The Supreme Court on Friday extended the deadline for Maharashtra Legislative Assembly Speaker Rahul Narwekar to decide the cross-petitions filed by the rival factions of the Shiv Sena seeking disqualification of each other's MLAs from December 31 to January 10 next year . The top court, which granted 10 more days to the speaker, had earlier asked him to decide the disqualification pleas by December 31, saying the sanctity of the 10th Schedule of the Constitution (disqualification law) should be maintained. "The speaker has indicated that the proceedings will be closed on December 20 and the speaker has sought a reasonable extension of time for declaration of the order. Bearing in mind the time limit, which was set out by this court in its previous order dated October 30, was until December 31. The Supreme Court on Friday deferred the hearing on a plea of Trinamool Congress leader Mahua Moitra challenging her expulsion from the Lok Sabha till January 3 next year. Moitra challenged her expulsion in the top court after the Lok Sabha adopted the report of its ethics committee that held her guilty of accepting gifts and illegal gratification from a businessman. As soon as the matter was taken up for hearing, a bench of Justices Sanjiv Khanna and SVN Bhatti told senior advocate Abhishek Singhvi, who was appearing for Moitra, that he had not gone through the case files and the bench would like to hear it upon reopening of the court after winter break, which ends on January 3. On December 8, after a heated debate in the Lok Sabha over the panel report -- Moitra was not allowed to speak --, Parliamentary Affairs Minister Pralhad Joshi moved a motion to expel the TMC MP from the House for "unethical conduct," which was adopted by a voice vote.

Kerala Chief Minister Pinarayi Vijayan on Thursday said his government has moved the Supreme Court against the Centre's allegedly "unconstitutional and illegal" measures that have pushed the southern state into dire straits financially. Vijayan contended that even though the state government repeatedly communicated to the Centre to stop its "discriminatory" actions, the Central government intensified its "vindictive moves" to make it difficult for Kerala to survive. "In this backdrop, the state government has approached the Supreme Court against the discriminatory measures of the Center which is throwing Kerala into dire straits by sacrificing the federal principles of the Constitution of India." he said at a press conference held here as part of the Nava Kerala Sadas, an outreach programme of the Left administration. The CM said the aim behind initiating the legal battle was to seek an order from the apex court under Article 131 of the Constitution which deals with settling ...

The Kerala government has approached the Supreme Court accusing the Centre of interfering in exercise of its "exclusive, autonomous and plenary powers" to regulate the state's finances by imposing a ceiling on net borrowing. In an original suit filed under Article 131 of the Constitution, the Kerala government has said the Constitution bestows fiscal autonomy upon states to regulate their finances under various articles, and the borrowing limits or the extent of such borrowings are regulated by a state legislation. Article 131 of the Constitution deals with original jurisdiction of the apex court in any dispute between the Centre and states. The suit referred to the letters dated March 27 and August 11, 2023 issued by the Centre, through the Ministry of Finance (Public Finance-State Division), Department of Expenditure, and the amendments made to section 4 of the Fiscal Responsibility and Budget Management Act, 2003. It alleged that the Centre "seeks to interfere with the finances

The Supreme Court on Wednesday expressed its displeasure over the delay on the part of the Delhi government in providing funds for the Regional Rapid Transit System (RRTS) corridors and granted it a week's time to transfer the money. The RRTS project entails semi-high-speed rail corridors connecting Delhi to Meerut in Uttar Pradesh, Alwar in Rajasthan and Panipat in Haryana. "You will make me reactivate my earlier order," Justice Sanjay Kishan Kaul, who was heading the bench that also comprised Justice Sudhanshu Dhulia, told the Delhi government counsel. The apex court had on November 21 pulled up the Delhi government for not providing funds for the project and said that funds allocated for advertisement purposes should be transferred to the project. Observing that farm fires were still significant, a bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia directed the state governments concerned to take steps to curb pollution. "Let us at least make an endeavour for the next winter to be little better," said the apex court, which was hearing a matter related to crippling air pollution that has been choking Delhi-NCR during winter year after year. The bench noted several meetings of the committee chaired by the Union cabinet secretary were held and it has prepared action plan for states, including Punjab and Haryana, to deal with the issue. It said the states concerned have to implement the action plans and submit progress reports before the court within two months. "We direct th
India on Wednesday strongly rejected the comments by the Organisation of Islamic Cooperation (OIC) expressing concern over the Supreme Court's verdict upholding the 2019 revocation of Article 370 of the Constitution that gave special status to Jammu and Kashmir. External Affairs Ministry spokesperson Arindam Bagchi said the OIC's action at the behest of a "serial violater of human rights and an unrepentant promoter of cross border terrorism" makes its action even more questionable. Though Bagchi did not name any country, it was clear that the reference was towards Pakistan. "India rejects the statement issued by the General Secretariat of the Organisation of Islamic Cooperation (OIC) on a judgement of the Indian Supreme Court. It is both ill informed and ill intended," Bagchi said. "That OIC does so at the behest of a serial violater of human rights and an unrepentant promoter of cross border terrorism makes its action even more questionable. Such statements only undermine OIC's ..
