SC asks Maha speaker to decide plea for disqualification of MLAs by Jan 10

The Supreme Court on Friday extended the deadline for Maharashtra Legislative Assembly Speaker Rahul Narwekar to decide the cross-petitions filed by the rival factions of the Shiv Sena seeking disqualification of each other's MLAs from December 31 to January 10 next year . The top court, which granted 10 more days to the speaker, had earlier asked him to decide the disqualification pleas by December 31, saying the sanctity of the 10th Schedule of the Constitution (disqualification law) should be maintained. "The speaker has indicated that the proceedings will be closed on December 20 and the speaker has sought a reasonable extension of time for declaration of the order. Bearing in mind the time limit, which was set out by this court in its previous order dated October 30, was until December 31. Over 5 cr cases pending in Indian courts, 80,000 of them in SC: Law Min

Over five crore cases are pending in various courts of the country, including 80,000 in the Supreme Court, the Lok Sabha was informed on Friday. In a written reply, Law Minister Arjun Ram Meghwal said as of December 1, out of the 5,08,85,856 pending cases, over 61 lakh were at the level of the 25 high courts. The district and subordinate courts accounted for over 4.46 crore cases, he said. The minister also noted that the overall sanctioned strength of the Indian judiciary was 26,568 judges. While the sanctioned strength of the top court is 34 judges, 1,114 is the sanctioned strength of the high courts. The district and subordinate courts have a sanctioned strength of 25,420 judges.

Manipur violence: SC asks state over steps taken to protect religious spots

The Supreme Court on Friday directed the Manipur government to apprise the apex court-appointed committee of the steps taken to secure places of public worship in the state where ethnic clashes have claimed more than 170 lives since May. A bench headed by Chief Justice D Y Chandrachud, while considering the issue of restoration of places of worship, said the state government shall furnish within two weeks to the panel a comprehensive list after identifying religious structures damaged during the strife. The bench, also comprising Justices J B Pardiwala and Manoj Misra, clarified the identification of such structures shall cover all religious faiths and denominations. "The government of Manipur shall apprise the committee of the steps which have been taken to secure the places of public worship," it said. SC defers hearing on Mahua Moitra's plea against expulsion till Jan 4

The Supreme Court on Friday deferred the hearing on a plea of Trinamool Congress leader Mahua Moitra challenging her expulsion from the Lok Sabha till January 3 next year. Moitra challenged her expulsion in the top court after the Lok Sabha adopted the report of its ethics committee that held her guilty of accepting gifts and illegal gratification from a businessman. As soon as the matter was taken up for hearing, a bench of Justices Sanjiv Khanna and SVN Bhatti told senior advocate Abhishek Singhvi, who was appearing for Moitra, that he had not gone through the case files and the bench would like to hear it upon reopening of the court after winter break, which ends on January 3. Net borrowing ceiling: Kerala moves SC alleging interference by Centre

The Kerala government has approached the Supreme Court accusing the Centre of interfering in exercise of its "exclusive, autonomous and plenary powers" to regulate the state's finances by imposing a ceiling on net borrowing. In an original suit filed under Article 131 of the Constitution, the Kerala government has said the Constitution bestows fiscal autonomy upon states to regulate their finances under various articles, and the borrowing limits or the extent of such borrowings are regulated by a state legislation. Article 131 of the Constitution deals with original jurisdiction of the apex court in any dispute between the Centre and states. The suit referred to the letters dated March 27 and August 11, 2023 issued by the Centre, through the Ministry of Finance (Public Finance-State Division), Department of Expenditure, and the amendments made to section 4 of the Fiscal Responsibility and Budget Management Act, 2003. RRTS project: SC grants a week's time to Delhi govt to transfer funds

The Supreme Court on Wednesday expressed its displeasure over the delay on the part of the Delhi government in providing funds for the Regional Rapid Transit System (RRTS) corridors and granted it a week's time to transfer the money. The RRTS project entails semi-high-speed rail corridors connecting Delhi to Meerut in Uttar Pradesh, Alwar in Rajasthan and Panipat in Haryana. India on Wednesday strongly rejected the comments by the Organisation of Islamic Cooperation (OIC) expressing concern over the Supreme Court's verdict upholding the 2019 revocation of Article 370 of the Constitution that gave special status to Jammu and Kashmir.
