The Delhi High Court Tuesday set aside the decision of Mayor Shelly Oberoi to call for a repoll to elect six members of the MCD standing committee and directed her to declare forthwith the results of the poll held on February 24. Justice Purushaindra Kumar Kaurav said the mayor, also the returning officer, acted beyond her powers and her decision was legally impermissible. The act of the mayor in rejecting the ballot after the stage of scrutiny and determination of quota was bad in law, the judge said. The court's order came on petitions by BJP councillors Kamaljeet Sehrawat and Shikha Roy against the mayor's decision to order repoll for six MCD standing committee seats. "Writ petition is allowed. Impugned order is set aside. Returning officer is directed to declare the result forthwith," the court ordered. The high court had stayed the repoll on February 25. The petitioners had alleged that the mayor, who belongs to AAP and was the returning officer, wrongly invalidated one of t
All the 12 zones of the Municipal Corporation Department here will have at least one unique 'pink park' and 'sculpture park,' officials said on Monday. The horticulture department is planning to develop more than 150 parks in the initial phase. Mayor Shelly Oberoi convened a review meeting to discuss and implement Chief Minister Arvind Kejriwal's vision of redeveloping Delhi's parks across all 12 zones. "She announced that the Municipal Corporation of Delhi (MCD) will embark on an extensive project, creating over 150 parks in the first phase. Additionally, each zone will boast a unique Pink Park and Sculpture Park," the mayor's office said in a statement. "The MCD aims to establish a 'pink park' and a 'sculpture park' in each zone. This groundbreaking initiative will result in the creation of 12 pink parks and 12 sculpture parks during the initial phase. A detailed list of these parks, categorised by zones, will be released soon. "Pink Parks will primarily cater to women, boasting

A large number of illegal dairies and a dearth of space in the cowsheds are the reasons behind unleashing of stray cattle on the city roads, where driving is increasingly becoming difficult, and dangerous, with the stately jaywalkers in the way. The matter is hardly helped by porous state borders which allow cattle from other states to infiltrate and the intransigent attitude of the illegal cattle owners against authorities, say the authorities. A senior MCD official suggested microchipping cattle to identify the animal and its owner to control the issue. Last year, the civic body impounded over 13,000 cattle and took action against dozens of illegal dairies. Last month, an NGT panel rapped the Municipal Corporation of Delhi for "lacking comprehensive data" on dairy farms and cow sheds in areas under its jurisdiction and asked it to carry out a complete inventory of the dairy farms by June 30. The official acknowledged that the issue is far from under control due to a lack of ...
The Supreme Court on Wednesday observed that giving the Lieutenant Governor the power to nominate aldermen in the Municipal Corporation of Delhi would mean that he can destabilise an elected civic body. A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala made this observation while reserving its verdict on plea of the Delhi government challenging the LG's power to nominate aldermen in the MCD. "Is the nomination of 12 specialised people in MCD is of that much concern to the Centre? Actually, giving this power to the LG would effectively mean that he can destabilise the democratically elected Municipal Committees because they (aldermen) will have voting powers also", the bench observed. On Tuesday, the top court had asked about the "source of power" of the LG under the Constitution and the law to nominate aldermen to the MCD without the aid and advice of the elected government. It was hearing a petition filed by the AAP government challenging the ...
The LG's office said that the discretionary power of "administrator" under the DMC Act is recognised independent of any interference by the other four sources of authority
Delhi Mayor Shelly Oberoi on Friday held a high-level meeting on the city's monsoon preparedness and asked officials to identify areas where there is frequent waterlogging during the rainy season. To ensure effective implementation of proposed plans, regular meetings will be organised on this subject twice a month, she said. With the aim of ensuring safety and convenience of citizens during heavy rainfall, the meeting focused on addressing the issue of waterlogging in several areas of the city, her office said in a statement. During the meeting, Oberoi emphasised on the importance of identifying areas prone to frequent waterlogging. Places such as Rani Khera, Bakkarwala, Najafgarh, Narela, and Mehrauli were highlighted as being particularly susceptible to water accumulation, it said. In light of this, the mayor emphasised the need for special planning and targeted measures to mitigate the impact of waterlogging in these areas. She also instructed officers to work in coordination w
Mayor Shelly Oberoi Friday asserted no prejudice will be caused if re-polling is held for choosing the six members of the MCD standing committee, as the Delhi High Court reserved its verdict on BJP councillors' challenge to the re-election. The high court had on February 25 stayed the re-election on the petitions filed by BJP councillors Kamaljeet Sehrawat and Shikha Roy. While the senior lawyers for the petitioners had earlier contended the Mayor, who is also the returning officer, acted in a malafide manner when she called for re-election upon finding the election results "politically unpalatable", senior counsel representing Oberoi Friday underscored that the re-polling was essential to ensure free and fair elections following the "ruckus" in the House during the polls held on February 24. "There is no prejudice in re-polling. Please test if it will cause prejudice to them (petitioners). They say the ballot is going to BJP then this will again happen," senior advocate Rahul Mehra
The Supreme Court Friday observed the lieutenant governor has to act on the aid and advice of the council of ministers of the Delhi government in nominating 10 aldermen to the MCD, a day after it substantially clipped the wings of the Centre's point man in running day-to-day administration of the national capital. The top court, which was hearing a petition filed by the AAP government challenging the nominations to the Municipal Corporation of Delhi (MCD), meanwhile, permitted the counsel for the office of the lieutenant governor to withdraw the earlier reply in the wake of the SC's judgement holding that the LG has to act as per the aid and advice of the council of ministers. A five-judge Constitution bench on Thursday held that the Delhi government has legislative and executive powers over all but three services public order, police and land. Why don't you (Additional Solicitor General Sanjay Jain, appearing for the office of the LG) advice the LG that he cannot nominate members

Delhi Mayor Shelly Oberoi on Wednesday said the municipal corporation is planning to provide smartwatches to sanitation workers for monitoring them at work on a daily basis. She said this while interacting with reporters during an inspection of a waste-to-energy plant at Tughlakabad. "We are working on a plan to provide smartwatches to sanitation workers and very soon we will execute it. Through these watches, we can track and monitor them at work on a daily basis," the mayor said. On the stray dogs' menace, she said, inspections will be done at various sterilisation centres, and the MCD will partner with more NGOs. On the issue of stray cows, she said, there are four 'gaushalas' under the Delhi government. "And, I will soon write a letter to Delhi cabinet minister Gopal Rai to open a fifth 'gaushala'," Oberoi said. Asked about the waste-to-energy plant, she said, a new plant is proposed to be built at Narela Bawana, adding, "Paperwork is happening, and in three years, it should
The Delhi Government is working on its food truck policy which will be finalised within the next couple of months and put up for public feedback, officials said. According to officials, meetings have been planned with different stakeholders to discuss the various aspects of the policy. The stakeholders include the MCD, DMRC, traffic police and the Transport Department, they said. "We have identified metro stations and parking sites as hubs for setting up food trucks. But it will have to be seen under which category these trucks can be placed by the Transport department and also the rules governing their plying in Delhi, the official said. We will also need the Delhi Metro and the MCD to be on board since we plan to station these food trucks at metro stations and parking sites," he said. Explaining how the framework is likely to be, the official said that the food trucks will come and go from the site where they will be stationed. They will operate in the night hours -- between 8 p
Delhi Urban Development Minister Saurabh Bharadwaj on Tuesday demanded that the lieutenant governor conduct a high-level inquiry into alleged corruption in the MCD while it was under the BJP's control. The Municipal Corporation of Delhi (MCD) earned a revenue of about Rs 8,900 crore in the financial year 2022-23, a rise of more than 22 per cent compared to the earnings in the year before, according to officials. The three erstwhile civic bodies of Delhi were unified into the MCD in May 2022. The "perennially cash-strapped" MCD has registered record revenue receipts in 2022-23, witnessing a jump of 22.77 per cent over the year (FY 2021-22) prior to it, when the figure was Rs 7,249.25 crore, a senior official of the Raj Niwas said. Following the release of these figures, Bharadwaj said LG V K Saxena's comments have raised questions on the 15-year tenure of the Bharatiya Janata Party (BJP) at the MCD. He expressed concerns about the LG's statement over the MCD's revenue growth over t

The Supreme Court on Tuesday said it will hear on May 8 a plea of the Delhi government challenging the power of the Lieutenant Governor to nominate 10 members to the Municipal Corporation of Delhi and sought the quashing of their nomination. A bench comprising Chief Justice D Y Chandrachud and J B Pardiwala took note of the fact that a letter seeking adjournment of proceedings before it has been moved by the counsel representing the office of the LG. We will then list it for hearing on Monday that is May 8, the bench said. Solicitor General Tushar Mehta and senior advocate A M Singhvi appeared for the office of the LG and the Delhi government respectively. The top court earlier had orally observed as to how the Lieutenant Governor (LG) can act without aid and advice of the council of ministers in nominating 10 members to the MCD. Prior to this, it had issued notice on the plea of the Delhi government seeking quashing of the nomination of the 10 members. The office of the LG had s
The Delhi High Court has directed coordination committees of the MCD and police to take action against unauthorised dairies operating in the national capital within 48 hours of receiving complaints in the matter. The April 25 order was passed on two contempt pleas that claimed unauthorized dairies were operating in Kotla Mubarakpur and Panchsheel Enclave in contravention to a 2019 judicial order directing the authorities, including the Municipal Corporation of Delhi (MCD) and the city police, to take action against illegal dairies. The petitioners, represented by senior advocate Vivek Sibal, said there is a vicious cycle where the MCD takes steps to rescue cattle in illegal dairies. However, after a few days, the cattle find their place at the same dairy, the advocate said. Justice Manmeet Pritam Singh Arora said, "He (MCD counsel) states that an appropriate direction can be issued by this court that upon receiving a complaint from any citizen, including the petitioners herein ...
The Municipal Corporation of Delhi "lacks comprehensive data" on dairy farms and 'gaushalas' in areas under its jurisdiction, an NGT panel said asking the civic authorities to carry out a complete inventory of the dairy farms by June 30. The solid-waste monitoring committee of the National Green Tribunal (NGT), which recently held a review meeting, asked the MCD to submit an action plan, including zone-wise details of dairy waste generated in their areas by July 31. In February, the NGT constituted the committee with Lieutenant Governor V K Saxena as its head. The panel submitted its report on Monday. In its report, the panel said that the NDMC and Delhi Cantonment Board (DCB) informed that there is no dairy functioning in their jurisdictional area. MCD officials did not respond to the questionnaire sent to them by PTI in this regard. According to the "Guidelines for Environmental Management of Dairy Farms and Gaushalas" by the Central Pollution Control Board (CPCB), July 2020, loc
The Municipal Corporation of Delhi (MCD) is planning to procure around 60,000 dual desks for its schools out of which 25,000 could be made by Central Tihar Jail inmates with orders likely to be placed soon, officials said on Thursday. There has been a shortage of desks in municipal schools and the issue was also raised by the Delhi Commission for the Protection of Child Rights (DCPCR) recently, an MCD official said. He said the procurement are beng made so that students are not forced to sit on floors. An official said around nine lakh students study in MCD schools and there is a shortage of 74,142 dual desks (27,056 of small size and 47,086 big size) currently. The erstwhile East Delhi Municipal Corporation (EDMC), before it was merged with NDMC and SDMC to make a unified MCD, had already given order for the procurement of 14,489 dual desks to Delhi Prison. "As many as 59,653 dual desks (22,834 small sized and 36,819 big sized) are yet to be procured," the official said. "Order
