Prajwal Revanna challenges conviction in rape case in Karnataka HC

Former JD(S) MP Prajwal Revanna has approached the Karnataka High Court appealing against his conviction in a rape case. A special court that convicted Revanna last month had sentenced him to imprisonment for the remainder of his life and imposed fines, in one of the four sexual abuse and rape cases against him. The Special Court for MPs/MLAs, Judge Santosh Gajanan Bhat, who sentenced the convicted politician under various sections of the IPC on August 2, had imposed a total fine of Rs 11.50 lakh on him, and had said Rs 11.25 lakh from this fine amount will be paid to the victim. Revanna, who was arrested in May last year after returning from Germany, is contesting the verdict on several grounds, including what he claims are contradictions in the survivor's testimony and inconsistencies in the evidence produced by the prosecution. The case in which Prajwal has been sentenced pertains to the one involving 48-year-old woman who was working as a help at the family's Gannikada farmhous

SC upholds rape conviction, says parental abuse shatters family trust

Observing incestuous sexual violence by a parent "tears through" the foundational fabric of familial trust, the Supreme Court has upheld a man's punishment for raping his minor daughter. A bench of Justices Aravind Kumar and Sandeep Kumar called the dignity of women "non-negotiable" while asking the legal system not to permit repeated intrusion into that dignity under the "guise of misplaced sympathy" or purported "procedural fairness". Justice, the August 4 order said, must not be limited to conviction and must include restitution. The top court further directed Rs 10.50 lakh to be paid to the survivor as compensation under the state of Himachal Pradesh. "Incestuous sexual violence committed by a parent is a distinct category of offence that tears through the foundational fabric of familial trust and must invite the severest condemnation in both language and sentence. The home, which should be a sanctuary, cannot be permitted to become a site of unspeakable trauma, and the courts

A suspect detained in connection with the alleged rape of a Pune IT professional at her home was her friend and not a stranger who gained entry by posing as a courier delivery agent, police said on Friday, casting doubt on her version of the events. It was the woman herself who took a selfie with him and typed a threatening message in her phone, police commissioner Amitesh Kumar said. "They know each other for a couple of years and belong to the same community," he said. The 22-year-old woman had claimed that a man who posed as a courier delivery agent entered her flat in Kondhwa area on Wednesday evening when she was alone, and forced himself on her. She passed out, and when she regained consciousness, he was gone, she said. Before leaving, the accused clicked a selfie using her phone in which her back and a part of his face are seen, and left a message warning that he had taken her pictures and would release them on social media if she reported the incident, she told police. The Calcutta High Court on Monday directed the CBI to produce the case diary related to its investigation into the rape-murder of an on-duty doctor at RG Kar hospital on the next date of hearing. RG Kar case: Legal experts back life sentence, oppose death penalty

Amid the raging debate over a Kolkata court sentencing R G Kar hospital rape-murder convict Sanjay Roy to life imprisonment till death, legal luminaries are unequivocal in their stand against awarding capital punishment to anyone. The Sealdah sessions court had on January 20 held Roy guilty of the rape and murder of an on-duty medic at the state-run RG Kar Medical College and Hospital, and sentenced him to life imprisonment till the end of his natural life. Holding that death penalty is undemocratic and irreversible, former Supreme Court judge Ashok Ganguly said such a punishment should, therefore, not be continued in a free, democratic country. Asserting that the demand for capital punishment to Roy is not just, he said in more than 150 countries across the world, there is no death penalty. He said that in Europe, there is no country where death penalty is allowed, and in America, too, there are various states where capital punishment is not awarded. "We always cry for death pena
