Set up special bench to monitor criminal cases against MP, MLAs: SC to HCs

In a significant verdict, the Supreme Court Thursday directed all high courts to set up a special bench and register a suo motu case to monitor criminal matters pending against MPs and MLAs to ensure their early disposal. A bench headed by Chief Justice D Y Chandrachud issued a slew of directions to high courts and trial courts on a PIL filed by Ashwini Upadhyay seeking early disposal of pending criminal cases against lawmakers. The top court said it would be difficult for it to give uniform guidelines for trial courts for speedy disposal of cases against lawmakers. The judgement said the high courts will be setting up a special bench, presided over either by the chief justice, or by a bench designated by the chief justice, to monitor criminal trials against the lawmakers. SC protects Surjewala from Non-Bailable Warrant by MP/MLA court in old case

The Supreme Court on Thursday granted protection to Congress leader Randeep Singh Surjewala from a Non-Bailable Warrant issued by the MP/MLA court of Varanasi in connection with a 23-year-old criminal case. A bench headed by Chief Justice D Y Chandrachud asked Surjewala to approach the court of special judge (MP/MLA) Varanasi for cancellation of the NBW within five weeks. "The petitioner is granted liberty to move an application for cancellation of NBW. The warrant shall not be executed in the meantime for a period up to five weeks," said the bench also comprising Justices JB Pardiwala and Manoj Misra. The matter came up for hearing after senior advocate Abhishek Singhvi, appearing for Surjewala, mentioned the matter in the morning seeking an urgent hearing. Chhattisgarh polls: 26 out of 223 1st phase candidates face criminal cases

Twenty-six out of the 223 candidates contesting the first phase of the Chhattisgarh assembly elections are facing criminal cases, and 16 of them have serious charges, including those related to voluntarily causing hurt and criminal intimidation, against them. As per the report by the Chhattisgarh Election Watch and the Association for Democratic Reforms (ADR), out of the 223 candidates analysed, 26 (12 per cent) have declared criminal cases. Twenty of the total 90 assembly seats will go to polls in the first phase of two-phased elections on November 7. The remaining 70 constituencies will vote on November 17. Prepare manual on media briefings by police about criminal cases: SC to MHA

The Supreme Court on Wednesday directed the Ministry of Home Affairs to prepare a comprehensive manual on media briefings by police personnel about criminal cases. Observing that biased reporting gives rise to public suspicion that the person has committed an offence, a bench headed by Chief Justice D Y Chandrachud said media reports can also violate the privacy of a victim. The top court also directed DGPs of all states to submit suggestions in a month to MHA on preparing manual for media briefings by police in criminal cases. "All DGPs, in a month, should communicate to Ministry of Home Affairs, their suggestions for guidelines...NHRC's suggestions may also be taken," the bench said. The top court was hearing a plea regarding modalities followed by police in conducting media briefings where probe is in progress.

40% sitting MPs have criminal cases, 25% serious criminal cases: ADR

About 40 per cent of sitting MPs have criminal cases registered against them out of which 25 per cent have declared serious criminal cases under charges of murder, attempt to murder, kidnapping and crimes against women, according to poll rights body ADR. The average worth of assets per MP from Lok Sabha and Rajya Sabha is Rs 38.33 crores and 53 (seven per cent) are billionaires, the ADR said. The Association for Democratic Reforms (ADR) and National Election Watch (NEW) have analysed the self-sworn affidavits of 763 sitting MPs out of 776 seats of Lok Sabha and Rajya Sabha. This data has been extracted from affidavits filed by the MPs prior to contesting their last elections and any subsequent by-elections. Four seats of Lok Sabha and one seat of Rajya Sabha are vacant and four Rajya Sabha seats of Jammu and Kashmir are undefined. Criminal cases registered against juveniles increased in 2022 in Rajasthan

Rajasthan saw a slight rise in the number of criminal cases registered against juveniles in 2022 as compared to the previous year, according to data released by the state's home department. As per the data, the number of different types of crimes committed by juveniles in Rajasthan in 2021 was 3,701, which increased to 4,257 the following year. These include crimes related to theft, extortion, rape, murder and matters under the Protection Of Children from Sexual Offences Act and Arms Act. Among the recent incidents of such crimes that made the news in the state are the detention of a juvenile along with the arrest of two others for extorting Rs 30 lakh from a jeweller in Jhunjhunu district, three juveniles being detained for attacking a retired teacher with a knife and a disgruntled student killing a 54-year-old teacher for reprimanding and expelling him from school. Criminal case accused under obligation to stand for test identification: SC

A person accused in a criminal case is under obligation to go for a test identification parade (TIP) during an investigation under the Code of Criminal Procedure and it does not violate any constitutional right, the Supreme Court has held. A bench comprising Justices M M Sundresh and J B Pardiwala made the observation in a judgment by which it dismissed the appeal of a convict in a murder case. The top court said the TIP does not violate the fundamental right of an accused under Article 20(3) of the Constitution which provides that no accused can be compelled to be a witness against himself. The bench said that merely taking part in the TIP does not amount to becoming a witness against himself.
