Court should take liberal view on delayed appeals of convicts in custody: HC

Courts should take a liberal approach when appeals against convictions are filed with some delay by those in custody, the Delhi High Court has said. The high court said delay does not work to the advantage of an incarcerated person and people who are in custody do not have the advantage of approaching a counsel and taking legal advice at their own free will, which a free person has. "Courts cannot adopt a hyper technical approach, while considering an application seeking condonation of delay filed against conviction by a person in custody," Justice Sanjeev Sachdeva said. The court's order came while setting aside a sessions judge's order, which had dismissed a man's appeal in a robbery case solely on the ground that it was filed after a delay of 220 days. It condoned the delay and restored the appeal to the court of an additional sessions judge and said the matter be listed before the trial court in July. The high court noted the man had filed an appeal after he had surrendered before

Judgement reserved in Pell appeal against child sex conviction

The fate of jailed Australian Cardinal George Pell was in the balance Thursday as judges adjourned to deliberate over an appeal against his conviction on historical child sex abuse charges. The three judges in Victoria state's Supreme Court heard two days of arguments by Pell's lawyers demanding his December conviction be quashed, while prosecutors insisted the jury verdict against the one-time top Vatican official was "unimpeachable". The judges can decide to reject the appeal, order a retrial or acquit Pell, the Catholic Church's most senior convicted child molester. There was no indication of when their ruling would be handed down. Lawyers for Pell, who turns 78 on Saturday, raised 13 objections to his conviction on five counts of sexual abuse for the assault of two 13-year-old choirboys following Sunday Mass in the 1990s. Their appeal maintains that the case against Pell was unreasonably dependent on the testimony of a single victim -- the second choirboy died in 2014 -- and fell .
