The Supreme Court on Monday questioned the delay on the part of Tamil Nadu Governor R N Ravi in granting assent to several Bills passed by the state Assembly, asking as to why should governors wait for parties to move the top court with their grievances. Posing tough questions, a bench headed by Chief Justice D Y Chandrachud asked what was the governor doing for three years, noting that the Bills were pending since January 2020. Observing that the issue was whether there was a delay in the discharge of the constitutional functions entrusted to the office of the governors, the court also said it would deal with the question whether a governor can sit over the Bills without sending them either back to the Assembly or to the President. The top court made the observations as it deferred the hearing on the Tamil Nadu government's plea alleging delay by Governor Ravi to December 1 after Attorney General R Venkataramani, appearing for the Office of the Governor, sought a postponement. "You are playing with fire," the Supreme Court told the Punjab governor on Friday, as it held that being the titular head of the state he cannot cast doubt on the validity of an assembly session or withhold his decision indefinitely on bills passed by the House. It said under Article 200 of the Constitution, when a bill is presented to the governor, he shall declare either that he assents to the bill or that he withholds assent therefrom or that he reserves the bill for the consideration of the President. The top court, which pulled up the Punjab governor for "indefinitely sitting over" bills passed by the assembly saying "You are playing with fire", also questioned the state government for repeatedly adjourning the Budget session sine die instead of proroguing it. It, however, upheld the Speaker's supremacy in conducting the business of the House or adjourning its sessions. Amid increasing confrontation between governors and chief ministers in non-BJP ruled states, Goa Governor P S Sreedharan Pillai has suggested that both sides should respect their Lakshmana rekha' to avoid any conflict. There is a Lakshmana rekha within which each pillar of democracy should function. Once that line is crossed, the Constitution does not have any remedy for that, Pillai said.
