Terminating the services of a woman on account of marriage under a service rule is a coarse case" of gender discrimination and inequality, and acceptance of such patriarchal norms undermine human dignity, the Supreme Court has said. The apex court made the strong observation in a case where former lieutenant Selina John was released from her job in the Military Nursing Service on account of her marriage. The top court directed the Centre to pay a compensation of Rs 60 lakh to John. We are unable to accept any submission that the respondent Ex. Lt. Selina John, who was a Permanent Commissioned Officer in the Military Nursing Service, could have been released/discharged on the ground that she had got married. This rule, it is accepted, was applicable to only women nursing officers. Such rule was ex-facie manifestly arbitrary, as terminating employment because the woman has got married is a coarse case of gender discrimination and inequality. Acceptance of such patriarchal rule ...

The Supreme Court on Wednesday refused to pass an order on an urgent listing of a lawsuit filed by the West Bengal government that has accused the CBI of going ahead with its probe in post-poll violence cases, without securing the prerequisite nod from the state under the law. Senior advocate Kapil Sibal, appearing in the matter on behalf of the West Bengal government, told a bench of Chief Justice D Y Chandrachud and justices J B Pardiwala and Manoj Misra that the matter has been adjourned nine times. The Supreme Court's order in the Chandigarh mayoral polls case is a big victory for democracy, the AAP said on Tuesday, demanding that BJP leaders apologise to the country for its "dishonesty" during the elections. The top court has said it would direct recounting of votes polled in the controversial elections and declaration of result after considering the eight "defaced" ballots that were declared invalid by the returning officer. The Supreme Court's order has exposed the BJP and shown it the mirror. The party's leaders should apologise to the country if they have any shame left, Aam Aadmi Party (AAP) spokesperson Saurabh Bharadwaj told a press conference here. "It is a matter of grave concern that if the BJP and its central government can do such open stealing and dishonesty in such a small poll, what would they do in other elections where there are no microphones and CCTV cameras," Bharadwaj said. The January 30 polls were videographed, and days after the announcement of result
The Congress on Tuesday hailed the Supreme Court's interim order asking the states and Union Territories to act as per the definition of "forest" laid down by the top court in a 1996 judgment and said it is committed to protecting forests and environment when an INDIA bloc government is formed. Congress General Secretary Jairam Ramesh said that after the "electoral bonds scam", the Supreme Court has stopped another set of "blatantly illegal and disastrous" Modi government schemes. Former environment minister Ramesh also tagged a media report on the Supreme Court directing that the dictionary meaning of "forest" be applied. He also shared another media report on the amnesty window opened for just six months in March 2017 to clear projects in a novel "violation category" that became routine through a Union Environment Ministry notification in July 2021, and provided ex-post facto approval to over 100 projects till the Supreme Court stayed the notification in January this year. The Kerala government has flayed the Centre's stand to allow the state to borrow money only if it withdrew the case before the Supreme Court, terming it "highly disappointing" and detrimental to fiscal federalism. Addressing media here on Monday, state Finance Minister K N Balagopal claimed that the central government has informed the apex court that if Kerala withdraws its petition, the government will give the state permission to borrow around Rs 12,000 crore on Monday itself. "The state government has filed the case in the Supreme Court for the fund which is rightfully ours," he said. "The Union government's stand is highly disappointing and will affect the fiscal federalism of the state and the day-to-day activities of the state government," Balagopal added. "Our lawyer Kapil Sibal argued for us and said we were seeking the amount that is rightfully ours. We have filed the petition seeking the fund as per our constitutional rights. They have asked us to withdraw our plea and it

The Supreme Court on Monday stayed proceedings against Karnataka Chief Minister Siddaramaiah and others in connection with a protest march held in the state in 2022. A bench of Justices Hrishikesh Roy and P K Mishra issued notice to the Karnataka government and the complainant in the case. The top court also stayed the high court order, which had imposed a fine of Rs 10,000 on him as well as Congress general secretary and Karnataka in-charge Randeep Singh Surjewala, state ministers M B Patil and Ramalinga Reddy, and directed him to appear before a special court on March 6. The case was registered against the Congress leaders after they took out a march to lay siege to the then chief minister Basavaraj Bommai's residence in Bengaluru, demanding the resignation of K S Eshwarappa, who was then the rural development and panchayat raj minister in the southern state. The agitation was staged after a contractor, Santosh Patil, died by suicide accusing Eshwarappa of demanding 40 per cent .
Observing that "horse-trading is taking place", the Supreme Court has said it would peruse on Tuesday the ballot papers of the Chandigarh mayoral polls and the entire video-recording of the counting day, and directed the registrar general of the Punjab and Haryana High Court to depute a judicial officer to bring the records safely to Delhi. The top court, on February 5, rapped Returning Officer Anil Masih, who conducted the mayoral polls, observing that it was obvious that he had defaced the ballot papers and that he should be prosecuted, adding that his action amounted to "murder" and a "mockery" of democracy. A bench headed by Chief Justice D Y Chandrachud directed the Chandigarh administration on Monday to provide security to the judicial officer, to be appointed by the high court, to ensure the safety of the officer and the records. "We ourselves will look at the records at 2 pm," the bench, also comprising justices J B Pardiwala and Manoj Misra, said. "Horse-trading taking ...
Sharad Pawar on Monday described as a victory of voters the Supreme Court ruling that his faction can use the name 'NCP-Sharadchandra Pawar' till further orders. It is a win for the voters as the court observed that the voters of the country should not be undermined and questioned what about the fact that candidates have fought on the ticket of the original party, Pawar said in a statement. The apex court on Monday directed that Election Commission's order of February 6 allotting 'Nationalist Congress Party-Sharadchandra Pawar' as the party name for the Sharad Pawar faction will continue till further orders. On the auspicious day of Chhatrapati Shivaji Maharaj Jayanti, the Supreme Court has granted us interim relief against the order of the Election Commission of India.
