HC rejects AAP candidate's plea on polls

The Delhi High Court today dismissed the plea of a Aam Aadmi Party candidate seeking a direction to the Election Comission to allow him to contest Delhi assembly polls on Schedule Caste certificate of another state.

Justice S K Misra turned down the plea of AAP candidate, Gajanand, whose nomination was rejected by the Returning Officer here due to possessing Schedule Cast certificate of another state, Rajasthan.

Citing the Supreme Court judgement, Justice Mishra said rejection and acceptance of the process of the nomination is decided by the Election Commission, so it cannot interfere in the decision.

Gajanand had filed nomination on November 16 from Bawana constituency here but his application was rejected saying he should file a caste certificate issued by Delhi government.
 

Delhi government had declined a new caste certificate to Gajanand saying, they cannot issue new documents as he already has a valid caste certificate issued by the government of Rajasthan.

Aggreived with Delhi government's response, Gajanand had moved the Delhi High Court.

AAP has already fielded Manoj from Bawana instead of him.
