Delhi HC to rule on doctors' plea against Ramdev over Coronil claims Monday

The Delhi High Court will on Monday pronounce its order on a plea by several doctors' associations against Yoga guru Ramdev over his claim of 'Coronil' being a "cure" for COVID-19. The plea forms a part of a 2021 lawsuit by the doctors' associations against the Ramdev, his associate Acharya Balkrishna as well as Patanjali Ayurveda. Justice Anup Jairam Bhambhani had reserved the order on the issue on May 21 after hearing the parties. According to the lawsuit, Ramdev made "unsubstantiated claims" with respect to 'Coronil' being a cure for COVID-19, contrary to the licence granted to the drug for merely being an "immuno-booster". The senior counsel appearing for the doctors had sought a direction to restrain the defendants, Ramdev and others, from making further similar statements. HC seeks police's stand on Umar Khalid's bail plea in Delhi riots case

The Delhi High Court sought the city police's stand on Wednesday on the bail plea of former Jawaharlal Nehru University (JNU) student Umar Khalid in a UAPA case related to the alleged larger conspiracy behind the February 2020 riots here. A bench of Justices Suresh Kumar Kait and Girish Kathpalia issued a notice to the Delhi Police on the bail plea and asked the agency to file its reply. The court listed Khalid's bail plea for hearing on August 29, along with the bail pleas of other co-accused in the case, including student activist Sharjeel Imam. The court observed that the bail pleas of Imam and the other co-accused in the case were "set for hearing". Khalid, who was arrested by the Delhi Police in September 2020, has assailed a recent trial court order refusing to grant him bail in the case. Khalid, Imam and several others have been booked under the anti-terror law, Unlawful Activities (Prevention) Act (UAPA), and provisions of the Indian Penal Code (IPC) for allegedly being th

Delhi HC quashes summons to Hero Group Chairman Pawan Munjal in DRI case

The Delhi High Court on Wednesday quashed a summons issued to Hero Motocorp chairman Pawan Kant Munjal in a case registered by the Directorate of Revenue Intelligence (DRI) relating to foreign currency. The high court passed the order on Munjal's plea seeking quashing and setting aside of a trial court's July 1, 2023 order by which the summons was issued against him for alleged offences under the Customs Act. "The petition is allowed. Summoning order is quashed," Justice Manoj Kumar Ohri said while pronouncing the order. In November last year, the high court had stayed the proceedings relating to foreign currency lodged against Munjal by the DRI. The high court, in its interim order, had noted that Munjal was exonerated by the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) on the same set of facts and this was not disclosed before the trial court and that the petitioner had successfully made out a case for interim protection. It had stayed the operation of the July 1,

HC points mistakes in Bharti's plea against Swaraj, asks to file it again

The Delhi High Court on Monday pointed out several mistakes in AAP leader Somnath Bharti's petition challenging BJP MP Bansuri Swaraj's election in the 2024 Lok Sabha polls on grounds of alleged corrupt practices, and asked him to file a corrected one. Justice Manmeet PS Arora said at the outset that there were a lot of typographical errors which made it difficult to understand the averments in the petition. Even the reference to respondents in the petition did not correlate with the respondents mentioned in the memo of parties and synopsis, the counsel said. The court gave Bharti 10 days to file a corrected petition and listed the matter for further hearing on August 14. When Bharti's counsel urged the court to issue notice to the respondents on the petition, the judge said, "There are too many mistakes. Correct the petition first. I can't issue notice like this. I will simply adjourn it. Please file a corrected petition." Both Bharti and Swaraj contested from the New Delhi Lok S

Delhi HC sets July 25 deadline for Centre to decide on office space to AAP

The Delhi High Court on Tuesday granted the Centre time till July 25 to decide on allotment of office space to the AAP here on account of it being recognised as a national party. On June 5, the high court granted six weeks to the Centre to decide the Aam Aadmi Party's (AAP) request in this matter. The Directorate of Estates, Ministry of Housing and Urban Affairs, on Tuesday, sought four more weeks to comply with the court's direction, stating it was occupied with the "mammoth task" of alloting accommodation to parliamentarians. The senior counsel appearing for AAP opposed the Centre's request and emphasised that keeping in view the six-week deadline, which is expiring on Wednesday, the Supreme Court has granted the party time till August 10 as the last opportunity to vacate its present office in Rouse Avenue. In March, the Supreme Court first granted the AAP time till June 15 to vacate its Rouse Avenue office after noting that the land was allotted to the Delhi High Court for ...

If parole can be granted to share grief, why not for happy occasions: HC

The Bombay High Court has granted parole to a man to bid farewell to his son, who is going to Australia for further studies, holding that if parole can be granted to share grief, it can also be for a happy occasion. The court said conditional release for a brief time is allowed to convicts to let them be in touch with the outside world and to arrange for their family affairs as though behind bars, the convict continues to be someone's son, husband, father or brother. A division bench of Justices Bharati Dangre and Manjusha Deshpande in its order of July 9 said the provisions of parole and furlough have been time and again looked towards as a humanistic approach towards the convicts. The court was hearing a petition filed by one Vivek Shrivastav seeking parole to arrange the tuition fees and other expenses for his son's education at an Australian university and to also bid farewell to him. The prosecution opposed the plea claiming that parole is normally given in emergency situation

Excise Policy case: HC lists Kejriwal's plea against ED summons for Sept 9

The Delhi High Court on Thursday listed for hearing on September 9 Chief Minister Arvind Kejriwal's petition challenging the summonses issued to him by the Enforcement Directorate in connection with its probe into an excise policy-linked money laundering case. A bench headed by Justice Prathiba M Singh granted four more weeks to the AAP leader to file a rejoinder to the reply submitted by the ED. The senior counsel, appearing for Kejriwal, sought more time to file the rejoinder saying there are certain changes in the circumstances and they have not been given a proper legal interview, a plea for which is pending in the high court. "Let the rejoinder be filed in four weeks," the bench, also comprising Justice Amit Sharma, said. The counsel for the ED had earlier said the petition against the summonses was infructuous after Kejriwal's arrest by the agency on March 21 in the money laundering case following the high court's refusal to grant him interim protection from coercive action.
