HC bail direction ordering closure of YouTube channel 'unwarranted': SC

The Supreme Court on Friday termed as unwarranted and extraneous the Madras High Court directive to YouTuber Felix Jerald to close down his channel as one of the bail conditions. The top court also confirmed its September 6 order granting bail to Jerald sans the condition asking him to close down his YouTube channel "RedPix 24x7". "The bail order of September 6 is hereby confirmed," a bench of Chief Justice D Y Chandrachud and Manoj Misra said after taking note of the submissions of senior advocate Gopal Sankaranarayanan, appearing for the YouTuber. The bench noted that following its earlier order Jerald has been already released on bail. "One of the bail conditions (imposed by the high court) asking him to close down his YouTube channel was unwarranted and extraneous and we accordingly set aside that condition," the bench said, adding the other bail conditions will remain operational. Jerald was arrested for hosting an "objectionable" interview of another YouTuber Savukku Shankar

PIL filed in Madras High Court to regulate functioning of You Tube

The Madras High Court on Monday ordered notice to the Centre and Tamil Nadu government on a petition, which sought to regulate and restrict the functioning of You Tube so as to bring it in conformity to Indian laws, social and religious restrictions, notwithstanding the right conferred under the fundamental right. A division bench comprising Acting Chief Justice D Krishnakumar and Justice P B Balaji posted after four weeks, further hearing of a PIL filed by advocate V Parthiban. According to the petitioner, media trials were effectively carried out on YouTube to hamper the investigation and decisions when the matter was sub-judice. Even such media trials, freely posted and commented on the social media site escape the eyes of law from contempt as You Tube disowns responsibility for any content posted by YouTubers, though it was also a beneficiary of any post, apart from those updating such content, he added. Several innocent people were getting affected. They were being judged by ..

DMK moves high court against 3 new criminal laws introduced by Centre

The DMK on Friday approached the Madras High Court to declare as ultra vires and unconstitutional, the three new criminal laws brought in by the Union government. The three laws-- Bharatiya Nagarik Suraksha Sanhita, Bharatiya Nyaya Sanhita and Bharatiya Sakshya Adhiniyam have come into effect from July 1. They have replaced the Indian Penal Code, The Code of Criminal Procedure Code and the Indian Evidence Act. A division bench comprising Justices S S Sundar and N Senthil Kumar before whom the petition filed by DMK Organising Secretary R S Bharathi came up for hearing, ordered notice to the Centre, returnable by four weeks. According to the petitioner, the government introduced the three Bills and got them passed by the Parliament without any meaningful discussion. In the absence of any substantive changes, mere shuffling of sections was unnecessary and will cause a lot of inconvenience and confusion regarding the interpretation of the provisions, he added. He said shuffling of ...

After Madras HC's nod, PM Modi to hold roadshow in TN's Coimbatore today

Prime Minister Narendra Modi will hold a roadshow here on Monday, days after Madras High Court green-flagged the event, asking the police to allow it with reasonable conditions. The PM will take out the roadshow in the city's Mettupalayam Road and is likely to end it at RS Puram later today. This will be his first political engagement in the state after the announcement of the seven-phase schedule of the Lok Sabha polls. The district BJP unit had on Friday moved the HC against the local police denying permission to the PM event, citing, among others, the "communally sensitive" nature of the area, and the ongoing public exams. However, the court had dismissed the contentions and asked the police to allow the roadshow with "reasonable conditions", such as erecting no flex boards by the organisers. The BJP, with a newfound vigour under its aggressive state unit president K Annamalai, is making all efforts to make significant inroads into Tamil Nadu, the Dravidian heartland that has ..

Madras HC convicts ex-IPS officer Sampath Kumar in Dhoni's contempt plea

The Madras High Court on Friday imposed a punishment of 15 days' simple imprisonment on retired IPS officer G Sampath Kumar in a contempt of court case filed by former Indian cricket team captain Mahendra Singh Dhoni. A division bench comprising Justices S S Sundar and Sunder Mohan found Sampath Kumar guilty of committing criminal contempt. "However, taking into consideration the credentials of the respondent (Sampath Kumar), as projected by him in his written statement as well in the reply affidavit, this court, showing lenience, restricts the punishment for a period of 15 days." "Even though a request is not received from the side of the respondent, this court is inclined to exercise its power under section 19 (3) of the Contempt of Courts Act and suspend the execution of punishment imposed on the respondent by this court, for a period of 30 days" (to enable him file an appeal).
