Court asked to add criminal intimidation charge against woman

A court has ordered framing of the additional charge of criminal intimidation against a woman lawyer for allegedly hurting a man inside court premises when he had come to surrender in a criminal case filed by her.

Additional Sessions Judge Manoj Jain asked the court of metropolitan magistrate to frame charge under section 506 (criminal intimidation) in addition to section 323 (voluntarily causing hurt) of IPC.

The charges are to be framed against the woman advocate on a plea filed by a south-Delhi resident, Ram Prakash Yadav, who had challenged the order passed by the magisterial court which had framed charge only under section 323.
 

He had approached the sessions court contending that charges under sections 506 (criminal intimidation) and 341 (wrongfully restraining any person) of IPC should also be framed against the woman as she, along with her associates, had allegedly abused and criminally intimidated him inside the court premises.

In its order, the sessions court said the charge under section 341 of IPC could not be substantiated as there was no averment or deposition in this regard.

"However, as regards section 506 of the IPC, I feel that trial court has not appreciated the entire factual matrix in the desired manner," the sessions court said.

"In view of aforesaid, the revision petition is partly allowed and it is ordered that accused (woman) would stand trial for committing offences under section 323 IPC and section 506 (part-I) IPC," the judge said.
