Swati Maliwal case: HC seeks police stand on Kejriwal aide's bail plea

The Delhi High Court on Friday sought the city police's stand on the bail plea of Chief Minister Arvind Kejriwal's aide Bibhav Kumar in the case pertaining to the alleged assault on AAP Rajya Sabha MP Swati Maliwal. A vacation bench of Justice Amit Sharma issued notice on the bail plea and asked the Delhi Police to file a status report. Kumar, presently in judicial custody, allegedly assaulted Maliwal on May 13 at Kejriwal's official residence. He was arrested on May 18. The Tis Hazari court had on June 7 refused to grant him bail, saying he was facing "grave and serious" charges and that there was an apprehension that he could influence witnesses. Kumar's first bail plea was dismissed on May 27 by another sessions court which said there appeared to be no "pre-meditation" by Maliwal in lodging the FIR and that her allegations could not be "swiped away". An FIR was registered against Kumar on May 16 under various provisions of the Indian Penal Code, including those related to crimi

Delhi HC asks Centre to decide on AAP office space allotment in six weeks

The Delhi High Court on Wednesday said the AAP is entitled to space for a party office here like other political parties and asked the Centre to take a decision on the issue within six weeks. Justice Subramonium Prasad said "pressure" or non-availability of a house in the general pool cannot be a reason for rejection of the request. "They are entitled to a house from the general pool. Mere pressure or non-availability is no reason to reject because pressure is always there and houses have always been allotted to political parties," the court stated. The Aam Aadmi Party (AAP) is seeking allotment of space for its office by the Centre on account of it being recognised as a national party. Considering that the AAP needs to vacate its current office in Rouse Avenue by June 15, the party's counsel had argued that a unit on Deen Dayal Upadhyay (DDU) Marg, which is presently with one of its city ministers, ought to be temporarily allotted to it. Justice Prasad, however, said the party ca

HC takes note of rising Delhi temp, says city could become 'barren desert'

Taking note of the recent temperature spike to 52.3 degrees Celsius in the city, the Delhi High Court has observed that the national capital could become a barren desert if the present generation continues an apathetic view on deforestation. Delhi's Mungeshpur area on Wednesday logged a maximum temperature of 52.3 degrees Celsius, the highest ever recorded in the city. "Judicial notice is taken of the fact that as recent as on May 30, the official temperature recorded in Delhi was 52.3 degrees Celsius. It is not far to see the day when this city may be only a barren desert, in case the present generation continues an apathetic view on deforestation," Justice Tushar Rao Gedela said. The high court, which had earlier appointed its former judge Najmi Waziri as the chairperson of an internal departmental committee of city officials dealing with the protection of forests in Delhi, was informed that Waziri was unable to perform his duties due to a lack of infrastructure. "This court cann

Court sends CM Kejriwal's aide Bibhav Kumar to 14 days judicial custody

A court here on Friday remanded Chief Minister Arvind Kejriwal's aide Bibhav Kumar, who has been accused of assaulting AAP Rajya Sabha MP Swati Maliwal, in judicial custody for 14 days. Kumar, personal assistant to Kejriwal, allegedly assaulted Maliwal at the chief minister's official reidence on May 13. Metropolitan Magistrate Gaurav Goyal allowed the Delhi Police's plea seeking judicial custody for Kumar, who was produced before him on expiry of his three- day police custody. Meanwhile, the Delhi High Court has reserved its order on maintainability of Kumar's plea challenging his arrest. Earlier on Monday, Kumar's bail plea was dismissed by a sessions court which said there appeared to be no "pre-meditation" by Maliwal in lodging the FIR and that her allegations could not be "swiped away". Kumar was arrested on May 18. He was sent to police custody for five days the same day by a magisterial court which observed that his anticipatory bail plea had become infructuous because of

Swati Maliwal case: HC reserves order on Bibhav Kumar's plea against arrest

The Delhi High Court on Friday reserved order on the issue of maintainability of a plea by Chief Minister Arvind Kejriwal's close aide Bibhav Kumar challenging his arrest in connection with the alleged assault on AAP MP Swati Maliwal at the CM's residence earlier this month. The senior counsel, appearing for the police, opposed issuance of notice on the petition on the grounds that it was not maintainable. "Order reserved on maintainability," Justice Swarana Kanta Sharma said after hearing the senior lawyers appearing on both the sides. Kumar, in his plea, has sought a direction to declare his arrest as illegal and in gross violation of the provisions of Section 41A (notice of appearance before police officer) of the Code of Criminal Procedure and against the mandate of the law. The Delhi Police's senior lawyer contended that the objection regarding compliance with section 41A has already been rejected by the trial court and the petitioner should, therefore, file a revision against

Delhi HC dismisses with costs plea seeking reasons from SC collegium

The Delhi High Court has dismissed with costs of Rs 25,000 a petition seeking a direction to the Supreme Court collegium to provide detailed reasons while refusing to accept recommendations for appointment of high court judges. Petitioner Rakesh Kumar Gupta also sought directions to the top court collegium to provide the "qualification" considered for appointment as a high court judge and publish monthly data related to pending and disposal of recommendations. Justice Subramonium Prasad observed that the court cannot sit in appeal over the subjective satisfaction of the Supreme Court's collegium and the petition was a "complete waste of judicial time". "This court is inclined to dismiss the writ petition imposing costs of Rs 25,000 on the petitioner to be deposited with the Armed Forces Battle Casualties Welfare Fund within a period of four weeks from today. The writ petition is dismissed along with pending application(s), if any," the court said in an order passed on May 27. The .

HC grants student activist Sharjeel Imam bail in Delhi communal riots case

More than four years after he was arrested, the Delhi High Court on Wednesday granted bail to student activist Sharjeel Imam in connection with a 2020 communal riots case involving allegations of sedition and unlawful activities. Imam had assailed a trial court order refusing to release him even though he had undergone more than half of the maximum sentence that could be awarded to him, if convicted. He claimed he was entitled to bail under the criminal statute. "Appeal is allowed," a bench of Justices Suresh Kumar Kait and Manoj Jain said after hearing the counsel for Imam and the Delhi Police. He will, however, stay behind bars as he has not been granted relief in the case involving alleged larger conspiracy behind the 2020 North East Delhi riots which left more than 50 people dead and hundreds of others injured. According to the prosecution, Imam made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019 where he threaten

ED to respond to Satyendar Jain's bail plea in money laundering case

The Delhi High Court on Tuesday asked the Enforcement Directorate to respond to a plea by jailed former minister Satyendar Jain seeking default bail in a money laundering case. Justice Swarana Kanta Sharma issued notice to the ED and asked it to file a status report on the matter. The court also called for the nominal roll of Jain from the jail and listed the matter for further hearing on July 9. Jain is accused of having laundered money through four companies allegedly linked to him. He has challenged a trial court's May 15 order by which he was denied default bail in the case. Jain has contended that the ED failed to complete the investigation in all respects within the statutory period and the prosecution complaint (charge sheet), which was incomplete, was filed in an attempt to deprive him of his right to default bail under the provisions of Section 167(2) of the CrPC. The ED arrested Jain on May 30 2022, in the money laundering case based on a CBI FIR lodged against him in 2

Non-recovery of cash can't be proof of no corruption: HC on Sisodia's bail

Non-recovery of cash cannot be a prima facie proof that no corruption has taken place as the offender's mind uses new technology to commit offences without leaving behind any trace, the Delhi High Court has held while denying bail to AAP leader Manish Sisodia in the excise policy scam cases. The high court said it cannot accept the argument put forth by Sisodia about non-recovery of cash from him in view of the statements of some hawala dealers and other witnesses recorded during the investigation. Justice Swarana Kanta Sharma dismissed the bail pleas filed by the former Delhi deputy chief minister in the corruption and money laundering cases lodged by the CBI and ED, respectively, in connection with the alleged liquor scam. While the two petitions were dismissed on Tuesday, the detailed order was uploaded on the high court's website on Wednesday.
