BHRC orders pension payment to man who retired in 2008

The Bihar Human Rights Commission today directed the Bihar State Food and Civil Supplies Corporation (BSFCC) to pay pension to an official who did not get it for the past six years.

Nirmal Kumar Sinha, who retired as an Assistant Manager of BSFCC on August 31, 2008, received the order from the Commission which directed the Corporation to pay all his pension dues within a period of one month along with 10 per cent interest.

Delivering the order on Sinha's petition filed in 2010, BHRC Chairperson Justice (Retired) Bilal Nazki said "unfortunately, it took a long time for the Commission to decide.
 

"The time was consumed in trying an amicable settlement so that the petitioner received his dues either from Jharkhand or Bihar state, but none of the states has shown any compassion towards a person who served the Corporation for about four decades," Nazki said.

"He is now living in misery as he retired in 2008. It is almost seven years that he is living without pension or pensionary benefits. This is the worst possible violation of human rights of a citizen," he said.

Sinha was in Bihar government service and was last posted at BSFCC branch office at Giridih in Jharkhand. Though Bihar was divided on November 15, 2000 and Jharkhand was created, BSFCC itself was divided on February 1, 2011. In the meantime Sinha retired, but his dues were not paid.

After the division of BSFCC, neither Bihar nor Jharkhand owned Sinha as their employee and kept passing bucks on his payment.

"The whole problem occurred because the petitioner was not paid his dues immediately. We verified the documents and came to the conclusion that the Bihar part of the divided Corporation is bound to pay his dues. It had paid similar dues of employees who retired around the time Sinha superannuated," Nazki said.
