SC dismisses Vedanta's plea against closure of copper plant in Thoothukudi

The Supreme Court on Thursday dismissed a Vedanta group's plea against the closure of its copper smelting plant in Tamil Nadu's Thoothukudi. The plant has been closed since May 2018 after 13 people were killed as police opened fire to quell a protest over alleged pollution caused by it. A bench headed by Chief Justice D Y Chandrachud said the health and welfare of residents of the area is a matter of "utmost concern" and the state government is responsible for preserving and protecting their concerns. " we have come to the conclusion that the Special Leave Petition (SLP) by the industrial unit shall not warrant interference under Article 136 of the Constitution. For the above reasons, the SLP shall stands dismissed," the bench, also comprising justices J B Pardiwala and Manoj Misra, said. The Madras High Court had in August 2020 rejected Vedanta's plea for allowing reopening of its Sterlite Copper unit.

SC to hear plea seeking release of detained Rohingya refugees in March

The Supreme Court on Thursday agreed to hear in March a plea seeking direction to the government to release Rohingya refugees who have been "illegally and arbitrarily" detained in jails and detention centres across the country. A bench of Justice B R Gavai and Justice Sandeep Mehta agreed to list the plea after advocate Prashant Bhushan mentioned the matter, saying the case has not been posted for hearing. Bhushan submitted that despite the issuance of notice to the Centre, the Union of India has not filed its reply till date. He told the top court that the matter needs an urgent hearing as many Rohingya refugees have been languishing in different parts of the country. The apex court said it will post the matter in March. The top court on October 10 last year issued notice to the Centre and sought its response within four weeks. There can't be automatic vacation of stay orders of courts: Supreme court

The Supreme Court on Thursday held that there cannot be an automatic vacation of stay orders granted by a lower court or high court in civil and criminal cases after six months. A five-judge Constitution Bench headed by Chief Justice D Y Chandrachud did not agree with its 2018 judgement which had held that there should be automatic vacation of stay orders of the courts below unless they are extended specifically. Laying down guidelines, the judgement also said the constitutional courts, the Supreme Court and the high courts should refrain from fixing a timeline for disposal of cases and it can be done only in exceptional circumstances. The bench pronounced two separate but concurring judgements. "The constitutional courts should not lay down a timeline to decide cases since grassroot issues are known to concerned courts only and such orders can be passed in exceptional circumstances only," said Justice A S Oka. The state machinery should help the Enforcement Directorate in finding out if an offence has been committed as there is no harm in it, the Supreme Court told the Tamil Nadu government on Monday. The apex court had last week questioned the Tamil Nadu government for filing a plea in the Madras High Court against the ED for its probe in a money laundering case. The central probe agency had summoned the district collectors of Vellore, Tiruchirappalli, Karur, Thanjavur and Ariyalur in connection with its probe in a money laundering case related to alleged illegal sand mining. The state government along with the bureaucrats had moved the high court that stayed the summons issued by the ED. The probe agency has moved the top court against the high court order. The ED's plea came up for hearing on Monday before a bench of justices Bela M Trivedi and Pankaj Mithal.
