Hearing of defamation suit against Bengal CM adjourned till Thursday

The Calcutta High Court on Wednesday adjourned till Thursday hearing of a defamation suit by West Bengal Governor C V Ananda Bose against Chief Minister Mamata Banerjee over alleged comments made by her and some other TMC leaders. The matter will appear for hearing on Thursday after Bose's lawyer makes necessary changes in the application. Claiming that baseless allegations were being made against the governor, Bose's lawyer also prayed for an interim injunction on further statements by the defendants in the defamation suit. Justice Krishna Rao noted that publications referred to in the suit have not been made party in it. The lawyer for Bose sought time to file a fresh application, incorporating necessary changes. Granting permission, the high court said the matter will be taken up for hearing on Thursday. Following HC order, Sebi to auction 22 properties of 7 companies on July 10

Markets regulator Sebi on Monday said it has lined up 22 properties of seven companies -- including Pailan Group, Vibgyor Group and GBC Industrial Corp group -- for auction on July 10 to recover money illegally collected from investors. Other firms, whose properties will also be auctioned, are Tower Infotech Group, Waris Group, Teachers' Welfare Credit and Holding Group, and Annex Infrastructure India Ltd. The regulator has initiated the process for the sale of assets of the companies as per orders by the Calcutta High Court. Justice Sailendra Prasad Talukdar has been appointed as the one-man committee for liquidating the assets of the firms and repaying the investors. The move is part of Sebi's effort to recover investors' money. The properties include plots and a flat in West Bengal and they will be auctioned at a reserve price of Rs 45.47 crore, according to a notice issued by the Securities and Exchange Board of India (Sebi). The Supreme Court is scheduled to hear on Monday a plea filed by the BJP challenging a Calcutta High Court order that had refused to interfere with a single-judge verdict restraining the party from issuing advertisements that are allegedly "violative" of the Model Code of Conduct during the Lok Sabha polls. According to the cause list of May 27 uploaded on the apex court website, a vacation bench of Justices J K Maheshwari and K V Viswanathan is scheduled to hear the plea. On May 22, a division bench of the high court had said it was not inclined to entertain the appeal against the interim order passed by the single-judge bench. The single-judge bench on May 20 had restrained the Bharatiya Janata Party (BJP) from publishing advertisements that violated the MCC until June 4, the day the Lok Sabha poll results are scheduled to be declared. WB to move higher court to challenge HC order on OBC certificates: Mamata

West Bengal Chief Minister Mamata Banerjee on Friday announced that her government will approach a higher court, challenging the Calcutta High Court order that cancelled all OBC certificates issued in the state since 2010. LS polls: HC refuses to interfere with order on BJP ads during MCC period

A division bench of the Calcutta High Court on Wednesday refused to interfere in a single-bench order that directed the BJP not to publish any advertisement in violation of the model code of conduct during the Lok Sabha election process. Observing that a laxman rekha should be adhered to, the division bench presided by Chief Justice T S Sivagnanam said there should not be any personal attack on the part of any political party. Refusing to interfere in Justice Sabyasachi Bhattacharyya's May 20 order, the division bench said the BJP can move the single bench, seeking a review or recall of its order. The BJP had moved the appeal, claiming that the single bench passed the order without giving it any hearing. Ex-Judge Abhijit Gangopadhyay moves Cal HC, alleges police overaction

Former Judge Abhijit Gangopadhyay, a BJP candidate from Tamluk Lok Sabha seat, on Monday moved the Calcutta High Court alleging police overaction by registering an attempt to murder case against him. Justice Jay Sengupta, before whose court the matter was mentioned, directed that the petition will be taken up for hearing on Tuesday. Alleging malafide and overaction on the part of police, Gangopadhyay's lawyer Rajdeep Majumder submitted before the court that the FIR was lodged to prevent him from campaigning for the election. Majumder stated that section 307 (attempt to murder) was registered against Gangopadhyay. Gangopadhyay, who resigned as a judge of the Calcutta High Court in March, is a BJP candidate from Tamluk Lok Sabha constituency. An alleged incident of protest against him by some persons claiming to belong to a teachers' organisation is stated to have taken place when Gangopadhyay went to file his nomination papers for the polls.

The Supreme Court on Monday stayed a Calcutta High Court order directing the CBI to probe into the role of West Bengal government officials in a teacher recruitment scam. The top court was hearing a plea by the West Bengal government against a high court order invalidating the appointment of 25,753 teachers and non-teaching staff made by the School Service Commission (SSC) in state-run and state-aided schools. A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra said it will hear the matter on May 6. "We will stay the direction which says the CBI (Central Bureau of Investigation) will undertake further investigation against officials in the state government," the bench said. The Calcutta High Court on Friday instructed the National Investigation Agency (NIA) to submit a report regarding the clashes in West Bengal's Murshidabad district during Ram Navami celebrations, stating whether the probe should be handed over to the central agency. The West Bengal government has moved the Supreme Court against the Calcutta High Court order invalidating the appointment of 25,753 teachers and non-teaching staff made by the state's School Service Commission (SSC) in state-run and state-aided schools. Challenging the high court order, the state government, in its appeal filed before the top court, said the HC cancelled the appointments "arbitrarily". "The high court failed to appreciate the ramification of cancelling the entire selection process leading to straightaway termination of teaching and non-teaching staff from service with immediate effect, without giving sufficient time to the petitioner state to deal with such an exigency, rendering the education system at a stand-still," the plea said. The Calcutta High Court on Monday declared as null and void the selection process of State Level Selection Test-2016 (SLST) in West Bengal government-sponsored and aided schools, ordering cancellation of all appointments made through it. A division bench comprising justices Debangsu Basak and Md Shabbar Rashidi also directed the CBI to undertake further investigation in respect of the appointment process, and submit a report in three months. The bench directed the West Bengal School Service Commission to initiate a fresh appointment process. Over 23 lakh candidates had appeared for the 2016 SLST for 24,640 vacant posts.
