A Delhi court on Thursday acquitted AAP MP Swati Maliwal accused of allegedly disclosing the identity of a 14-year-old rape victim who succumbed to injuries. Additional chief judicial magistrate Neha Mittal acquitted Maliwal. A detailed order is awaited. Delhi Police booked Maliwal in 2016 when she was the chairperson of Delhi Commission for Women, and said there was a blatant violation of provisions of Juvenile Justice Act, which protect the identity of a minor victim of sexual offence. The minor girl succumbed to her injuries on July 23, 2016, at a hospital after being sexually assaulted by her neighbour who allegedly forced a corrosive substance down her throat and damaged her internal organs. The police said Maliwal circulated a notice she sent to the area deputy commissioner of police, in which she sought to know about the investigation in the case. The notice, which was given to the print and electronic media, reportedly named the victim. The FIR alleged the notice was ...

Prasad, Devi and Yadav have refuted corruption and other charges levelled against them by the Central Bureau of Investigation (CBI) in the case. The charges also include criminal conspiracy and cheating, and carry a maximum jail term of seven years. The three claimed before the court through their lawyer that the CBI lacked evidence to prosecute them. Prasad, who was the railway minister during the UPA-I government, earlier questioned the validity of sanctions obtained by the CBI to prosecute him. The agency told the court on February 28 that there was sufficient evidence to prosecute the accused persons. The case is linked to alleged irregularities in th

A Delhi court on Wednesday extended the judicial custody of 26/11 Mumbai terror attack accused Tahawwur Hussain Rana till August 13. Special Judge Chander Jit Singh passed the order after Rana was produced before it through video conference after expiry of his judicial custody granted earlier. Rana is a close associate of 26/11 main conspirator David Coleman Headley alias Daood Gilani, a US citizen. He was brought to India after the US Supreme Court on April 4 dismissed his review plea against his extradition to India. On November 26, 2008, a group of 10 Pakistani terrorists went on a rampage, carrying out a coordinated attack on a railway station, two luxury hotels and a Jewish centre, after they sneaked into India's financial capital through the sea route. As many as 166 people were killed in the nearly 60-hour assault.
The Delhi High Court has denied anticipatory bail to a Hong Kong-based Indian businessman in a PMLA case and said giving the reprieve prematurely impedes investigation and undermines the objective of anti-money laundering law. Justice Ravinder Dudeja denied the relief to Amrit Pal Singh in a Prevention of Money Laundering Act (PMLA) case. Singh was the director of Broway Group Ltd, which was the alleged beneficiary of "fraudulent" foreign outward remittances amounting to USD 2,880,210 (approximately Rs 20.75 crore), originating from Indian shell entities. These transactions were made under the guise of import goods, without any actual corresponding business activity, the ED alleged. "Custodial interrogation may be warranted to ascertain the applicant's role in facilitating or benefiting from the alleged money laundering operation. Premature grant of bail would impede investigation and compromise the statutory objectives of the PMLA," the order read. The court on July 1 further no

A Delhi court would on June 30 decide whether or not to accept a police report recommending closure of a case on the disappearance of former JNU student Najeeb Ahmed, who went missing on October 15, 2016. Additional Chief Judicial Magistrate Jyoti Maheshwari on Thursday posted the matter on June 30 after seeking clarifications from the CBI in the matter. The court would also decide on a protest plea filed against it by Ahmed's mother Fatima Nafees. The CBI in October 2018 closed its investigation into the case as the agency's efforts to trace Ahmed, a Master's student at JNU, yielded no results. The agency filed its closure report before the court in the case after getting permission from the Delhi High Court. Ahmed went missing from the Mahi-Mandvi hostel of JNU on October 15, 2016, following a scuffle with some students allegedly affiliated to the Akhil Bharatiya Vidyarthi Parishad the previous night. The National Investigation Agency has informed a Delhi court that Mumbai terror attack accused Tahawwur Rana could spill the beans on Lashkar-e-Toiba and its future terror plans. The agency's argument came on April 28 while seeking Rana's custody before special NIA judge Chander Jit Singh. According to sources, the NIA said, "Hafiz Saeed is an accused in the case and his terror organisation is still involved in terror attacks in India. Rana's custody is required to unearth the operational details of the organisation." The agency said it was interrogating Rana in a "measured" manner considering his health as opposed to his claims of being questioned 20 hours a day. The NIA sought his custody claiming non-cooperation from Rana. "There is contention of non-cooperation of accused in investigation, coupled with the fact of the extent, gamut, depth and widespread nature of the present case which has allegation of hatching the conspiracy at a global level in the sense of accused been fro

It takes one's lifetime to build a reputation, but a few lies can destroy it, said a Delhi court while acquitting a man of rape charge and directing initiation of perjury proceedings against the woman for filing a false case. Additional Sessions Judge Anuj Agrawal was hearing the case against the man, who was accused of raping the complainant in a hotel here on the intervening night of November 23-24, 2019. "It is evident from record that prosecutrix gave false deposition before this court and concocted a mendacious story of rape/threat," the court said in its verdict dated April 4 and acquitted the accused. The court noted that the woman had filed six similar rape and molestation cases in past against different persons and according to Delhi Police she was "in habit of giving false complaint of molestation and eve-teasing". The court said that her statements had "inherent contradictions". Noting the facts of the case, the judge said, "The said circumstances, if seen cumulatively,
A Delhi court on Thursday dismissed a criminal defamation complaint filed by Congress leader Sandeep Dikshit against former chief minister Atishi and AAP MP Sanjay Singh, underscoring their "legitimate exercise of fundamental right to freedom of speech and expression". Additional chief judicial magistrate Paras Dalal refused to take cognisance of Dikshit's complaint and said the averments and contentions labelled defamatory by Dikshit were "not imputation" but "political aspirations and assertions". The order said the statements of the AAP politicians urged the public to make a "wise decision of their precious vote" and couldn't be termed as imputations "worthy of scrutiny" under defamation laws. "This court fails to find that the necessary ingredients of criminal defamation are prima facie not made out. The press conference and averments made by the respondents is nothing more than political discourse amongst rival and competing parties," it said. The statements were observed to h
