Nitish Katara murder: SC questions Vikas Yadav's plea on award of sentence

Vikas Yadav, undergoing 25-year jail term for killing business executive Nitish Katara in 2002, moved the Supreme Court Monday challenging a Constitution Bench verdict which held that courts can specify the length jail of term for murder convicts. The move prompted the top court to ask Yadav whether he can challenge through a fresh plea the validity of a verdict which has already attained finality. On October 3, 2016 the Supreme Court had awarded 25-year jail term without any benefit of remission to Yadav and his cousin Vishal for their role in the sensational kidnapping and killing of Katara. Another co-convict Sukhdev Pehalwan was also handed down 20- year jail term. A bench headed by Chief Justice Rajan Gogoi and Justice Sanjiv Khanna was hearing the fresh plea by Yadav alleging that "no special category of sentence in substitution to the life sentence or the death penalty could be imposed upon the persons guilty of offence of murder under section 302 of the IPC". Bombay HC pulls up BJP corporator over illegal hoardings

A BJP corporator on Monday drew the ire of the Bombay High Court over violations of its previous orders prohibiting political parties and their members from putting up illegal hoardings. A bench of justices AS Oka and AS Gadkari directed corporator Murji Patel to file a reply by March 12 as to why contempt proceedings must not be initiated against him for the violation. Patel, a BJP corporator from K-East ward in Andheri, is facing contempt proceedings following a plea filed in HC last year by the Brihanmumbai Municipal Corporation (BMC). As per the BMC's plea, during a drive conducted by its officials against illegal hoardings, Patel intervened, obstructed and assaulted its licence inspector and members of the civic squad engaged in removing such hoardings. Many of these hoardings had been put up by a local organisation chaired by Patel, the BMC plea stated. Chouhan leads BJP protest march in Satna over killing of twins

The BJP Monday took out a silent march in the Satna city of Madhya Pradesh to protest the kidnapping and killing of two twin brothers, and demanded the death sentence for the culprits besides action against those guilty of inept investigation into the case. The march in Satna, around 375km from Bhopal, was led by senior BJP leader and former chief minister Shivraj Singh Chouhan. The main opposition party also staged protests in other parts of the state, including Bhopal, over the shocking abduction-killing of the six-year-old twins, whose father is an oil businessman, and criticised the Congress government. Sunanda death case: Delhi court allows Tharoor to travel to Saudi Arabia

A Delhi court Monday allowed Congress leader Shashi Tharoor, accused in a case related to death of his wife Sunanda Pushkar, to travel to Saudi Arabia from February 28 to March 4 for attending a seminar. Special CBI Judge Arun Bhardwaj permitted Tharoor noting that he was given permission to travel abroad earlier and had abided by the terms and conditions of the court. It also noted that another court had already given him permission to travel to UAE, Qatar and Bahrain. "Considering the fact that earlier the applicant/ accused was given permission to travel abroad and he has abided by the terms and conditions of the court, now the applicant/accused is further permitted to visit Saudi Arabia from February 28 to March 4 in addition to permission already granted to him to travel to UAE, Qatar and Bahrain," the court said. Shelter home assault: Court raps CBI for delay in notifying SPP, says laxity will amount to contempt

A Delhi court Monday rapped the CBI for delay in notifying special public prosecutor in the Muzaffarpur shelter home sexual assault case and directed the agency to appoint a lawyer within two days. Additional Sessions Judge Saurabh Kulshreshtha pulled up the probe agency after senior public prosecutor R N Singh informed the court that he had not been notified as the SPP in the case and the process may take a couple of more days. "I want the notification day after tomorrow. If you cannot, just inform the Supreme Court. I am sending a copy of this order to the CBI director as well. All party peace meeting called by Kasaragod collector

An all party peace meeting will be held here Tuesday against the backdrop of the killings of two youth congress workers at nearby Kalliyot last week, officials said Monday. The meeting will be held at the collectorate at 2 pm, district collector Dr Sajith Babu said in a statement here. Revenue minister E Chandrasekharan, who hails from Kasaragod, will preside. The two workers, in their early twenties, were hacked to death on February 17. Police arrest a 27-year old man for allegedly raping minor

A 27-year-old man was arrested for allegedly raping a minor after promising to marry her in northeast Delhi, police said Monday. Police said, the victim - a resident of Loni - filed a case on October 17 last year. The victim said she had a relationship with a person named Shakeel, a resident of Bhagirathi Vihar. She alleged Shakeel had raped her multiple times after promising to marry her, police said. A case under the relevant sections of the IPC and The Protection of Children from Sexual Offences Act (POCSO) was registered. Raids were conducted but the accused had been absconding, Atul Kumar Thakur, Deputy Commissioner of Police (Northeast), said. The accused was arrested on Sunday. California news crew robbed, guard shot; suspect arrested

Authorities arrested a man suspected of shooting the security guard of a news crew that was robbed while covering the Oakland teachers strike, according to a statement by the CBS affiliate. KPIX said a reporter and a photographer were gathering interviews before 5 p.m. Sunday about the strike at the Oakland Library when a car pulled up and the driver pulled a gun, demanding their camera. The crew surrendered the equipment and began walking away. The suspect then shot the guard, Matt Meredith, in the leg, the news station said. KPIX reporter Joe Vazquez said on Twitter that the guard, a retired Berkeley police officer, exchanged gunfire. MP cable TV firm owner held in U'khand for partner's killing

The main accused in the murder of a businessman in Indore over a Rs 19 crore dispute in a cable TV firm has been arrested in Uttarakhand capital Dehradun, police said Monday. Businessman Sandeep Agarwal (42) was shot dead in Vijay Nagar area of Indore on January 16 this year. Speaking to reporters Monday, Senior Superintendent of Police (SSP) Ruchi Vardhan Mishra said main accused Rohit Sethi was held by Uttarakhand police with 112 grams of charas (hashish/cannabis) from a park in the northern state's capital. SC issues notice to Meghalaya HC Registry on Judge's controversial remarks

The Supreme Court Monday sought response of the Meghalaya High Court Registry on a plea seeking expunction of controversial remarks by Justice Sudip Ranjan Sen that India should have been declared a Hindu country at the time of partition in 1947. A bench comprising Chief Justice Ranjan Gogoi and Justices Sanjiv Khanna issued notice to the high court registrar on the plea filed by Sona Khan and others. The plea contended that the judgment authored by Meghalaya High Court judge Justice Sen is "legally flawed and historically misleading". The apex court had earlier refused to consider the prayer that the judicial work from Justice Sen be withdrawn and had rather asked the petitioner to amend her plea by seeking expunction of alleged controversial remarks in the judgment. A Delhi court Monday granted bail to journalist Priya Ramani, summoned as an accused in a defamation case filed by former Union minister M J Akbar after she levelled allegations of sexual misconduct against him when he was a scribe. Additional Chief Metropolitan Magistrate Samar Vishal granted her bail on a personal bond of Rs 10,000, with a surety of a like amount. Agra woman gang-raped in Greater Noida, 2 held

A woman from Agra was allegedly raped inside an apartment in Greater Noida by two men after she was brought there on the pretext of getting her a job, police said on Monday. The incident took place on Sunday at the apartment in Sector Tau, under Kasna police station limits, and the accused have been arrested, they said. "The woman, in her early 30s, is from Agra. She was brought to the residence of one of the accused by the other accused, who was already known to her and hails from Agra only," a police official said. Maha: 5 booked for raping woman during 13-day captivity

Five persons have been booked in Maharashtra's Palghar district for kidnapping a newly-married woman, holding her captive for almost two weeks and repeatedly raping her, police said Monday. An official said the 21-year-old victim's ordeal began on February 6 when a man posing as a policeman came to her house in Pragati Nagar in Nalasopara and asked her to accompany him to the police station.
