Hardie Trading Wins Trade Marks Case

Hardie Trading Ltd has won its long-standing dispute with Addisons Paints and Chemicals Ltd over the trade marks comprising the words Spartan and Spartan Velox and a picture of the upper body of a helmeted warrior carrying a shield and a spear.

The Supreme Court last week set aside the Madras High Court order in favour of Addisons and held that Hardie could use the trade marks.

The disputed trade marks were first registered in Australia and New Zealand in 1926 and continue till today. Hardie wanted to start its business in paints and lacquers in India and registered the trade marks in Kolkata in 1940.
