SC miffed over PIL seeking in-house inquiry against ex-CJI Ranjan Gogoi

The Supreme Court on Monday took strong note of former CJI Ranjan Gogoi being made a party to a PIL and seeking of an in-house inquiry against him for dismissing a plea earlier related to a service dispute. "How can you file a PIL with a judge as a respondent? There has to be some dignity. You cannot just say I want an in-house inquiry against a judge. Justice Ranjan Gogoi was a former judge of the Supreme Court," a bench comprising Chief Justice D Y Chandrachud told a Pune-based litigant. "He retired as the Chief Justice of India. You cannot say I want an in-house inquiry against a judge because you did not succeed before the bench. Sorry, we cannot tolerate this", the bench said. The litigant filed a PIL after his plea relating to his termination of services under labour laws was earlier dismissed by a bench headed by Justice Gogoi, since retired. At the outset, the CJI got miffed when the litigant said ya-ya' instead of yes' in response to some queries from the bench, which also

Gogoi urges PM to take action to combat narcotics smuggling from Myanmar

Congress deputy leader in the Lok Sabha, Gaurav Gogoi, has called upon Prime Minister Narendra Modi to take "decisive action" to address the widespread smuggling of narcotics from Myanmar into India. Gogoi emphasised that this illicit activity not only poses a threat to national security but also presents severe health risks to citizens. Recent media coverage has shed light on the alarming frequency of truck entries at Merapani border in Assam, indicating that smuggled Myanmar-origin areca nuts, colloquially known as Burmese supari, are making their way to our country through the porous India-Myanmar border in Mizoram and Manipur, the Assam MP said in a letter to the Prime Minister on Tuesday. Subsequently, these smuggled areca nuts find their way to Nagaland from where they are distributed to gutkha industries in Kanpur, Lucknow and West Bengal and these activities are conducted with blatant disregard for customs duties and regulations, he added. Other drugs such as heroin, opium,

Gogoi questioning jurisprudence of Constitution's structure shocking: Cong

The Congress on Monday said former CJI and Rajya Sabha MP Ranjan Gogoi "questioning the jurisprudence of the basic structure of the Constitution" was "shocking". The party asked if this was the "BJP's trick" to begin the "full-fledged dismantling" of the Constitution. The Congress' attack on the ruling party came after Gogoi, while participating in the debate on the Government of National Capital Territory of Delhi (Amendment) Bill, 2023, said, "There is a book by (TR) Andhyarujina, the former solicitor general, on the Kesavananda Bharati case." "Having read the book, my view is that the doctrine of the basic structure of the Constitution has a very debatable jurisprudential basis. I would not say anything more than this," the former chief justice of India said. Reacting to his remarks made in Rajya Sabha, Congress general secretary in-charge organization K C Venugopal said, "Shocking that a former CJI questions the jurisprudence of the basic structure of the Constitution." Delhi services bill perfectly, legitimately valid: Ranjan Gogoi in RS

Former Chief Justice of India and Rajya Sabha MP Ranjan Gogoi on Monday said the bill to replace an ordinance for handling the transfers and postings of officials in the Delhi government is "perfectly, legitimately valid". Home Minister Amit Shah introduced the Government of National Capital Territory of Delhi (Amendment) Bill, 2023 for consideration in the Rajya Sabha. The bill was passed by the Lok Sabha last week. Participating in the debate on the bill, Gogoi, a nominated member of the Upper House, said it is the prerogative and the right of the members of the House to debate, and the question of the proposed legislation being sub-judice does not arise. Several leaders from the opposition parties have termed the Delhi services bill as "unconstitutional". Some even suggested that Parliament should not take up the bill saying the matter was pending before the Supreme Court. "So far as overreaching or outreaching the order of the court, Supreme Court, is concerned, very shortly p
