The Supreme Court said on Tuesday it doesn't want Delhi Chief Minister Arvind Kejriwal to discharge his official duties if he is released on interim bail in the money laundering case linked to the alleged excise policy scam as it would lead to a conflict of interest. Kejriwal failed to get any relief from the top court, with a two-judge bench rising without pronouncing an order granting him interim bail to enable him to campaign in the Lok Sabha elections. The Aam Aadmi Party (AAP) leader was arrested on March 21 and is currently lodged in Tihar Jail under judicial custody. A bench of Justices Sanjiv Khanna and Dipankar Datta, which reserved its verdict on the question of interim bail, said allowing Kejriwal to attend his office may have a "cascading effect". Misleading ads case: SC says public figures must act with responsibility

It is imperative for celebrities and public figures to act responsibly while endorsing a consumer product, the Supreme Court said on Tuesday as it clamped down on misleading advertisements. The apex court directed that before an advertisement is permitted to be issued, a self-declaration be obtained from advertisers on the line of the Cable Television Network Rules, 1994. Rule 7 of the 1994 law stipulates an advertisement code that says advertisements carried should be designed to be conformity with the laws of the country. A bench of Justices Hima Kohli and Ahsanuddin Amanullah also directed the Union ministries concerned to apprise it of misleading advertisements and the action taken or proposed to be taken against them by the Central Consumer Protection Authority (CCPA). The Supreme Court on Tuesday termed as "very, very unacceptable" the statements made by Indian Medical Association (IMA) president R V Asokan targeting the apex court in a recent interview where he answered questions about Patanjali Ayurved's misleading advertisements case. Expressing displeasure over Asokan's comments a day before the top court was slated to the hear the matter, a bench of Justices Hima Kohli and Ahsanuddin Amanullah sought his response on an application filed by Patanjali Ayurved Ltd. Senior advocate Mukul Rohatgi, appearing for Patanjali, told the bench that they have filed an application urging the court to take judicial notice of the "wanton and unwarranted comments" made by the IMA president. Terming the alleged recruitment scam in West Bengal "systemic fraud", the Supreme Court on Tuesday said authorities were duty-bound to maintain the digitised records pertaining to the appointment of 25,753 teachers and non-teaching staff. Ensure innocents from backward communities not named in history sheet: SC

The Supreme Court on Tuesday asked the police in states and Union Territories to ensure that innocents and individuals from backward communities are not named in a history sheet. Initiating suo motu action, a bench of Justices Surya Kant and K V Viswanathan said there are some studies available in the public domain that reveal a pattern of "unfair, prejudicial and atrocious" mindset. Police authorities in states and Union Territories should ensure that no mechanical entries in a history sheet are made of innocent individuals belonging to socially, economically and educationally disadvantaged backgrounds along with backward communities, scheduled castes or scheduled tribes, the apex court said. The top court said a history sheet is an internal public document and not a publicly accessible report. SC asks Maha govt to conduct safety audit of Bombay High Court building

The Supreme Court on Tuesday took note of concerns over the safety of the 150-year-old Bombay High Court building and the need for additional space, and directed the Maharashtra government to forthwith conduct a safety audit of the heritage structure. A special bench of Chief Justice D Y Chandrachud and Justices B R Gavai and J B Pardiwala also asked the government to expedite drawings of the site earmarked for constructing new high court building in Mumbai. Observing that the state government must act with alacrity to fulfil the needs for facilities in the high court, the bench asked the state PWD to take up the matter in right earnest. It also said the high court may consult the state PWD and others on expediting the drawings. In order to ensure the structural safety of the existing premises, the State PWD will forthwith conduct a safety audit and apprise it on the next hearing of the steps taken on that regard, the bench said. Excise policy Case: SC questions ED on probe delay, seeks case files

The Supreme Court on Tuesday questioned the Enforcement Directorate (ED) over the "delay" in its probe into the excise policy-linked money laundering case involving Delhi Chief Minister Arvind Kejriwal, and asked the agency to produce case files before the arrest of the AAP leader. A bench of Justices Sanjiv Khanna and Dipankar Datta also asked the ED to produce case files before and after the arrest of Delhi's former deputy chief minister Manish Sisodia, who is also an accused in the case. The bench is hearing arguments on Kejriwal's plea challenging his arrest by the ED in the case. It questioned the ED on the time taken to probe the case and noted that the agency has taken two years to unearth something The bench also asked why relevant direct questions were not put to witnesses and accused in the case. Additional Solicitor General S V Raju, appearing for the ED, said initially Kejriwal was not the focus of the investigation in the case and his role became clear at later stage.

Hemant Soren moves SC against rejection of bail plea by Jharkhand HC

Former Chief Minister Hemant Soren moved the Supreme Court on Monday against rejection of his bail plea by the Jharkhand High Court in a money laundering case linked to an alleged land scam. Senior advocate Kapil Sibal, appearing for Soren, mentioned the matter before a bench headed by Chief Justice D Y Chandrachud seeking urgent listing of his plea. The bench also comprising Justices J B Pardiwala and Manoj Misra said it would look into the request. The Jharkhand High Court on Friday dismissed Soren's writ petition challenging his arrest by the Enforcement Directorate (ED) and denied bail to him. Soren was arrested by the ED on January 31 and is at present in judicial custody and lodged at the Birsa Munda Central Jail in Ranchi. He was sent to the jail on February 15 after 13-day custody of the ED.

SC asks Centre to furnish details on notices, arrests done under GST Act

The Supreme Court has asked the Centre to furnish details of issuance of notices and arrests done under the provisions of the Goods and Services Tax, saying it may interpret the law and lay down appropriate guidelines to avoid any harassment of citizens by depriving their liberty. A special bench of Justices Sanjeev Khanna, MM Sundresh and Bela M Trivedi, which is hearing a batch of 281 petitions challenging various provisions of the GST Act, Customs Act and the provisions of PMLA, voiced concern over the ambiguity in section 69 of the GST Act that deals with the powers of arrest. The bench said it would interpret the law to "strengthen" the liberty, if need be, but not allow citizens to be harassed.
