Bihar Cricket Association cannot make amendments to its constitution: SC

The Supreme Court on Monday said the Bihar Cricket Association cannot amend its own constitution and directed it to file an affidavit explaining the mechanism it is following for its elections scheduled on September 25. A bench of justices D Y Chandrachud and Hima Kohli asked the cricket body to clarify if it has changed the constitution of electoral college for the purpose of elections. "You can certainly hold the election, but you cannot amend the constitution. You file a short affidavit explaining what steps you are taking. We will record your undertaking in those terms that you will not give effect to amendment for elections," the bench observed. The top court said it would hear the matter on Friday. The apex court was hearing a plea seeking a stay on the upcoming election of the Bihar Cricket Association. SC refers to 5-judge bench on 'mitigating circumstances' in Death Penalty

The Supreme Court on Monday referred to a five-judge Constitution bench a suo motu plea on framing of guidelines on how and when potential mitigating circumstances be considered by courts during trial in cases which entail the death penalty as the maximum punishment. A bench headed by Chief Justice Uday Umesh Lalit said it was of the opinion that this matter required a hearing by a larger bench to have clarity and uniform approach as to when an accused, facing death penalty as maximum sentence, is required to be heard with regard to mitigating circumstances. Let matter be placed before the CJI for orders in this regard, Justice S Ravindra Bhat said while pronouncing the verdict. A death sentence is irreversible and every opportunity should be given to the accused for consideration of mitigating circumstances so that the court concludes that capital punishment is not warranted, the bench had observed while reserving its verdict on August 17. SC trashes 13,147 old cases in one stroke to unclog justice delivery system

In a big step towards unclogging the top judiciary burdened with humongous pendency of cases, the Supreme Court has, in one massive sweep, binned 13,147 old "diarized but unregistered" cases, including one filed more than three decades ago. An order issued by Registrar Judicial-1 Chirag Bhanu Singh on Thursday said all these cases were filed more than eight years ago but the defects pointed out by the Registry to the respective counsel or petitioners in-person were not "cured". The cases got the diary numbers prior to the year 2014, and the list included a case filed way back in 1987. These petitions just sat idly in the Registry, adding to the ever growing pendency. As per the data uploaded on the Supreme Court website, there were as many as 70,310 pendig cases as on September 1, 2022. These included 51,839 miscellaneous matters and 18,471 related to regular hearing. The order by the Supreme Court registrar said the parties to the cases seemingly do not intend to prosecute the ..

A day before Prime Minister Narendra Modi releases eight cheetahs brought from Namibia in a Madhya Pradesh national park, the Congress said Friday the proposal for 'Project Cheetah' was prepared in 2008-09 and approved by the then Manmohan Singh-led UPA government. The opposition party also said that in 2013, the Supreme Court had stayed the project, and in 2020, that the apex court allowed it, paving the way for the cheetahs to come ot India. "The proposal for 'Project Cheetah' was prepared in 2008-09. Manmohan Singh's government gave approval to it. The then Forest and Environment Minister, Jairam Ramesh, went to Cheetah outreach centre in South Africa in April 2010," the Congress said in a tweet. SC bench expresses displeasure in order over new case listing system

A Supreme Court bench, in a rare instance, has expressed displeasure in its judicial order over a new case listing mechanism introduced by Chief Justice U U Lalit for speedy disposal of matters pending for years. A bench headed by Sanjay Kishan Kaul, the number three-judge in seniority at present in the apex court, while hearing a criminal case passed the order, "The new listing system is not giving an adequate time to take up matters fixed for hearing like the present case as there are number of matters within the span of Afternoon' session". The bench, which passed the order on September 13, listed the matter for hearing on November 15. Under the new mechanism, the judges of the top court are working in two different shifts. The new system stipulates that on Monday and Friday of every week, 30 judges are to sit in a combination of two and deal with over 60 miscellaneous matters of each bench, including the fresh PILs. The Supreme Court Wednesday asked whether there is any authentic figure regarding dropping out of students from educational institutions in Karnataka because of the Hijab ban and the subsequent judgement by the high court on the issue. The Centre's decision to grant 10 per cent quota for the EWS category in admissions and jobs violates the basic structure of the Constitution on multiple counts including that it breaches the 50 per cent cap on reservation, the Supreme Court was told on Tuesday. The quota for the Economically Weaker Sections(EWS) is a "deceitful and a backdoor attempt" to destroy the concept of reservation, a lawyer submitted before the court, which was told it also excludes the poor belonging to the SCs, STs, and OBC category and defeats the creamy layer concept.
