SC judge recuses from hearing Sisodia's plea for revival of bail petitions

Supreme Court judge Justice Sanjay Kumar on Thursday recused from hearing pleas of AAP leader and former deputy chief minister Manish Sisodia by which his bail petitions has been sought to be revived in the excise policy scam cases. A bench of Justices Sanjiv Khanna, Sanjay Karol and Sanjay Kumar said another bench in which Justice Kumar is not a member will take up Sisodia's two separate pleas for reviving his bail petitions in cases filed by the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) in the excise policy scam case. As soon as the matter was taken up for hearing, Justice Khanna said, "Our brother has some difficulty. He will not like to hear this matter for personal reasons." Senior advocate Abhishek Singhvi, appearing for Sisodia, requested the bench to list the matter urgently, saying time is of essence. He said the trial has not yet commenced in both the cases. NEET-UG 2024 results: No evidence of mass malpractice, Centre tells SC

The Centre on Wednesday told the Supreme Court there was neither any indication of "mass malpractice" nor a localised set of candidates being benefitted leading to abnormal scores in NEET-UG 2024. It said the data analytics of results of NEET-UG 2024 was conducted by IIT Madras and as per the findings given by the experts, the marks distribution follows the bell-shaped curve that is witnessed in any large-scale examination indicating no abnormality. In an additional affidavit filed in the apex court, the Centre said for 2024-25, the counselling process for undergraduate seats will be conducted in four rounds starting from the third week of July. Meanwhile, the National Testing Agency (NTA), which conducts the prestigious test, also filed a separate additional affidavit in the top court and said it has carried out an analysis of distribution of marks in NEET-UG 2024 at the national, state, city and centre level. Muslim women can get maintenance after divorce under CrPC Section 125: SC

The Supreme Court on Wednesday ruled that a Muslim woman can seek maintenance from her husband under Section 125 of the Code of Criminal Procedure and said the "secular and religion neutral" provision is applicable to all married women irrespective of their religion. The Muslim Women (Protection of Rights on Divorce) Act, 1986 will not prevail over the secular law, a bench of Justices B V Nagarathna and Augustine George Masih said. "We are hereby dismissing the criminal appeal with the major conclusion that Section 125 would be applicable to all women...," Justice Nagarathna said while pronouncing the verdict. The two judges gave separate but concurring verdicts. Section 125 of the erstwhile CrPC, which deals with a wife's legal right to maintenance, covers Muslim women, the bench said. Senior-most Supreme Court judge Sanjiv Khanna on Wednesday recused himself from considering pleas seeking review of the apex court's judgement last year declining legal recognition to same-sex marriage, sources said. According to the sources, Justice Khanna has cited personal reasons for his recusal. The recusal of Justice Khanna would necessitate reconstitution of a fresh five-judge constitution bench by Chief Justice D Y Chandrachud for considering the review pleas. The top court on Tuesday had refused to allow open court hearing of pleas seeking review of its last year's judgement. The Supreme Court on Wednesday agreed to consider listing of a plea of the Uddhav Thackeray faction challenging Maharashtra Legislative Assembly Speaker Rahul Narwekar's order declaring the Shiv Sena bloc led by Chief Minister Eknath Shinde as the "real political party" after its split in June 2022. SC adjourns hearing on ex-TN min Senthil Balaji's bail plea to July 12

The Supreme Court on Wednesday adjourned to July 12 the hearing on the bail plea of former Tamil Nadu minister V Senthil Balaji, who was arrested in a money laundering case by the Enforcement Directorate last year.
