The National Investigation Agency (NIA) scaled up its crackdown against terror networks this year, conducting over 1000 raids after registering 68 cases and arresting 625 accused across the country, an official said on Sunday. The anti-terror federal agency also achieved a stupendous 94.70 per cent conviction rate with 74 accused sentenced in various cases, the official said. The official said another highlight of the NIA action in 2023 was multiple raids conducted to identify suspects behind the attacks on High Commissions of India in Ottawa and London and Consulate General in San Francisco that involved criminal trespass, vandalism, damage to public property, and attempts to cause hurt to Indian officials and damage the Consulate building through arson. The agency identified 43 suspects behind these attacks using several innovative methods of investigation, including crowd-sourcing of information while investigating the larger conspiracy. Opportunity to replace, redraft colonial criminal laws wasted: Chidambaram

Senior Congress leader P Chidambaram on Thursday criticised the three key bills brought by the government that seek to overhaul the criminal justice system, saying the opportunity to replace and redraft the colonial laws has been "wasted". The Lok Sabha on Wednesday passed three key bills -- the Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagarik Suraksha (Second) Sanhita and the Bharatiya Sakshya (Second) Bill -- that seek to overhaul the criminal justice system. In a post on X, former home minister Chidambaram said, "Has the government really dumped the British 'colonial' criminal laws? Consider the fact that 90-95% of IPC, 95% of CrPC and 99% of Evidence Act have been cut, copied and pasted in the three Bills: can any one deny or debate that fact?" "In fact, the government has immortalised Macaulay and Fitz Stephen who drafted the original IPC and Evidence Act," he claimed. The opportunity to replace and redraft the laws has been wasted, Chidambaram said. The three bills will

Set up special bench to monitor criminal cases against MP, MLAs: SC to HCs

In a significant verdict, the Supreme Court Thursday directed all high courts to set up a special bench and register a suo motu case to monitor criminal matters pending against MPs and MLAs to ensure their early disposal. A bench headed by Chief Justice D Y Chandrachud issued a slew of directions to high courts and trial courts on a PIL filed by Ashwini Upadhyay seeking early disposal of pending criminal cases against lawmakers. The top court said it would be difficult for it to give uniform guidelines for trial courts for speedy disposal of cases against lawmakers. The judgement said the high courts will be setting up a special bench, presided over either by the chief justice, or by a bench designated by the chief justice, to monitor criminal trials against the lawmakers. The high courts may call upon special lower courts for reports on status of trials against the lawmakers in criminal cases, it said. "The trial courts shall not adjourn hearing of the cases against the Member of

The Supreme Court on Thursday granted protection to Congress leader Randeep Singh Surjewala from a Non-Bailable Warrant issued by the MP/MLA court of Varanasi in connection with a 23-year-old criminal case. A bench headed by Chief Justice D Y Chandrachud asked Surjewala to approach the court of special judge (MP/MLA) Varanasi for cancellation of the NBW within five weeks. "The petitioner is granted liberty to move an application for cancellation of NBW. The warrant shall not be executed in the meantime for a period up to five weeks," said the bench also comprising Justices JB Pardiwala and Manoj Misra. The matter came up for hearing after senior advocate Abhishek Singhvi, appearing for Surjewala, mentioned the matter in the morning seeking an urgent hearing. The case dates back to 2000 when Surjewala, who was then national president of the Indian Youth Congress, was booked for allegedly creating a ruckus while protesting against the alleged false implication of Congress leaders in

Prepare manual on media briefings by police about criminal cases: SC to MHA

The Supreme Court on Wednesday directed the Ministry of Home Affairs to prepare a comprehensive manual on media briefings by police personnel about criminal cases. Observing that biased reporting gives rise to public suspicion that the person has committed an offence, a bench headed by Chief Justice D Y Chandrachud said media reports can also violate the privacy of a victim. The top court also directed DGPs of all states to submit suggestions in a month to MHA on preparing manual for media briefings by police in criminal cases. "All DGPs, in a month, should communicate to Ministry of Home Affairs, their suggestions for guidelines...NHRC's suggestions may also be taken," the bench said. The top court was hearing a plea regarding modalities followed by police in conducting media briefings where probe is in progress.

Criminal case accused under obligation to stand for test identification: SC

A person accused in a criminal case is under obligation to go for a test identification parade (TIP) during an investigation under the Code of Criminal Procedure and it does not violate any constitutional right, the Supreme Court has held. A bench comprising Justices M M Sundresh and J B Pardiwala made the observation in a judgment by which it dismissed the appeal of a convict in a murder case. The top court said the TIP does not violate the fundamental right of an accused under Article 20(3) of the Constitution which provides that no accused can be compelled to be a witness against himself. The bench said that merely taking part in the TIP does not amount to becoming a witness against himself. "We are of the view that after the introduction of Section 54A in the CrPC referred to above, an accused is under an obligation to stand for identification parade. An accused cannot resist subjecting himself to the TIP on the ground that he cannot be forced or coerced for the same," the benc
