Man acquitted of charges of raping his woman friend

Additional Sessions Judge Virender Bhat let off West Delhi resident Surjeet Singh Sahni, relying on the victim's statement.

"She (victim) has turned completely hostile and did not support the case of the prosecution at all. She, however, admitted that accused Surjeet was her friend and had visited her residence at Dwarka on the date of incident...

"In a specific question put to her by the court, she stated that the accused did not commit sexual intercourse with her on that day..., she denied all the suggestions put to her regarding the alleged incident," the court noted.

Surjeet was arrested by the police in February this year on a complaint lodged by the woman alleging that while her mother and her daughter had gone to the doctor along with her uncle, the accused had visited her house here and raped her.

 

The prosecution said Surjeet had come to see the victim's new flat in West Delhi when he sprayed some stupefying drug on the woman and raped her.

"The victim is also stated to have filed an application in the police station..., wherein it was mentioned that she does not want any criminal proceeding against Surjeet," the court observed while acquitting the accused.
