Court asks JCP to act against cop, woman for framing youth in

The Joint Commissioner of Police has been directed by a Delhi court to take action against an official and a woman for falsely implicating a youth, with whom her daughter had eloped, in a kidnapping case as he belonged to a different religion.

Additional Sessions Judge Kamini Lau acquitted the youth of the charges of kidnapping the girl and compelling her to marry him, saying she was over 18 years of age at the time of the incident and had gone with him of her own accord.

The court, however, pulled up the girl's mother for falsely deposing before it and said she had twisted the law to suit her convenience.
 

It also questioned the role of the investigating officer, ASI Abbas Raza, for allegedly not placing the full records of the case in court so as to implicate the 23-year-old youth.

"I direct that a copy of this judgement be placed before the Joint Commissioner of Police (Range) for appropriate action against the erring official over the lapses committed by him and also against the mother of the girl," the judge said.

According to the prosecution, a complaint was lodged by the girl's mother that, on April 27, 2011, her daughter was kidnapped by the youth from the Sultanpuri area here. The girl's mother had claimed that her daughter was 17-years-old at the time.

The girl was traced a few days later and the youth arrested.

Later, in court, the girl had deposed that she had willingly eloped with the youth as she was in love with him.

She had added that her parents were against their union as they belonged to different religious faiths.

The girl had pleaded in court that the youth was not at fault and added that she does not wish any action to be taken against him.

During the trial, the youth corroborated the girl's statements in court.
