Advocates can't be held liable under Consumer Protection Act, says SC

The Supreme Court on Tuesday held that advocates are not liable for deficiency of services under the Consumer Protection Act 1986 and cannot be sued for poor service before consumer courts. A bench of Justices Bela M Trivedi and Pankaj Mithal said the legal profession is sui generis (unique) and the nature of work is specialised and cannot be compared with other professions. "Advocates have to respect client's autonomy, not entitled to make concessions without express instructions from client and transgress authority. Considerable amount of direct control is with client of advocate. This strengthens our opinion that contract is of personal service and excluded from definition of service under Consumer Protection Act," the bench said. IMA president tenders apology in SC for statements against apex court

Indian Medical Association (IMA) president R V Asokan on Tuesday tendered an unconditional apology to the Supreme Court and expressed regret for his statement against the apex court in an interview to PTI where he answered queries about Patanjali Ayurved Ltd's misleading advertisements case. The matter came up for hearing before a bench of justices Hima Kohli and Ahsanuddin Amanullah which posed some tough questions to Asokan and made it clear that at this stage, the apex court will not accept his affidavit tendering unconditional apology. In an affidavit filed in the top court, Asokan said he has realised his error that he ought not have made such statements in the interview when the matter was under consideration of the court. "The deponent (Asokan) hereby tenders his unconditional apology and expresses regret for his statements in relation to the order dated April 23, 2024 passed by this court in the present writ petition," the affidavit said. Kerala govt's borrowing lawsuit to be listed before constitution bench: SC

The Supreme Court on Tuesday assured the Kerala government that its lawsuit against the Centre raising the issue of ceiling on net borrowing will be considered for listing before a five-judge Constitution bench. A bench comprising Justices Sanjiv Khanna and Dipankar Datta took note of the submissions of senior advocate Kapil Sibal, appearing for the state government, that the matter is urgent and be listed after the summer vacation. "We will see and take a call on listing," Justice Khanna told Sibal. NGOs urge SC to list PIL seeking SIT probe into electoral bonds scheme

Two NGOs on Tuesday urged the Supreme Court to consider listing their PIL seeking a court-monitored probe by a special investigation team into alleged instances of "apparent quid pro quo" involving political parties, corporate entities and officials of investigative agencies in the electoral bonds scheme. A bench comprising Justices Sanjiv Khanna and Dipankar Datta took note of the submissions of lawyer Prashant Bhushan, appearing for NGOs Common Cause' and the Centre for Public Interest Litigation (CPIL), that the plea needed to be listed for hearing at the earliest. SC quashes plea for Kejriwal's removal as Delhi CM, says it is up to L-G

The Supreme Court on Monday dismissed a plea seeking removal of Arvind Kejriwal as the Delhi chief minister after his arrest in a money laundering case, holding that the petitioner had no legal right to seek his ouster. A bench of Justices Sanjiv Khanna and Dipankar Datta said resignation in such circumstances is a matter of propriety but there is no legal right to seek removal of Kejriwal as the chief minister following his arrest. "What is the legal right? On propriety you may certainly have something to say, but there is no legal right. It's up to the LG (Lieutenant Governor) to take action if he wants to. We are not inclined to entertain this (petition)," the bench told petitioner Kant Bhati's counsel. The bench, while dismissing the appeal challenging the April 10 order of the Delhi High Court said, "When the matter (Kejriwal's petition against arrest) was being heard, we had posed the same question to them. Ultimately, it is a matter of propriety and there is no legal right."

SC slams authorities over failure to process municipal solid waste in Delhi

The Supreme Court on Monday slammed authorities for their failure to process municipal solid waste generated in Delhi and termed it "sorry state of affairs". The apex court observed that in the national capital, 3,000 tonnes of municipal solid waste generated remains untreated every day. "What is the solution to that," a bench of justices AS Oka and Ujjal Bhuyan asked the lawyers appearing for different authorities, including the Municipal Corporation of Delhi (MCD). The bench observed that the issue of processing municipal solid waste was "very vital" for the national capital and there should be no politics be involved in this. The hearing in the matter has been passed over and will be taken up again during the day.
