The bench, which granted bail to Kanojia, said fundamental ...
The prosecution's failure to verify accused Vishal Jangotra's alibi during the probe in the Kathua rape and murder case led to his acquittal, the special court said as it blamed the Jammu Crime Branch for withholding the best evidence against him. Jangotra was the only one among the seven accused to be acquitted by the court. Three, including his father Sanji Ram who was the key conspirator, were given life sentences. The court also raised the issue of the prosecution failing to question Inspector Kewal Kishore who had done most of the investigation regarding Jangotra's alleged role in the crime. "Almost all investigating officers had deposed ...
Observing that right to liberty is sacrosanct and "non-negotiable", the Supreme Court Tuesday ordered that journalist Prashant Kanojia, arrested for allegedly sharing objectionable posts on Uttar Pradesh Chief Minister Yogi Adityanath, be immediately released on bail. Making it clear that granting bail to Kanojia cannot be construed as approval of the posts or tweets, the court also slammed the UP government for the "excessiveness" of its action and questioned his nearly two-week judicial custody, asking, "Is this a case of murder?" Asserting fundamental right guaranteed under the Constitution cannot be infringed upon by the state and that it was not inclined to sit back on technical grounds to deny justice, the court, however, said proceedings against the journalist will go on as per law. A vacation bench of Justices Indira Banerjee and Ajay Rastogi gave the order while hearing a habeas corpus petition (a writ for producing a person who is under arrest or in unlawful detention before

Controversial Islamic preacher Zakir Naik, booked by the Enforcement Directorate for money laundering, Tuesday claimed investigating agencies were "desperately" trying to get "something to stick on him" on the instructions of their "political bosses". Naik levelled the allegation in response to the ED trying to get a Red Corner Notice issued against him. In a statement issued here, Naik asked "why are the Indian agencies getting so desperate? Desperate to comply with the instructions of their political bosses?" "It surely cannot be a desperation to serve justice because theyre not sure of the charges themselves. But this desperation is shameful, and it shows in the way they keep shifting focus from one angle to another, from terror to money laundering, just to make something stick on me," his statement added. "If the Supreme Court of India gives me in writing that I will not be arrested and jailed until I am convicted, I will return to India, and I will return today," he
Even judges have to face the brunt of social media, the Supreme Court said Tuesday while hearing the case of journalist Prashant Kanojia, arrested for allegedly making objectionable comments on Twitter and Facebook against Uttar Pradesh Chief Minister Yogi Adityanath. "Sometimes even we have to suffer the brunt of social media. Sometimes it is just and sometimes it is unjust but we have to exercise our powers," a vacation bench of Justices Indira Banerjee and Ajay Rastogi said while ordering immediate release of the scribe on bail. "Show your magnanimity," the bench told Additional Solicitor General (ASG) Vikramjit Banerjee who was appearing for the Uttar Pradesh government, adding that "the question is only about deprivation of citizen's liberty". Kanojia had

Veteran lyricist-writer Javed Akhtar has said while he understands the disappointment with the verdict in the rape and murder case of an eight-year-old girl in Jammu and Kashmir's Kathua, he believes capital punishment is not a deterrent to crime. Akhtar admitted that he did not have "clear cut" ideas about the merits and demerits of capital punishment. "I have heard that some people are disappointed with the verdict because they thought these people deserved capital punishment. I, in all honesty, must accept that I don't know have very clear cut ideas about capital punishment - whether it's right or wrong... "One thing I am sure about is that capital punishment is not a deterrent of crime because where they have banned capital punishment, crime hasn't increased, and where they have kept it, crime hasn't reduced. So, I have no idea that whether they should have been given capital punishment or a life term is good enough. I am not sure," Akhtar said at a book launch here on Monday when
