SC suggests idea of private jails built by corporates as part of CSR

The Supreme Court Thursday expressed concern over the conditions of jails in the country and suggested the idea of building private jails involving big corporates. The apex court said big corporate houses can build private prisons as part of their Corporate Social Responsibility. In Europe, there is a concept of private jails. Then there is corporate social responsibility. If you give them sufficient inducement you can have jails built. Because you don't want the public exchequer to be used for that. There is an alarming number of under-trial prisoners. They will build it and give it to you and claim reduction under the Income Tax. A new concept will emerge. Then a new concept will evolve, from anticipatory bail to anticipatory jail, said a bench of Justices K M Joseph and Hrishikesh Roy. SC to hear pleas against TN, Maha's bull-taming sport Jallikattu on Nov 22

The Supreme Court on Thursday said it would hear on November 22 a batch of pleas challenging Tamil Nadu and Maharashtra laws allowing bull-taming sport 'Jallikattu' and bullock cart races. A five-judge Constitution bench headed by Justice K M Joseph was told by senior advocate Anand Grover, appearing for the petitioners, that the amendments with respect to Jallikattu are unconstitutional. The bench, also comprising Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and C T Ravikumar, said it would take up the matter in November. The top court had earlier said that the petitions challenging the Prevention of Cruelty to Animals (Tamil Nadu Amendment) Act, 2017, needed to be decided by a larger bench since they involved substantial questions relating to interpretation of the Constitution. Around 500 shop owners near Taj Mahal fear shutdown after SC order

With the Supreme Court's order to immediately stop all commercial activities within the 500-meter periphery of the Taj Mahal, the shop owners in this area are uncertain about the future of their businesses. There are about 500 odd restaurants, emporiums, budget hotels, cafes and other business outlets in the area that might be affected by the court order. The Supreme Court on Monday directed the Agra Development Authority (ADA) to prohibit commercial activities within the 500-meter periphery of the Taj Mahal. Talking to PTI, Charchit Gaur, vice chairman of ADA said, "We have begun the survey processing of the businesses and after the completion of the survey we will identify the businesses and act accordingly to the order of the Supreme Court." SC collegium proposes Orissa CJ Justice Muralidhar's transfer to Madras HC

The Supreme Court Collegium headed by Chief Justice Uday Umesh Lalit is learnt to have recommended to the Centre the transfer of Chief Justice (CJ) of Orissa High Court, Justice S Muralidhar, as the CJ of the Madras High Court, sources said on Thursday. The collegium, which also comprised justices D Y Chandrachud and Sanjay Kishan Kaul, met on Wednesday to deliberate upon issues including the transfer of high court judges, the sources told PTI. In the meeting, the collegiums resolved to transfer Justice Muralidhar in the same capacity to the Madras High Court. The apex court collegium is likely to come up with a statement on it, they said. Justice Muralidhar was initially appointed as a judge of the Delhi High Court in May 2006 and later was transferred to the Punjab and Haryana High Court on March 6, 2020. Victory of democracy: Eknath Shinde faction of Shiv Sena on SC ruling

The Shiv Sena rebel faction led by Maharashtra Chief Minister Eknath Shinde on Tuesday welcomed the Supreme Court's order as the "victory of democracy". Welcoming the SC's ruling that the Election Commission will continue to hear the plea of the Shinde faction seeking the poll symbol of Shiv Sena, its spokesperson Naresh Mhaske said, "the rights of the EC and its powers have remained intact due to the decision of the apex court". Kalyan MP and CM Shinde's son Shrikant Shinde hailed the ruling as the victory of democracy. "I hope they (Uddhav Thackeray camp) will learn a lesson. They will also realise which is the real Shiv Sena of Bal Thackeray," he added. Mhaske said 40 MLAs of Shiv Sena and 12 of the 18 MPs are with the Shinde group, besides more than 80% of the district chiefs, corporators and councillors in Maharashtra.

The Supreme Court on Tuesday said a five-judge Constitution bench would hear on November 9 the legal issue concerning the scope of legislative and executive powers of the Centre and Delhi government over control of services in the national capital.
