Delhi court reserves order on Subramanian Swamy's plea to be part of Sunanda Pushkar death trial

Special Court Judge Arun Bhardwaj reserved the order on Swamy's application seeking to be part of Pushkar trial in terms of Section 301 of the Code of Criminal Procedure (CrPC), 1973 after hearing arguments from Swamy, Vikas Pahwa, the counsel of Shashi Tharoor, and the counsel of Delhi Police.Asserting locus standi in the matter, Swamy argued that the court has to look at the material and not whether the person is a politician.Pahwa opposed the application of Swamy arguing that the BJP leader should be treated as a stranger in the case as he is neither the complainant nor the victim."Swamy does not have any locus in the case," Pahwa told the court. Sunanda Pushkar death case: Court reserves order for May 13 on Swamy's plea

A Delhi court on Saturday reserved its order for May 13 on Subramanian Swamy's plea seeking to be part of the trial in the death of Sunanda Pushkar, wife of Congress MP Shashi Tharoor. Special judge Arun Bhardwaj passed the order after hearing all the parties. Swamy's plea has also sought to bring on record the Delhi Police's vigilance report on tampering of evidence in the case and claimed that it might lead to framing of additional charges. Pushkar was found dead in a suite of a luxury hotel in the city on the night of January 17, 2014. The couple were staying in the hotel as the official bungalow of Tharoor was being renovated at that time. The former Union minister has been charged under sections 498-A (husband or his relative subjecting a woman to cruelty) and 306 (abetment of suicide) of the IPC.

SIMI ban: 2-day tribunal hearing concludes in Pune

A tribunal headed by a Delhi High Court judge conducted a two-day hearing here to ascertain whether there was sufficient cause to extend the ban on the Students Islamic Movement of India (SIMI) as an unlawful association. The tribunal, presided by Justice Mukta Gupta of the Delhi High Court, began its hearing on Friday in Pune and it concluded on Saturday. Founded in 1977, SIMI was banned in 2001. The tribunal, under the Unlawful Activities (Prevention) Act, 1967, was constituted by a notification of the Ministry of Home Affairs (MHA) on February 21 this year after the five-year ban on SIMI ended on January 31. Officials from the Maharashtra Police's Crime Investigation Department, the state Anti-Terrorism Squad and State Intelligence Department deposed before the Unlawful Activities Tribunal, to justify the ban on SIMI. Police filing 'designed FIRs' in prohibition cases: Guj HC

The Gujarat High Court has pulled up the state police, saying it has become a "custom" for the force to file "designed FIRs" in prohibition cases where the accused are shown as having escaped before raids were conducted even when the cops have prior information regarding the movement of liquor, including the exact location and vehicles used for the act. In its order Friday, in connection with a case dealing with regular bail plea of an accused in a prohibition case, Justice S M Vora said the state government has created no mechanism to monitor "designed FIRs", a year after the court had asked whether it plans to create an "in-house mechanism" to deal with such cases. The court also asked the state government to furnish information on all such FIRs registered under the provisions of the Gujarat Prohibition Act from May 1, 2018 to May 1, 2019, including the name of the accused escaping and police involved in the raids, to be submitted on or before July 11. Man held for sodomising boy

A man was Saturday arrested for allegedly sodomising a nine-year-old boy living in his neighbourhood at Kolegaon in Dombivli in the district, police said. The accused, Dinesh Lawhari (36), was booked by Manpada police for the incident that took place last Sunday at at his house. Lawhari, who works as a housekeeper, was booked under IPC sections 377 (unnatural offences), 342 (wrongful confinement), 323 (voluntarily causing hurt), 506 (criminal intimidation) and sections of the Protection of Children from Sexual Offences (POCSO) Act, police said. A complaint against the accused had been lodged by the minor's parents on Friday.

Man gets 10 years of rigourous imprisonment for raping 13-yr-old girl

The Thane district court in Maharashtra has sentenced a man to 10 years of rigorous imprisonment for raping a 13-year-old girl. Judge S A Sinha also imposed a fine of Rs 5,000 on the 42-year-old man (name not disclosed), a resident of Uttan in the district, after convicting him under Section 376 (rape) of the IPC on Friday. The victim and the convict, who worked as a security guard, were neighbours, said Public Prosecutor Ujjwala Moholkar Saturday. On August 27, 2018, the victim and her younger brother had gone to the convict's residence to play with his cat, she said. The convict sent the boy outside to purchase something and raped the girl. After the girl narrated the incident to her grandmother, a complaint was lodged against the convict at the Uttan Sagari (Marine) police station, Moholkar said. The judge relied on the victim's testimony as well as on the medical evidence, the prosecutor added.

CBI court grants bail to businessman Gautam Khaitan's wife Ritu in money laundering case

A Special CBI court on Saturday granted bail to Ritu Khaitan, wife of lawyer-cum-businessman Gautam Khaitan in connection with a money laundering case.Special CBI Judge Arvind Kumar while granting regular bail to Ritu directed her to furnish a personal bail bond of Rs. 25 lakhs and two sureties of like amount and posted the matter for hearing on August 7.Enforcement Directorate through its counsel opposed the Ritu's bail plea. Rajasthan officials held with unaccounted cash of Rs 10.67 lakh

Sleuths of the anti-corruption bureau (ACB) here recovered unaccounted cash of Rs 10.67 lakh from two officials posted with the Water Resources Department in Atru of Baran district in Rajasthan, police said Saturday. The amount was recovered during a checking on the BaranKota highway near Nohar Thursday night, police said. "The two officials have not been arrested or booked for corruption as investigation is underway," police maintained. According to ASP (ACB) Chandrasheel Thakur, they had got a tip-off that assistant engineer Mohan Lal Sharma had collected a huge amount as commission from contractors and was returning to Kota by a government vehicle. "The ACB sleuths stopped the government vehicle, in which Mohan Lal Sharma and executive engineer Satyendra Kumar Pareek were travelling along with another official of the department," the officer said.
