Substantial material against Kolkata Police Commissioner, CBI tells SC

CBI Monday alleged in the Supreme Court that it has found "substantial material" against Kolkata Police Commissioner Rajeev Kumar in connection with the Saradha chit fund scam case but he was not cooperating in the investigation and ignoring the summons. Narrated the sequence of events of Sunday evening in which its sleuths were rounded up by the West Bengal police, CBI said it was seeking a direction for Kumar to immediately surrender and make himself available before it for investigation into the scam. CBI said Chief Minister Mamta Banerjee along with the DGP, additional commissioner of police sat on dharna or sit-in at around 10 pm Sunday in Kolkata and as such a conduct by the officials in uniform points to "complete anarchy prevailing in Kolkata and West Bengal". CBI vs CBI: Alleged middleman refuses lie detector test before Delhi court

Manoj Prasad, an alleged middleman arrested in connection with a bribery case against CBI's Special Director Rakesh Asthana, on Monday refused to undergo a lie detector test after the CBI filed a plea in a Delhi court in this regard. Chief Metropolitan Magistrate Deepak Sehrawat was hearing the CBI's application seeking permission to conduct lie detector test and taking voice sample of Prasad and the complainant, Hyderabad-based businessman Satish Sana. Prasad's brother Somesh and senior advocate Sunil Mittal, other accused in the case, have given their consent for the test. Prasad's counsel and senior advocate Vikas Pahwa submitted that the report of the test was not admissible as evidence and the accused should not be directed to undergo it as the CBI is not confident of the complaint. Ponzi scam: CBI sent 20 notices in 2017-18 for questioning SIT members

The CBI sent as many as 20 notices for examination members of a Special Investigation Team, including Kolkata Police commissioner Rajeev Kumar, before knocking on his doors on Sunday evening which spiralled into an unprecedented tussle between the two agencies, officials said Monday. The 20 notices were sent by the Central Bureau of Investigation (CBI) between September 2017 and December 2018. The CBI was handed over the probe by the Supreme Court in 2014 but the agency was allegedly finding it difficult to get all the documents and evidence collected by the special investigation team of West Bengal, which had initiated the probe against the Saradha Group, an official said. Delhi bizman robbed of Rs 28 lakh in Ghaziabad

A businessman from outer Delhi's Nazafgarh was robbed of Rs 28 lakh in Ghaziabad's Sahibabad after a dealer allegedly lured him into a trap by offering a low-price property, police said Monday. The incident took place in Sahibabad's Rajendra Nagar last Saturday, they said, adding that the businessman had come there to make an advance payment to the property dealer. S P (City) Shlok Kumar said that Omprakash, a resident of Dharmapura in Nazafgarh, had arrived here to pay Rs 28 lakh as token money. The broker, Ram, had promised to manage a low-price property for him in Delhi for which advance money was to be paid to the owner in Sahibabad. Sukna scam:SC sets aside sacking order against ex-military Secy, says GCM proceedings vitiated

In a major relief to former military secretary Avadhesh Prakash, the Supreme Court has set aside the General Court Martial (GCM) order dismissing him from service for alleged involvement in the 2008 Sukna land scam in West Bengal, terming its proceedings as "vitiated". The top court held that the GCM was not "validly constituted" in Prakash's case as it consisted of members below his rank of Lieutenant General, and refused to remit back the case to the authorities for fresh GCM which is done in "normal course". A bench of justices A K Sikri, S Abdul Nazeer and M R Shah also set aside the December 2017 order of Armed Forces Tribunal (AFT) holding him guilty of charge of "unbecoming conduct" with a punishment that he need not be given arrears of pension from the date of dismissal of service till the date of passing of order. CBI files contempt plea in SC against WB chief secretary, DGP and Police Commissioner

Turkish national dies while attending to machine repair

A 43-year-old man from Turkey died Monday after getting stuck in a hydraulic machine while trying to repair it at a door and frame manufacturing firm near here, police said. The incident occurred at Choutuppal around 11.45 am when P Uysal Hrun, a technician, got "accidentally" squeezed into the machine and suffered injuries, police said. He succumbed to his injuries in hospital, a senior police official said. A case under IPC section 304 A (causing death by negligence) has been registered.

Another person arrested in BJD leader murder case

Police Monday arrested another person for his alleged involvement in the murder of a young BJD leader at Chhatrapur in Odisha's Ganjam district, a police officer said. The accused identified as Subrat Patnaik (18) alias Lucky of Pandiripada, was arrested for his alleged involvement in the murder of Laxmidutta Pradhan, a BJD councillor in Chhatrapur NAC on September 17, 2017. With Patnaik's arrest the total number of persons arrested in the sensational murder of the BJD leader increased to 19. This included two BJP leaders. Patnaik was absconding after the muder. Police arrested him acting on a tip off, said Sub-Divisional Police Officer (SDPO), Chhatrapur, Ramesh Chandra Sethi. BJPs Ganjam district unit secretary Krushna Chandra Nayak and Laxmipur panchayat samiti member N.Duryodhan Reddy were arrested by the police from Derhadun on October 2017 for their alleged involvement in the case. Attorney General files contempt petition against advocate Prashant Bhushan

Attorney General K K Venugopal Monday filed a contempt petition in the Supreme Court against activist lawyer Prashant Bhushan for allegedly scandalising the court with his recent tweets on the appointment of former interim chief of CBI M Nageswara Rao. The contempt petition refers to the February 1 tweets by Bhushan in which he allegedly said that the government appeared to have misled the apex court and perhaps submitted fabricated minutes of the meeting of the high-powered Selection Committee headed by the Prime Minister. Venugopal, in his petition, said Bhushan had deliberately intended to cast aspersions on the integrity and honesty of the Attorney General who had placed the minutes of the meeting before the apex court during the February 1 hearing.

HC awards Rs 3.85 cr damages to UK firm for trademark infringement

The Delhi High Court has awarded 3.85 crore to UK-based Whatman International Ltd in damages for its trademark infringement by various persons here who were selling infringed products. The court said the conduct of defendants was wrong and they have committed infringement of the company's mark and impinged on its rights deliberately, consciously and wilfully for over 25 years. "Repeated legal action has not deterred them. They showed no remorse in the statements recorded.... The present is a case for award of aggravated, punitive damages," Justice Prathiba M Singh said. The court directed them to pay the amount to the company within three months. It also also held them guilty of contempt of court order and listed the matter for March 5 for hearing arguments on the point of punishment to be awarded to them. Four get 10 years in jail for abducting, raping minor girl in UP

A local court Monday sentenced four men to 10 years in jail for abducting and raping a minor girl in the district in 2009. Additional District Sessions judge Ajay Kumar also imposed a fine of Rs 70,000 each on Sanju, Dushyant, Kallu and Sachin for abducting and raping the 15-year-old girl after finding them guilty under relevant sections of the Indian Penal Code. The court said Rs 1 lakh from the cumulative fine would be given to the victim. According to government lawyer Anjum Khan, the minor was abducted from the fields and raped in district's Biralsi village on May 30, 2009.

HC says section 481 of TN prison rules unconstitutional

The Madras High Court Friday held Rule 481 of the Tamil Nadu Prison Rules unconstitutional as it stated 50 per cent of wages earned by prisoners shall be deducted for their upkeep. Partly allowing a PIL, a division bench of the court's Madurai bench, comprising Justices K K Sasidharan and G R Swaminathan, said admittedly the prisoners were not paid the wages as prescribed in the Minimum Wages Act. Therefore making substantial deduction from the wages prescribed violated the constitution and hence unreasonable, the bench said. The judges, however, said it was open to the government to provide for a lesser and reasonable percentage of deduction which would be in accordance with the law laid down by the Supreme Court. The judges said making a substantial deduction from the wages prescribed under prison rules ran counter to the direction laid down by the apex court. Delhi: Man sets himself ablaze after tiff with girlfriend

Upset over a tiff with his girlfriend, a 25-year-old man allegedly set himself ablaze in an auto rickshaw, injuring two of his co-passengers, in northeast Delhi's Jyoti Nagar area, police said on Monday. The man was identified as Shivam, a resident of Loni, Ghaziabad. His co-passengers, his cousin Arjun (24) and one Bhagwan Singh (60), also sustained burns, they said. The incident took place on Sunday night at around 9 pm, the police said. Officials of Jyoti Nagar police station rushed to Loni Gol Chakkar after receiving information about a person burning, a senior police officer said. On reaching the spot, they found three persons had sustained burns. All of them were rushed to Guru Tegh Bahadur Hospital for treatment, Deputy Commissioner of Police (Northeast) Atul Thakur said. The court of Chief Judicial Magistrate Chetan Sharma extended the police remand after hearing arguments of both the prosecution and the defence. Sharma's eight-day police remand was expiring on Monday. He was arrested in a case related to the killing of two youths in alleged police firing on anti-sacrilege protesters in 2015 in Behbal Kalan of Punjab's Faridkot district. Man held for misappropriating gold jewellery using fake bills

: A 29-year-old man employed at a city-based jewellery firm was arrested for allegedly misappropriating its gold and diamond jewellery, police said Monday. G Vivek, a sales executive, misappropriated gold and diamond jewellery weighing about 4 kg by submitting fake bills as if it was delivered to different shops and showrooms, police said based on a complaint lodged by the firm's owner. He allegedly mortgaged 1 kg gold with a Finance firm and got other gold ornaments melted and kept the diamonds with him at his house for later disposal, a police release said. Three kg gold ornaments worth Rs 1 crore were seized from him, police added.

Man arrested in Katihar for obscene tweet about Priyanka Vadra

Days after an obscene tweet with a morphed picture of Congress leader Priyanka Gandhi Vadra was posted on the social media platform, police said on Monday the accused person has been arrested and sent to jail. Yogi Surajnath, a resident of this north Bihar town who describes himself as a 'bhakt' (devotee) of Prime Minister Narendra Modi on the social media, was arrested from his residence in Binodpur locality, Town police station SHO Ranjan Kumar said. While Surajnath is said to be an avid follower of the 'BJP's Mission 2019' on Twitter, BJP's district president Manoj Rai asserted this person has no association with the party. INX Media case: Chidambaram moves HC to place add'l documents on record in anticipatory bail plea

Congress leader P Chidambaram approached the Delhi High Court Monday seeking to place some additional documents on record in his pending anticipatory bail plea in the INX Media case lodged by the CBI.
