2G scam case: Illegalities in judgment acquitting A Raja, CBI to Delhi HC

The CBI contended before the Delhi High Court on Tuesday that there were glaring illegalities in the trial court judgment that acquitted former telecom minister A Raja and others in the 2G spectrum allocation scam case. The Central Bureau of Investigation (CBI), which was making submissions on its appeal challenging the acquittal of the accused individuals and firms, argued that the evidence placed before the special court was disregarded. Justice Dinesh Kumar Sharma, after hearing part arguments, listed the matter for further proceedings on May 29. "I will demonstrate that there are glaring illegalities in the (trial court) judgment. The evidence placed by the CBI was disregarded. Appreciation of evidence was completely wrong. I will show that the judgment was perverse and there were flaws in it," advocate Neeraj Jain, who appeared in the court on behalf of the CBI, argued. Delhi HC sets aside mayor's decision for re-elect MCD standing committee

The Delhi High Court Tuesday set aside the decision of Mayor Shelly Oberoi to call for a repoll to elect six members of the MCD standing committee and directed her to declare forthwith the results of the poll held on February 24. Justice Purushaindra Kumar Kaurav said the mayor, also the returning officer, acted beyond her powers and her decision was legally impermissible. The act of the mayor in rejecting the ballot after the stage of scrutiny and determination of quota was bad in law, the judge said. The court's order came on petitions by BJP councillors Kamaljeet Sehrawat and Shikha Roy against the mayor's decision to order repoll for six MCD standing committee seats. "Writ petition is allowed. Impugned order is set aside. Returning officer is directed to declare the result forthwith," the court ordered. The high court had stayed the repoll on February 25. The Supreme Court on Monday sought the response of a firm to a plea filed by consumer goods company Zydus Wellness challenging an order of the Delhi high court which held that it cannot use the brand name "SugarLite" for its products. A vacation bench of Justices J K Maheshwari and P S Narasimha issued notice to the firm named Delhi Marketing and sought its reply within three weeks. The top court was hearing an appeal filed by Zydus Wellness against the May 12 order of the high court which restrained it from using the brand name "SugarLite" as Delhi Marketing held the rights to use the brand name "SUGARLITE". The firm alleged that Zydus was using a deceptively similar trademark to confuse the customers and sought directions to restrain the company that manufactures nutrition and skin care products from using the SugarLite' brand name. PIL in HC against permission to exchange of Rs 2000 note without id proof

A public interest litigation was filed in the Delhi High Court on Monday against permission to exchange Rs 2000 banknotes without obtaining any requisition slip and identity proof. Lawyer Ashwini Kumar Upadhyay contended in his plea that notifications by RBI and SBI in this regard are arbitrary, irrational and offend Articles 14 of the Constitution of India. The petition said that a large amount of the currency has reached either in individual's locker or has been hoarded by the separatists, terrorists, Maoists, drug smugglers, mining mafias & corrupt people. Delhi HC summons BBC in defamation suit for documentary on PM Modi

The Delhi High Court on Monday issued summons to the British Broadcasting Corporation (BBC) on a defamation suit filed by an NGO claiming that its documentary cast a slur on the reputation of India, its judiciary and Prime Minister Narendra Modi. Besides the BBC (UK), Justice Sachin Datta also issued notice to the BBC (India) seeking its response on the suit filed by Gujarat-based NGO Justice for Trial. The plea said BBC (India) is the local operation office and BBC (UK) has released the documentary -- "India: The Modi Question" -- which has two episodes. Senior advocate Harish Salve, appearing for the NGO, said the suit for defamation against the BBC is in relation to the documentary which has "defamed" India and the whole system including the judiciary. The Delhi High Court has said the appellate tribunal under the senior citizens welfare law should make all efforts to ensure that the provision mandating its to decide matters within one month is implemented in its true spirit to the extent it is practical. The Delhi High Court has constituted a five-member committee for the implementation of the National Rare Disease Policy-2021, including procurement and "indigenisation" of therapies and drugs for patients who are mostly children. The Delhi High Court has sought response of the NHAI and the Centre on a plea seeking to direct banks to pay interest to the authorities on the money collected by them with the issue of FASTag and minimum balance requirement on the card. A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad issued notices to the National Highways Authority of India (NHAI) and the Ministry of Road Transport and Highways (MoRT&H) on an application which pleads that with the issuing of FASTag, thousands of crores of rupees have entered the banking system without any corresponding benefit either to the commuter community or to NHAI or MoRT&H. Delhi Police reply sought on Umar Khalid's plea for bail in UAPA case

The Supreme Court on Thursday sought a response of the Delhi Police on a plea of former JNU student Umar Khalid seeking bail in a UAPA case related to the alleged conspiracy behind the riots here in February 2020. A bench of Justices AS Bopanna and Hima Kohli issued notice to the Delhi government and sought its response in six weeks. Senior advocate Kapil Sibal, appearing for Khalid, pointed out to some dates and said that on the date of incident he was not there. The bench said it is issuing notice and granted liberty to seek listing of the matter vacation bench. Sibal said that the matter be listed after the vacation. HC grants protection from coercive steps to Wankhede in Aryan Khan case

The Delhi High Court Wednesday granted protection from coercive action to former NCB officer Sameer Wankhede, booked by the CBI for allegedly demanding Rs 25 crore bribe to spare superstar Shah Rukh Khan's son in a drugs case, his lawyer said. Advocate Shubhi Srivastava, who filed the petition on behalf of the former Narcotics Control Bureau (NCB) officer, said Justice Vikas Mahajan granted the protection from coercive steps for five days with the liberty to approach the appropriate forum, which would be the Bombay High Court.
