SC to hear plea on April 28 to ban explicit content on OTT, social media

The Supreme Court is scheduled to hear on Monday a plea seeking a direction to the Centre to take appropriate steps to prohibit streaming of sexually explicit content on over the top (OTT) and social media platforms. The plea has sought laying down of guidelines constituting a National Content Control Authority to prohibit sexually explicit content on these platforms. According to the top court's cause list of April 28, the petition is slated to come up for hearing before a bench of Justices B R Gavai and Augustine George Masih. The plea claimed there were pages or profiles on social media sites that were disseminating pornographic materials without any filter and various OTT platforms were streaming content that also has potential elements of child pornography. "Such sexually deviant material pollute the minds of youth, children and even grown up persons which gives rise to perverted and unnatural sexual tendencies thereby leading to an increase in the crime rate," it said. The Information and Broadcasting Ministry is examining the existing statutory provisions and the need for a new legal framework to regulate "harmful" content amid complaints of "obscenity and violence" being shown on digital platforms. In its reply to a parliamentary panel, the ministry said there is a growing concern in the society that the constitutional right of "freedom of expression is being misused to showcase obscene and violent content on digital platforms". Blocked 18 OTT platforms for publishing obscene, vulgar content: Govt in LS

Government blocked 18 OTT platforms this year for publishing obscene and vulgar content, Minister of State for Information and Broadcasting L Murugan told the Lok Sabha on Wednesday. In a reply to a question by Shiv Sena-UBT member Anil Desai, Murugan said the IT Rules of 2021 cast specific due diligence obligations on intermediaries to make reasonable efforts by themselves against displaying or spreading obscene or pornographic content. The Rules also provide for a Code of Ethics for publishers of news and current affairs on digital media and publishers of online curated content (OTT platforms). "The Ministry of Information and Broadcasting has taken action in coordination with various intermediaries, and blocked 18 OTT platforms on 14th March, 2024 for publishing obscene, vulgar, and, in some instances, pornographic content under these provisions," Murugan said.
