HC refuses to interfere with BoB's decision inviting EoI for NBL stake sale

The Delhi High Court has refused to interfere with the "expression of interest (EoI)" invited by Bank of Baroda (BoB) for acquisition of its stake in Nainital Bank Limited (NBL). Justice Purushaindra Kumar Kaurav dismissed a petition by the Nainital Bank Officers Association and said BoB's divestment decision was not arbitrary or illegal, and there was no "clear violation" of any statutory provisions in the process. The judge, in an order passed on May 2, said divestment is a policy decision involving complex economic factors, and courts have consistently refrained from interfering with economic decisions. "This court, therefore, at this stage, is not inclined to interfere with the impugned advertisement of EoI. However, it would be open to the petitioner to raise any grievance at an appropriate stage in accordance with the law, if so necessitated," the court ordered. "It is thus seen that in the instant case, in the absence of there being a clear violation of any statutory provisi

SC to hear Delhi govt plea against HC order staying notice against Rapido

The Supreme Court on Monday agreed to hear the Delhi government's plea challenging the high court order staying its notice to bike-taxi aggregator Rapido and allowing it to ply till the final policy has been notified. A vacation bench of Justices Aniruddha Bose and Rajesh Bindal said it will hear the petition on June 7. Senior advocate Manish Vashisht, appearing for the Delhi government, said the high court's decision to stay its notice till the final policy is notified is like virtually allowing the writ petition by Rapido. The bench said it will list the matter for hearing on Wednesday. On May 26, the high court, while issuing notice to the Delhi government on Rapido's plea challenging a law that excludes two-wheelers from being registered as transport vehicles, directed no coercive action will be taken against the bike-taxi aggregator till the final policy has been notified. Why was excise policy withdrawn if it was good? Delhi HC asks Sisodia

The Delhi High Court Thursday asked former deputy chief minister Manish Sisodia, arrested in cases related to alleged irregularities in the city government's excise policy, to explain why he chose to withdraw the policy when it was claimed to be "so good". Justice Dinesh Kumar Sharma, while hearing the bail application of co-accused Vijay Nair in a money laundering case arising from the alleged scam, asked the counsel for the AAP leader to "get a definite reply" to his query. Sisodia also held the excise portfolio besides many others as the deputy chief minister. "If policy is so good, why did you withdraw it? Get a definitive reply for this," said the judge, who was informed that Sisodia, currently lodged in Tihar jail, has once again filed applications for his interim release. The counsel for Sisodia submitted the policy was rolled back after the Delhi Lieutenant Governor did not let liquor vends to open in "non-conforming" zones, leading to losses. He claimed vends were allowed

Go First lessors' plea for plane delisting shown as rejected due to glitch

The Directorate General of Civil Aviation (DGCA) Wednesday told the Delhi High Court it was due to a technical glitch on its portal that the applications of several aircraft lessors of Go First for deregistration of their planes were shown as rejected'. The aviation regulator said it was not processing such requests following a moratorium on financial obligations and transfer of assets of the crisis-hit airline in the wake of insolvency resolution proceedings. The lessors are unable to deregister and take back the aircraft leased to the carrier because of the moratorium. Justice Tara Vitasta Ganju asked the counsel for DGCA as to why different responses were sent to different lessors on repossession requests. Why is there a distinction? There are 7-8 petitions and each one of them has a different response. Why so? the court asked. The court asked the DGCA counsel to produce the documents in relation to each petitioner lessor on Thursday when it will hear further arguments on beha

Trial court can't send foreigner to detention while granting bail: Delhi HC

A trial court cannot send a foreign citizen to a detention centre at the time of granting him bail as these facilities are not meant for judicial custody but for keeping foreign nationals on the basis of an executive order in terms of the Foreigners Act, the Delhi High Court has said. Justice Anish Dayal's order came on petitions by a Nigerian man who was sent to a detention centre by a magisterial court even while being granted bail in a criminal case filed under the Delhi Excise Act and the Foreigners Act in April 2021 considering that his visa had expired. Subsequently, a sessions court directed his release from the detention centre subject to certain conditions but the petitioner contended before the high court that he was yet to be released. The court said once enlarged on bail, the petitioner cannot be detained without following the due process of law when he is yet to be proved guilty. "The petitioner once being enlarged on bail cannot be detained without due process of law.

Sisodia liable for corruption in Delhi excise policy formulation: BJP

The BJP on Monday welcomed the denial of bail to former deputy chief minister Manish Sisodia saying the politician is "liable for action" against him for "corruption" in framing of the now-scrapped Delhi excise policy. The Delhi High Court earlier in the day dismissed Sisodia's bail plea in the alleged excise policy scam being probed by the CBI, observing that he is an influential man and the allegations against him are "very serious" in nature. Justice Dinesh Kumar Sharma denied the relief to the AAP leader, who was arrested on February 26, saying he has held the post of the deputy chief minister with 18 portfolios and the possibility of witnesses being influenced cannot be ruled out. Addressing a press conference, BJP leader and Union Minister Meenakshi Lekhi said: "There is a very famous proverb which says, fence eating the crop. This comes to my mind because there is a strong suspicion that those who are supposed to protect and uphold the law have become the violators of law ..
