Sahara files appeal against HC order in Jet case

Sahara Airlines Ltd has filed an appeal to a larger bench against yesterday’s order of the high court here, rejectingd its argument for claiming Rs 2,000 crore from Jet Airways for default in payment in the Air Sahara deal.
Judge D Y Chandrachud had ruled that the consideration price for Air Sahara would remain Rs 1,450 crore and not Rs 2,000 crore as demanded by Sahara. The court, however, found Jet guilty of breaching contract terms and directed it to pay Rs 478 crore, including nine per cent interest, to Sahara within two weeks.
Sahara’s counsel, Satish Kishanchandani, said the airline will demand that interest payable to Sahara be fixed at 18 per cent.
He added the airline will argue it had not defaulted on tax obligations, a claim contested by Jet Airways. “The appeal has been filed and will come up for hearing before a division bench of Chief Justice Mohit Shah and Justice G S Godbole on Friday,’’ he added.
