation by Sebi will be completed in six months in the matter, according to the order. Capital markets regulator Sebi on Friday asked stock brokers functioning only in the Execution Only Platforms (EOP) segment to maintain a sum of Rs 10 lakh with the bourse as a base minimum capital deposit. The EOP is a digital or online platform which allows transactions in direct plans of mutual funds without the help of distributors. Under the rule, an entity desirous of providing execution-only services in direct plans of mutual funds can obtain registration under either of the two categories -- category 1 EOP as an agent of asset management companies registered with industry body Association of Mutual Funds in India (AMFI) or category 2 EOP as an agent of investor, registered as a stock broker. Capital markets regulator Sebi on Wednesday said it has constituted Working Groups to recommend on simplification of various rules, ease of compliance, and reduction in the cost of compliance. Also, the regulator has sought suggestions from public and regulated entities till November 6 towards simplifying the rules. The move came following an announcement made in the Union Budget for FY 2023-24. In a statement, the regulator said it has formed Working Groups to recommend simplification of various Sebi rules. "The Working Groups will also look into the compliance requirements to enhance ease of compliance and reduction in the cost of compliance," the Securities and Exchange Board of India (Sebi) said. Capital markets regulator Sebi has imposed a penalty of Rs 5 lakh on YES Securities (India) Ltd for wrong reporting of margin and discrepancy in the computation of client's net worth. It has been directed to pay the fine within 45 days, the Securities and Exchange Board of India (Sebi) said in its order. The order came after Sebi, jointly with the Stock exchanges -- NSE, BSE and MCX -- conducted inspection of documents and other records of YES Securities (India) Ltd to verify the possible violation of stock brokers' rule. In its order, Sebi found several violations, including wrong reporting of margin and discrepancy in reporting of net worth of clients by YES Securities, during July 2021 to March 2022. The regulator said the brokerage house sent the retention statements after the prescribed time of five days and also mailed the statements of accounts to wrong email addresses.
