The Supreme Court on Monday dismissed the pleas challenging the 1976 amendment to the Constitution adding terms "socialist", "secular" and "integrity" to the Preamble. A bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar had on November 22 reserved its verdict on a batch of pleas filed by former Rajya Sabha MP Subramanian Swamy, advocate Vishnu Shankar Jain and others, challenging the inclusion of the words "socialist" and "secular" in the Preamble to the Constitution. The petitions do not require a detailed hearing, the CJI said. "The two expressions 'socialist' and 'secular' were made in 1976 through amendments and the fact that the Constitution was adopted in 1949 does not make any difference... the retrospectivity arguments if accepted will apply to all amendments," noted the CJI.

The Delhi High Court has set aside BSNL's decision to withdraw a purchase order placed by it with a private IT company in relation to providing central billing and internet protocol data recovery (IPDR) solutions. The state-owned telecom company had rescinded the multi-crore contract with Millennium Automation Private Limited, dated July 19, for 'Supply, Installation, Testing, Commissioning and Annual Maintenance of IT hardware and related software for BSNL's centralized Mobile Billing System and Probe based IPDR Management Solution', alleging collusion and mala fide on part of the company in securing the purchase order. Justice Sanjeev Narula, in a judgement passed on November 19, said that while the sanctity of the tendering process must be zealously guarded and any deviation must be met with appropriate consequences, the argument of "compromised integrity" in this case could not be sustained in the absence of any "concrete material" to support BSNL's claims. Seeking to provide "further boost" to institutional arbitration and reduce court intervention in such cases, the government has come out with a draft bill seeking views on the proposed amendments. The Department of Legal Affairs in the law ministry has invited comments on the draft Arbitration and Conciliation (Amendment) Bill, 2024, saying "the aim and purpose is to provide further boost to institutional arbitration, reduce court intervention in arbitrations and ensuring timely conclusion of arbitration proceedings". The draft bill comes months after an expert committee headed by former law secretary and former Lok Sabha secretary general T K Vishwanathan submitted its report on proposed reforms in the arbitration sector to the law ministry. In a significant development, the Supreme Court on Friday recalled its 2022 verdict that had declared as unconstitutional two provisions of the law on prohibition of benami property transactions that restrains such deals and acquisition of properties by authorities.
