SC stays Delhi HC order refraining Centre from taking action against Gautam Khaitan

The Supreme Court (SC) on Tuesday stayed the Delhi High Court's order restraining the Central government from taking action against lawyer Gautam Khaitan under provisions of Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015.A vacation bench of Justice Arun Mishra and Justice MR Shah also issued a notice to advocate Gautam Khaitan in connection with a plea filed by the Centre.Earlier on Monday, the SC bench comprising of Justices Indira Banerjee and Sanjiv Khanna had agreed to hear the Centre's plea on Tuesday.The Centre had challenged the May 16 order of the Delhi High Court which stated that Black Money Act that came into force on April 1, 2016, could not be applied retrospectively.It had refrained the central government and the Income Tax Department from taking any action at this stage against Khaitan under the provisions of the Act."We are of the opinion that the petitioner (Gautam Khaitan) has made out a good prima facie case for grant of interim .

Bikaner gang-rape: NCW takes suo-motu cognizance of media report, urges DGP to ensure speedy probe

SC stays Delhi HC order disallowing black money law to operate retrospectively

The Supreme Court Tuesday stayed the Delhi High Court order which had held that the 2016 black money law cannot be allowed to operate with retrospective effect from July 2015 to book and probe offenders. A vacation bench headed by Justice Arun Mishra also stayed the May 16 order of the high court, which had restrained the Income Tax (I-T) department from taking any action against VVIP chopper scam accused Gautam Khaitan, against whom a black money case has been lodged. "Notice. The impugned order (of the high court) is stayed," the bench said while agreeing to hear the appeal of the Centre against the high court order. The bench issued notice to Khaitan and asked him to file his response to the government's petition within six weeks. SC says no to setting up special bench for ex-Kolkata top cop's plea

The Supreme Court on Tuesday refused to set up special bench to hear former Kolkata Police Commissioner Rajeev Kumar's plea seeking extension of the seven-day period granted to him to approach a competent court after his protection from arrest was vacated in connection with the Saradha chit fund scam.The matter was heard by Chief Justice of India Ranjan Gogoi.Kumar had on Monday approached the apex court seeking an extension of the time citing strike of lawyers in West Bengal.The Supreme Court had last week vacated the interim protection from arrest to Rajeev Kumar in the Saradha chit fund scam case but granted him seven days to approach a competent court to seek legal remedies.A bench comprising Chief Justice Ranjan Gogoi and Justices Deepak Gupta and Sanjiv Khanna had said that the order should not be treated as a direction to the Central Bureau of Investigation (CBI) for custodial interrogation and asked the investigating agency to act as per law.The CBI, in its plea, had sought ...

Girl dies after falling into borewell

Rescue workers Tuesday pulled out dead the four-year-old girl, who had slipped into a 440-feet deep borewell at a farm in Melana village of Jodhpur, officials said. Seema fell into the borewell at 5:30 pm on Monday and was stuck at a depth of 260-feet. The body was pulled out after a 14-hour operation and handed over to family members. Despite all efforts we could not take out the girl alive. Her body was taken out at about 7.30 am, Additional District Magistrate Mahipal Bhardwaj said. He said compensation of Rs. 1 lakh from the chief minister's relief fund has been given to the parents of the girl. Initially, rescue teams could hear the cries of the girl but around midnight it stopped. Oxygen was being supplied through a pipe. After the rescue teams and officials came to the conclusion that the girl was no more, a rope with a tool attached to it was dropped in the borewell and the body pulled out. Girl raped by two men in Rajasthan's Karauli district: Police

A girl was allegedly raped by two men in Karauli district of Rajasthan, police said on Tuesday. The victim, aged around 18-19 years, has alleged that the incident happened on Monday, when she was intercepted by two men, who forcibly took her to an isolated area and took turns to rape her, Station House Officer (SHO) of the Todabhim police station Manoharlal said, adding that the accused are absconding. One of the accused was identified as Manish Meena, he said. "A medical examination of the girl will be conducted on Tuesday. Teams have been formed to nab the accused," the SHO added.

Woman raped by occultist in UP

A 25-year-old woman has alleged that she was raped by an occultist in Uttar Pradesh's Shahjahanpur district, police said on Tuesday. The incident took place in Samastipur village under Madnapur police station area on Sunday, they said. On the pretext of curing the woman of some ailment, the occultist, identified as Pramod, took her into the jungle after sending her husband away. He allegedly raped her there, Madnapur police station in-charge Mohd Kasim said. While returning, the woman narrated her ordeal to her husband who lodged an FIR, he said. Pramod fled the village after the incident and a manhunt has been launched to nab him, Kasim said, adding that the woman has been sent for medical examination.

Two of a family killed in accident in UP

Two members of a family were killed and two others injured after they were hit by a speeding SUV on National Highway 2 here on Tuesday morning, police said. The victims were standing on the roadside when the vehicle hit them, Kokhraj police station in-charge Rajkumar Verma said. Nusrat (30) and her daughter Alisha (5) died on the spot. Nusrat's mother-in-law and son were injured, he said. The driver has been arrested and the SUV has been impounded, he said.

SC dismisses plea challenging appointment of observers for LS polls in West Bengal

The Supreme Court Tuesday refused to entertain a plea challenging the appointment of two retired bureaucrats as special observer and central police observer in West Bengal for Lok Sabha polls. A vacation bench comprising Justices Arun Mishra and M R Shah said it was not inclined to entertain the petition as polling is already over. The bench, however, granted liberty to petitioner Ramu Mandi, who is contesting Lok Sabha polls as an independent candidate from Barrackpore constituency of West Bengal, to approach the Calcutta High Court.

Rajasthan: Man sentenced to life for killing lover

A special court here has sentenced a 40-year-old man to life imprisonment for killing a woman, with whom he was in a relationship, by running her over with his SUV in 2013. Special woman harassment court judge Lokesh Sharma convicted Ganesh Gujjar under sections 302 (murder) and 201 (tampering of evidence) of the Indian Penal Code on Monday, special public prosecutor Niteyendra Sharma said. The court also imposed a fine of Rs 13,000 on Ganesh, he said. The statements of eyewitnesses -- 14-year-old son of the deceased and Assistant Sub-Inspector (ASI) Babulal -- played a decisive role in securing the conviction, he added. The woman, Pooja Gujjar, who had separated from her husband, was in a relationship with Ganesh. The two were having frequent arguments, Sharma said. The man accused of shooting dead 51 Muslim worshippers in the Christchurch mosque attacks was formally charged with terrorism for the first time on Tuesday, New Zealand police said. In addition to the terror charge, Brenton Tarrant also faces 51 charges of murder and 40 of attempted murder over the March 15 attacks. "The charge will allege that a terrorist act was carried out in Christchurch," police said in a statement. The Central Bureau of Investigation (CBI) has given a clean chit to Samajwadi Party (SP) leaders Mulayam Singh Yadav and Akhilesh Yadav in connection with a disproportionate assets case.The probe agency gave a clean chit to the SP leaders in an affidavit filed in the Supreme Court.The CBI, in its affidavit, stated that it had closed the investigation on August 7, 2013, in the case and did not find any evidence to register a Regular Case (RC) against the father and son.The apex court had earlier directed the CBI to file a status report in the case. Maha: Sand boa snakes worth Rs 1.2 crore seized, 2 held

Two sand boa snakes, a protected species under the Wildlife (Protection) Act, were seized in Palghar district of Maharashtra and two persons were arrested, police said on Tuesday. Acting on a tip-off, the police kept a watch on the two men and seized the snakes, worth around Rs 1.2 crore in the illegal wildlife market, near the Nallasopara railway station on Saturday evening, senior police inspector Jitendra Vankoti said. The accused - Shashant Mudaliar (32) and Mosin Qureshi (30)- were subsequently arrested, he said, adding that the duo was trying to sell the reptiles. Sand boas are used for making certain medicines, cosmetics and in black magic, and are in huge demand in the international market. The two accused were booked under relevant provisions of the Wildlife (Protection) Act, Vankoti said.

Mentally challenged woman raped in Maharashtra

A 20-year-old mentally challenged woman was allegedly raped by an unidentified man in Palghar district of Maharashtra, police said on Tuesday. The offence came to light some days back when doctors found that she was pregnant, a police spokesperson said. The victim was allegedly raped on several occasions in the last two-and-a-half months by the man at her home in Vasai area here when her parents, who are labourers, went out for work, he said. The man used to lure the victim by offering her biscuits and chocolates, the official said. A few days back, the woman complained of stomachache following which her parents took her to a hospital where doctors found that she was pregnant, he said. The victim has so far not been able to identify the accused, the official said. The woman's parents on Monday lodged a complaint following which the police registered a case under Indian Penal Code sections for rape, he said. Efforts were on to identify and trace the accused, he added.

Malegaon blast case: Pragya Thakur, two other accused exempted from court appearance

A special court here has granted exemption to the 2008 Malegaon blast case accused Pragya Singh Thakur, Lt Col Prasad Purohit and Sudhakar Chaturvedi from appearing before it this week. When the matter was taken up by the special NIA court on Monday, the three accused filed applications through their lawyers seeking exemption from appearance. While Thakur and Chaturvedi said they are busy with preparations for the upcoming results of the Lok Sabha polls, which they had contested, Purohit cited personal difficulties. The court allowed the applications. The court also allowed an application filed by lawyers of the accused persons to visit the blast site in Malegaon, a town about 200 kilometers from here in Maharashtra's Nashik district. A four-year-old girl died after she fell into a 400-feet deep borewell in a village in Rajasthan's Jodhpur district on Monday.A massive 13-hour rescue operation was carried out to bring out the child safely.
