ICICI Bank gave sanction to prosecute Kochhar in loan fraud case: CBI

The Central Bureau of Investigation (CBI) on Wednesday told a special court here that it received a sanction from the ICICI Bank's board to prosecute Chanda Kochhar, the former CEO and MD of the bank, in connection with a case of alleged cheating and irregularities in loans sanctioned by the bank to Videocon Group companies. The probe agency, represented by special public prosecutor A Limosin, told the court that the board of ICICI Bank in a resolution passed on April 22 this year gave its sanction to the prosecution (against Kochhar), accepting that there seemed to be quid pro-quo. Chanda Kochhar and her husband Deepak Kochhar were arrested by the central probe agency in December last year in connection with the case. The Bombay High Court later granted interim bail to the couple (Kochhars) and came down heavily on the CBI for making the arrest in a "casual and mechanical" manner and without application of mind. The agency had also arrested Videocon group founder Venugopal Dhoot. .

A court here on Wednesday came down hard on the Delhi Police for wrongly and casually clubbing as many as 27 complaints of separate incidents of rioting and arson during the 2020 northeast Delhi riots with a pre-existing FIR, and directed a senior police officer to ensure the additional complaints were investigated properly. Additional Sessions Judge Pulastya Pramachala's order came while acquitting three people, who were named as accused in the original FIR with which 27 complaints were clubbed, for the offences of rioting and arson. Akil Ahmed, Raheesh Khan and Irshad were accused of being part of a rampaging mob that had looted and set ablaze the complainant's shop in Chandu Nagar on February 24, 2020 during the riots. The judge said the charges were not proved against them beyond reasonable doubt. While acquitting the three accused in the main case, the court was severely critical of Delhi Police's action of clubbing 27 complaints with the main FIR and improper and inadequate ..

Court grants bail to Mirchi's aide in money laundering case, pulls up ED

A special PMLA court here on Friday granted bail to businessman Haroun Yusuf, arrested in 2019 in connection with a money laundering case also involving late gangster and drug smuggler Iqbal Mirchi, holding he had no knowledge regarding the latter's source of money. The Enforcement Directorate (ED), probing the case, has claimed Yusuf had assisted Mirchi in buying properties in India using money earned through illegal activities. However, special PMLA (Prevention of Money Laundering Act) court judge MG Deshpande, while granting the accused bail, held that except bare allegations, there was nothing to show Yusuf had any knowledge regarding Mirchi's source of money. The judge also pulled up the central agency for delaying trial in the case. Based on multiple FIRs registered under provisions of the IPC and the NDPS Act (Narcotic Drugs and Psychotropic Substances Act) against Mirchi, the ED had registered its case against him, his family members and others. Mirchi died at the age of

Live streaming of proceedings takes court to homes of common citizens: SC

The Supreme Court Tuesday said live streaming of its proceedings has taken the court to the homes and hearts of common citizens and it is trying to use technology to ensure the live-streamed content is made available simultaneously in languages other than English so more people can follow. A five-judge constitution bench headed by Chief Justice D Y Chandrachud observed this while hearing arguments for the eighth-day on a batch of petitions seeking legal validation for same-sex marriage. Senior advocate Rakesh Dwivedi, appearing for Madhya Pradesh, said an important fallout of the proceedings is that there is a churning in society, and because of this debate and live streaming in different corners of the country, people are thinking about the issue. "The live-streaming of court proceedings has really taken our court absolutely to the homes and to the hearts of the common citizens and I think that is part of the process," said the CJI, who is heading the bench which also comprises ...

SC to hear pleas challenging remission of convicts in Bilkis Bano to May 9

The Supreme Court on Tuesday deferred to May 9 the hearing on a batch of pleas challenging the remission granted last year to all the 11 convicts in the case of gang rape of Bilkis Bano and murder of her family members during the 2002 post-Godhra riots. Several counsel appearing for the convicts raised objections on not being served the notice on Bano's plea, which made the top court observe, "It is obvious, rather more than obvious, that you all do not want the hearing to be conducted by this bench." A bench of Justices K M Joseph and B V Nagarathna was told by Solicitor General (SG) Tushar Mehta, who appeared in the court on behalf of the Centre and the Gujarat government, that they are not claiming any privilege and not filing any plea for a review of the court's March 27 order, asking for the production of the original records with regard to the remission granted to the convicts. The SG raised preliminary objections with regard to the petitions filed in the matter other than the

Surat court to pronounce order on Apr 20 on Rahul's plea to stay conviction

A sessions court here on Thursday said it would pronounce on April 20 its order on Congress leader Rahul Gandhi's plea for a stay to his conviction in a criminal defamation case over his "Modi surname" remark. After hearing arguments from both sides, additional sessions judge R P Mogera said he will pronounce the order on April 20. A metropolitan magistrate's court in Surat had on March 23 sentenced the Congress leader to two years in jail after holding him guilty for his remark "How come all thieves have Modi as the common surname" made during an election rally in 2019. Gandhi, who was disqualified as Member of Parliament after the conviction, has filed an appeal before the sessions court against the verdict. He also prayed for a stay to the conviction in the meantime.

Trial not fair, no need for maximum punishment: Rahul Gandhi's lawyer

Rahul Gandhi's lawyer on Thursday argued in a court in Gujarat's Surat that the trial in a defamation case over the Congress leader's "Modi surname" remark was "not fair" and there was no need for maximum punishment in the case. The lawyer made the argument during a hearing currently underway on Gandhi's plea for a stay on his conviction in the defamation case. A metropolitan magistrate's court in Surat on March 23 sentenced Rahul Gandhi to two years in jail after holding him guilty for his remark "How come all thieves have Modi as the common surname", made during an election rally on April 13, 2019. Bharatiya Janata Party (BJP) MLA and complainant in the case, Purnesh Modi, in his reply filed earlier in the same court, had opposed Gandhi's plea for a stay on conviction saying the Congress leader is a "repetitive offender" who is in the habit of making defamatory statements. On Thursday, arguments from both sides commenced in the court of Additional Sessions Judge R P Mogera. ...

Court refuses pre-arrest bail to NCP's Hasan Mushrif in alleged ED case

A court here on Tuesday rejected an anticipatory bail application filed by former Maharashtra minister Hasan Mushrif in an alleged money laundering case being probed by the Enforcement Directorate (ED). The special court for Prevention of Money Laundering Act (PMLA) cases, however, granted the Nationalist Congress Party (NCP) leader 'interim protection from arrest' till April 14. Mushrif had moved the special court stating that he apprehended arrest under the garb of investigation and the recording of statement under the PMLA. The MLA from Kagal Assembly constituency in Kolhapur had served as rural development minister in the previous Maha Vikas Aghadi (MVA) government. The ED has claimed that there was a suspicious flow of several crores of rupees from two companies without having substantial business to Sar Senapati Santaji Ghorpade Sugar Factory in which Mushrif's sons Navid, Aabid and Sajid are directors or stakeholders. In his pre-arrest bail plea filed through advocates .
