Chhattisgarh Chief Minister Vishnu Deo Sai on Thursday hailed the Calcutta High Court's decision to scrap the OBC status of several classes in West Bengal, calling it a slap in the face of those indulged in appeasement politics through religion-based quota. The HC on Wednesday struck down the OBC (Other Backward Class) status of several classes in Bengal, finding such reservations under a 2012 Act to vacancies in services and posts in the state illegal. LS polls: HC refuses to interfere with order on BJP ads during MCC period

A division bench of the Calcutta High Court on Wednesday refused to interfere in a single-bench order that directed the BJP not to publish any advertisement in violation of the model code of conduct during the Lok Sabha election process. Observing that a laxman rekha should be adhered to, the division bench presided by Chief Justice T S Sivagnanam said there should not be any personal attack on the part of any political party. Refusing to interfere in Justice Sabyasachi Bhattacharyya's May 20 order, the division bench said the BJP can move the single bench, seeking a review or recall of its order. The BJP had moved the appeal, claiming that the single bench passed the order without giving it any hearing. The saffron party's counsel also stated the Constitution provides that the Election Commission is the appropriate authority for redressal in case of any dispute during a poll process. Ex-Judge Abhijit Gangopadhyay moves Cal HC, alleges police overaction

Former Judge Abhijit Gangopadhyay, a BJP candidate from Tamluk Lok Sabha seat, on Monday moved the Calcutta High Court alleging police overaction by registering an attempt to murder case against him. Justice Jay Sengupta, before whose court the matter was mentioned, directed that the petition will be taken up for hearing on Tuesday. Alleging malafide and overaction on the part of police, Gangopadhyay's lawyer Rajdeep Majumder submitted before the court that the FIR was lodged to prevent him from campaigning for the election. Majumder stated that section 307 (attempt to murder) was registered against Gangopadhyay. Gangopadhyay, who resigned as a judge of the Calcutta High Court in March, is a BJP candidate from Tamluk Lok Sabha constituency. An alleged incident of protest against him by some persons claiming to belong to a teachers' organisation is stated to have taken place when Gangopadhyay went to file his nomination papers for the polls.

SC stays CBI probe into WB govt officials' role in teacher recruitment scam

The Supreme Court on Monday stayed a Calcutta High Court order directing the CBI to probe into the role of West Bengal government officials in a teacher recruitment scam. The top court was hearing a plea by the West Bengal government against a high court order invalidating the appointment of 25,753 teachers and non-teaching staff made by the School Service Commission (SSC) in state-run and state-aided schools. A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra said it will hear the matter on May 6. "We will stay the direction which says the CBI (Central Bureau of Investigation) will undertake further investigation against officials in the state government," the bench said. The Calcutta High Court on Friday instructed the National Investigation Agency (NIA) to submit a report regarding the clashes in West Bengal's Murshidabad district during Ram Navami celebrations, stating whether the probe should be handed over to the central agency. The court noted that the Murshidabad district SP in a report had referred to alleged use of bombs and other weapons resulting in injuries during the clashes in Beldanga and Saktipur on April 13 and 17. Challenging the high court order, the state government, in its appeal filed before the top court, said the HC cancelled the appointments "arbitrarily". "The high court failed to appreciate the ramification of cancelling the entire selection process leading to straightaway termination of teaching and non-teaching staff from service with immediate effect, without giving sufficient time to the petitioner state to deal with such an exigency, rendering the education system at a stand-still," the plea said. The Calcutta High Court on Monday declared as null and void the selection process of State Level Selection Test-2016 (SLST) in West Bengal government-sponsored and aided schools, ordering cancellation of all appointments made through it. A division bench comprising justices Debangsu Basak and Md Shabbar Rashidi also directed the CBI to undertake further investigation in respect of the appointment process, and submit a report in three months. NIA moves Cal HC for quashing of FIR against officials in Bhupatinagar case

The National Investigation Agency (NIA) on Tuesday moved the Calcutta High Court, seeking the quashing of an FIR against its officials who went to West Bengal's Bhupatinagar for a raid in connection with the agency's probe into a blast case. Justice Jay Sengupta granted permission to file the application and move his court in the post-recess session of the day, NIA counsel Arun Kumar Mohanty said.
