HC stays construction of Rs 500-cr township in Alwar

The Rajasthan High Court has stayed the construction of a Rs 500-crore township in Alwar in the national capital region (NCR) by a private builder and issued show-cause notices to the governments of Delhi, Haryana and Rajasthan.

Justice Mohammad Rafiq of the Jaipur Bench has issued the stay on "Park City" being developed at Belaka village in Alwar district by Omway Build Estate Ltd on a petition filed by some investors.

The petition said there were irregularities like benami transactions and unauthorised sale of plots of the project, besides which the Alwar Divisional Commissioner had on August 21 rejected the land conversion granted to the firm.

It alleged that the state government gave its approval to the project despite several FIRs against Omway Director Janak Goyal in Rajasthan and Haryana, which were being probed.

The petitioners informed the court that a single-judge bench had earlier stayed the project following an anticipatory bail application filed by Goyal.

They said the Delhi High Court had also directed the firm not to sell land as there was no scope to get plots in the township while hearing a dispute between the partners.

There were only 216 plots available for sale in the township but the promoters had booked more than 350 plots, the petition said and alleged the firm was involved in defrauding and cheating of investors.

The petition prayed that the no objection certificate granted to Omway be annulled and the sub-registrar be directed to cancel all the sale deeds.

The court has sent show-cause notices to the Registrar of Companies, NCT of Delhi, Secretary of Haryana Urban Housing and Development Department, Sub-Registrar of Urban Improvement Trust, Alwar, and one Ghanshysham who is a partner in the project.
