Bihar man gets 5-year jail; fifth man to be convicted under anti-money laundering law

A special court here Thursday convicted a man to five years of rigorous imprisonment under the anti-money laundering law for possession of illegal arms and fake Indian currency notes (FICN), the Enforcement Directorate (ED) said. Mohammed Naushad alias Nasia was also slapped with a fine of Rs 5 lakh and his assets worth over Rs 22.56 lakh have been confiscated under the Prevention of Money Laundering Act (PMLA), it said. This is the fifth conviction under the PMLA in the country after the stringent law was enacted in 2002 and implemented from 2005 to check serious crimes of tax evasion, generation of black money and money laundering. Officials said the ED had filed a criminal complaint against the man in 2013 based on a Bihar police FIR which had charged him under the Arms Act and Unlawful Activities Prevention Act (UAPA) after FICN of Rs 1.40 lakh face value was seized from his possession in 2009. No hearing in Bofors case in SC on Friday

The much-awaited scheduled hearing in the politically-sensitive Rs 64 crore Bofors pay-off case will not take place Friday in the Supreme Court as it has been deleted from the cause list which contains a record of businesses for the day. The cause list till Thursday afternoon showed that the petition filed by the CBI was listed for hearing before a bench comprising justices R Banumathi and Indira Banerjee in court number 8 as item number 43. The matter was deleted from the cause list late Thursday evening. Another petition filed by advocate and BJP leader Ajay Agrawal was not mentioned in the cause list. Agrawal said when he contacted an apex court official about the matter not there in the cause list, he was told that it has been deleted by an administrative order. Some law officers said the CBI was all set to argue on Friday before the Supreme Court to admit its petition in the case which was filed early this year after an inordinate delay of 13 years. Pak constitutional body recommends removal of HC judge over remarks against ISI

A high-level constitutional body in Pakistan on Thursday recommended the removal of a high court judge for his scathing remarks against the country's powerful spy agency ISI, the first such case in nearly five decades. The Supreme Judicial Council (SJC) recommended to remove Islamabad High Court (IHC) Justice Shaukat Aziz Siddiqui, who was facing a case of alleged misconduct over his controversial speech targeting the Inter-Services Intelligence (ISI). Justice Siddiqui while addressing the Rawalpindi District Bar Association on July 21 had alleged that the ISI was manipulating judicial proceedings to constitute panel of judges to get favourable decisions. The army had asked the chief justice of Pakistan to take the notice of the remarks after IHC chief justice Anwar Kansi rejected the allegations against Siddique. Two held for gang-rape of school girl in Yavatmal district

A 20-year-old man has been arrested at Arni in Yavatmal district of Maharashtra for allegedly raping a minor girl in February this year, police said Thursday. While Sheikh Sohel Sheikh Sajid (20) was arrested after the girl's parents lodged the complaint two days ago, another youth, a minor, was apprehended and sent to the children's observation home here, a police officer said. A case under IPC section 376 (rape) as well as under the Protection of Children from Sexual Offences (POCSO) Act has been registered in this regard, said Arni police station officer Yashwant Bawiskar. Minor girl raped by five youths in Ghaziabad

A minor girl was allegedly raped by five youths in a hotel here, police said Thursday. Superintendent of Police Shlok Kumar said the girl, 16, was gang-raped when she had gone to attend the birthday party of her friend on September 25. The youths served her a sedative-laced drink and took her to a hotel in Bazariya market railway road here, where they committed the crime. They threatened her of dire consequences if she disclosed it before parents or police, he said. The accused also shot a video of the act and uploaded it on social networking sites, the SP added. The girl narrated the incident to her parents following which they approached the police, Kumar said. An FIR was lodged against Shahrukh, Chand, Shadab, Rahees and Shaheed under Section 375 (rape) of the Indian Penal Code and The Protection of Children from Sexual Offences Act (POCSO Act). CBI takes over two more cases related to Chhota Rajan

The CBI has taken over investigation in two 25-year old murder cases in Mumbai allegedly involving gangster Chhota Rajan, who is in the judicial custody, officials said. Both the cases were registered in Ghatkopar police station in 1993 with one pertaining to the murder of a hotel owner's relative and another of the brother of businessman. In one case it was alleged that, on May 27, 1993 at 19:30 hrs, two unidentified shooters fired bullets at Ashok Krishna Shetty, cousin of Karianna Shetty, the owner of the Ashoka Hotel. Ashok succumbed to wounds while his friend with whom he was was sitting, Sadanand Suvamna, was injured in the attack. The second case was related to killing of the brother of a businessman on September 10, 1993 by unidentified shooter. It is alleged that when Dilip Hansraj Mota was going with his brother Muksh alias Bharat, along with Mechanic Mohram, by road, an unknown person fired from a revolver which killed Mukesh, they said. Man sentenced to death for raping and killing 3-yr-old

A court here Thursday sentenced a 25-year-old man to death for raping and killing a three-year-old girl on New Year Day in 2017. Additional District and Sessions Judge Kamal Nayan Pandey also handed Rohit Rai imprisonment from seven years to life term for abduction, sexual assault and causing disappearance of evidence. The court also slapped a fine of Rs 25,000 on the man, assistant public prosecutor Dinesh Kumar Ojha said. Rai, who hails from Jabijore village under Sareiyahaat block of Dumka district, had lured the three-year-old with a chocolate and throttled her to death after committing the crime. The police recovered the body on January 3 from a field in the village, and the man was arrested from Banka in Bihar the following day.

Benami property: HC refuses to stay show cause notice against Misa Bharti's relative

The Delhi High Court on Thursday declined to stay the show cause notice and the provisional attachment order issued against Misa Bharti's brother-in-law Nilesh Kumar under the Benami law. Bharti is the daughter of RJD Chief Lalu Prasad Yadav. Justice Vibhu Bakhru said however that the final order passed by the Initiating Officer of the Benami Prohibition Unit-1 (BPU) would not be given effect to until Kumar's petition against the show cause notice and provisional attachment order has been decided by the high court. The court also issued notice to the Ministry of Finance and the Initiating Officer seeking their stand on the plea by November 1. Punjab police solves 10-yr-old murder case, arrests two

The Punjab Police Thursday claimed to have solved a 10-year-old murder case of a columnist-cum-politician in Patiala with the arrest of two persons. Darbara Singh Seona, a Punjabi columnist and the general secretary of the Shiromani Akali Dal, was shot dead on September 12, 2008, by unknown assailants. A case was registered at Civil Lines Police Station in Patiala city in this regard. Gurgaon school murder: HC says 16-year-old accused will not be treated as adult

The Punjab and Haryana High Court on Thursday set aside a lower court order which said the16-year-old student, accused of killing a seven-year-old boy at a private school in Gurgaon over a year ago, will be treated as an adult during trial. Justice Daya Chaudhary allowed the petition of the accused challenging a sessions court decision that he be tried as an adult in the case. The sessions court had upheld a Juvenile Justice Board order. "The court set aside the judgement of the lower court which had ordered that the accused be tried as an adult in the murder case," advocate Sushil Tekriwal, representing the victim's family, said. 'Hardcore criminal' slapped with PSA in J K's Samba

A "hardcore criminal" was on Thursday arrested and slapped with the stringent Public Safety Act (PSA) in Jammu and Kashmir's Samba district, police said. Vipan Kumar Gupta alias Jony was nabbed by a special police team during a raid, a police officer said. He was involved in a number of criminal activities and drug peddling. Man arrested by Delhi Police for theft not our employee: Google

Technology giant Google said on Thursday that it has no employee in the name of Garvit Sahni, who was arrested by Delhi Police for allegedly stealing money to meet his girlfriend's expenses. The 24-year-old man was arrested on Wednesday for allegedly stealing Rs 10,000 from the handbag of a woman at a five-star hotel in Lutyens' Delhi last month. After arresting him, police had said that Sahni worked as an executive at Google. However, Google has denied any association with him. "We would like to put it on record that we have no record of a Google employee with this name or credentials," said a Google spokesperson in a statement. Sahni had told police that he stole the money as he was facing a financial crunch and did not have the money to bear his girlfriend's expenses. CJI asks lawyers again not mention unimportant cases for urgent hearing

Chief Justice Ranjan Gogoi asked lawyers again on Thursday not to seek urgent hearing of cases which are not "so urgent", and said that otherwise Bar's privilege to mention such cases would lose relevance. Justice Gogoi, who took oath as 46th CJI on October 3, has been saying that he would not allow mentioning of cases for urgent hearing till parameters are laid and only cases of real urgency like execution of death penalty and eviction would be treated as urgent. A bench comprising CJI and Justices S K Kaul today again told the lawyers, standing in the queue, to mention only those cases for urgent hearing "which cannot wait". Ex-Bosnia army commander, 16 others charges with war crimes

Bosnian prosecutors have indicted a former Bosnian army commander and 16 other people for war crimes against civilians and prisoners during the country's brutal 1992-95 war. A statement from the prosecutor's office says Atif Dudakovic and the other accused are charged with crimes against humanity over the killings of more than 300 Serbs, mostly elderly civilians or prisoners of war. The accused are former members of the Bosnian army's wartime 5th Corps. Their prosecution for war crimes is sensitive for Bosnia because the corps was in charge of the northwestern Bihac area that was under Serb siege during most of the war, which killed around 100,000 people and left millions homeless.
