In his complaint, Mann said the service tax charged by the Mahanagar Telephone Nigam Ltd on the amount of bill is without quid-pro-quo and added that the company is not a tax authority to levy tax.
The department cannot charge any extra amount without providing additional services.
According to the complaint, the trade practice adopted by Mahanagar Telephone Nigam Ltd has resulted in coercion and imposition of unjustified cost on the consumer without any quid-pro-quo.
Therefore, the practice is restrictive in nature under the MRTP Act as it tends to bring about manipulation of prices or condition of delivery.
Also, it affects the flow of supplies in the market relating to goods or services in such a manner as to impose on the consumers unjustified cost or restrictions, the complaint said.
